1996-02-26 CITY COUNCIL AND PLANNING AND ZONING JOINT PUBLIC HEARING MINUTES 157 MINUTES OF A JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND,TEXAS, HELD ON FEBRUARY 26, 1996, AT 6:30 P M. Absent from hearing City Manager Paul Grohman PURPOSE OF THE HEARING Application No 59 REQUEST OF RONALD HAUSMAN AND JAMES A. BANFIELD, OWNER, FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF SAID CITY FROM CLASSIFICATION SINGLE FAMILY DWELLING DISTRICT (R-3) TO MULTI-FAMILY DISTRICT (MF) ON THE FOLLOWING DESCRIBED PROPERTY, TO-WIT 6 01403 ACRES OF LAND, OUT OF A 172.0566 ACRE TRACT OUT OF TRACT 1, THOMAS J GREEN SURVEY, ABSTRACT 198, BRAZORIA COUNTY, TEXAS (ALEXANDER LANE) STAFF REVIEW Assistant City Manager Richard Burdine reviewed the proposed area. 158 PERSONS WISHING TO SPEAK IN SUPPORT 1 Tony Banfield - Friendswood, TX. Mr Banfield spoke on behalf of the proposed project, and stated that the project is for a seniors apartment complex similar to The Bedford in Friendswood He pointed out that the complex would have added services, facilities and amenities that are not usually found in a regular apartment community, including transportation, dining facilities, libraries, arts & crafts programs, etc Mr Banfield stated that many of the tenants in seniors complexes do not have vehicles or no longer drive them, so increased traffic would not be an issue. The average age of the tenants would be 75-80 years old, and would consist largely of females. 2. Bob Alexander - 314 S Beauregard, Alvin, Tx. Mr Alexander addressed the Council on behalf of Mr Banfield and Mr Hausman and noted their good reputation in the business community He stated that he had no financial interest in the property, but wanted the citizens to consider the fact that Mr Banfield and Mr Hausman already own the land and have a plan for it, they should consider granting their request unless it was detrimental to the area, which it does not seem to be. PERSONS WISHING TO SPEAK AGAINST: The following citizens spoke against the proposed request. 1 Bill Helms - 3108 Lee Circle Court 2. Debbie Morina - 3001 London Court. She presented a petition containing 155 signatures of residents opposing this project. 3 Rodney Horn - 3221 Alexander Parc 4 Bruce Kirby - 3207 Lee Circle. Mr Kirby read a letter from the residents who oppose the project. 5 Bill O'Rourke - 3201 Lee Circle i 6 Kathy Patterson - 3214 Lee Circle Court 7 Art Hall - 3226 Three Sisters Circle 11, 8 Brenda Crager - 3202 Lee Circle 9 James Redlinger - 2201 Alexander Lane 10 - 2920 Cambridge Circus 11 Frank Gallington - 3201 Three Sisters Circle 12. C D Anderson - 3215 Jacquelyn Drive 13 Brian Armbruster - 3221 Lee Circle 14 Randy Patterson - 3214 Lee Circle Court 15 Linda Redlinger - 2201 Alexander Lane 16 Glenn Garrison - 1902 Meadow Creek 17 Andrea Bloom - 3217 Alexander Parc 18 Linda Sullivan - 3101 Lee Circle Court 19 Connie Schmoltz - 3229 Three Sisters Circle 20 Bob Crager - 3202 Lee Circle The majority of the citizens voiced their concerns over the added traffic problems that would occur with the building of this project. It was pointed out that even though the senior citizens may not drive or own vehicles, their family members will and this will increase the traffic in the area. They also noted that this area is a single-family subdivision and should remain that way as there are already several apartment complexes located there. Request was made by several citizens that other areas around the City be considered for this project, such as in the west portion towards Hwy 288 that y` are already zoned for multi-family dwellings Several residents confirmed that The Bedford is a very nice facility, but they did not want one in their subdivision Other problems noted included drainage, how to prevent the builders from turning the complex into something other than a seniors project, increase in traffic due to service providers coming into the complex, the safety of the children, the loss of tax revenues for the school district, increase in crime, increase in noise, and comparison to the City of Pasadena's problems with apartment complexes. yi. Vn 159 QUESTION AND ANSWER PERIOD Councilmember Tetens inquired as to whether this was the only tract of land which Mr Banfield owns in this particular area, and Mr Banfield noted that it was. Councilmember Weber asked Mr Banfield if he would consider building his project elsewhere. Mr Banfield stated he would most likely put the property up for sale and possibly look elsewhere, he was not certain at this point. P&Z Commissioner Peggy Mayfield-Royer commented that senior citizen complexes are usually best located close to shopping areas and churches. P & Z Chair Pat Lopez cited the following questions. 1) Did Mr Banfield consider single- family dwellings?, 2) Was this project going to be one of Mr Banfield's direct holdings? Mr Banfield noted that he is not a builder and had only considered multi-family dwellings, and he continues to maintain his first multi-family dwelling which was built in 1973, so he plans to maintain this project, as well After brief discussion, it was noted that if the application were to be approved for the multi-family dwelling, it could not be changed further down the line. Councilmember Cole asked about securing the apartment complexes Mr Banfield noted that there are security gates requiring codes at all of their complexes. Councilmember Beckman inquired about landscaping or a "buffer zone" between the proposed apartment complex and the adjacent homes Mr Banfield noted that these are standard with all of their projects. He also stated that he is not certain whether the project will be one or two story at this time. Mayor Reid noted that the Planning & Zoning Commission would be meeting in the Second Floor Conference Room immediately following the public hearing, and the public is invited to attend that meeting ADJOURNMENT The public hearing on Application No 59 adjourned at 7 45 P M ***** PURPOSE OF THE HEARING Application No 60 REQUEST OF RAY WHALEY, OWNER, FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF SAID CITY FROM CLASSIFICATION SUBURBAN DEVELOPMENT DISTRICT (SD) TO COMMERCIAL DISTRICT (C) ON THE FOLLOWING DESCRIBED PROPERTY, TO WIT 0 252 ACRES OF LAND OUT OF LOT 46 E-1 AND 0 103 ACRES OF LAND, MORE OR LESS, OUT OF LOT 46 E-2 FOR A TOTAL OF 0 355 ACRES OUT OF TRACT 46 OF THE ALLISON RICHEY GULF COAST HOME COMPANY SUBDIVISION OF SECTION 8, F B DRAKE SURVEY, ABSTRACT 504, BRAZORIA COUNTY, TEXAS (6609 BROADWAY) STAFF REVIEW Assistant City Manager Richard Burdine noted that the property in question is located in the area that was annexed in December, 1995 PERSONS WISHING TO SPEAK IN SUPPORT 1 Ray Whaley - 5502 Robin Sound Mr Whaley noted that he has been at this location for 22 years and requested that Council take this into consideration and approve his request. 160 PERSONS WISHING TO SPEAK AGAINST. QUESTION AND ANSWER PERIOD It was noted that the business is already in existence at this location, there is a commercial building in front of the business, and the owner has just completed a new building which is in conformance with all safety regulations ADJOURNMENT The public hearing on Application No 60 was adjourned at 8 00 p mI ***** PURPOSE OF THE HEARING Application No 61 REQUEST OF RONALD STEVE SMITH, OWNER, FOR AN AMENDMENT TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF SAID CITY FROM CLASSIFICATION SINGLE FAMILY DWELLING DISTRICT (R-2) TO SUBURBAN DEVELOPMENT RESIDENTIAL DISTRICT (SDR) ON THE FOLLOWING DESCRIBED PROPERTY, TO-WIT APPROXIMATELY 2.79 ACRES OUT OF RESERVE A IN TWIN WOOD SUBDIVISION (1255 OLD ALVIN ROAD) STAFF REVIEW Assistant City Manager Richard Burdine read a letter from Mr Ronald Steve Smith requesting an extension for his public hearing as he is out of town on business.
