A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, APPROVING WORK AUTHORIZATION #12 SUPPLEMENT #2
FOR RIGHT-OF-WAY ACQUISITION SERVICES ASSOCIATED WITH THE
PEARLAND MOBILITY AND DRAINAGE BOND PROGRAM (WALNUT
STREET IMPROVEMENT PROJECT).
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That certain contract by and between the City of Pearland and Turner,.
Collie and Braden, Inc., ("T C & B)for Program Management of the Pearland Mobility and
Drainage Bond Program was authorized by the City Council on December 10, 2001.
Section 2. That T C & B has developed work authorization #12 Supplement#2,
which is attached hereto as Exhibit "A".
Section 3. That work authorization#12 Supplement#2 for right-of-way acquisition
services associated with the Walnut Street Improvement Project is hereby approved.

Supplement No.2
This Work Authorization is made pursuant to the terms and conditions of the Pearland
Mobility&Drainage Bond Program,hereinafter identified as the"Contract," entered into
by and between the City of Pearland("City"), and Turner Collie&Braden Inc.
("Engineer).
PART 1. Work Authorization No. 12 is related to the improvement of Walnut Street
improvements,Veterans to Houston. The Engineer will perform Right-of-Way
Acquisition Services under this Authorization.
PART 2. The maximum amount payable for services under this Work Authorization is
$40,500.00. This amount is based on the following: See attached fee proposals submitted
by: Lockwood Andrews&Newnam, Inc. in the amount of$40,500.00 dated February 6,
2003.
PART 3. Payment to the Engineer for the services established under this Work
Authorization shall be"Reimbursable on a per Parcel Basis".
PART 4. This Work Authorization shall become effective on March 4, 2003 and shall
terminate on November 12, 2005,unless extended by a supplemental work authorization.
PART 5. This Work Authorization does not waive the parties' responsibilities and
obligations provided under the contract.
PART 6. This Work Authorization is hereby accepted and acknowledged below.

® Conduct a 25-year title investigation to determine fee owner.
• Secure preliminary title committnerrt and title insurance for all parcel t2hrgs
appraised at greater than $25,000, insuring acceptable title to the City ofPearland.
Ntgotiatioa Services
• Analyze appraisal report, and confirm value prior to malting offer for each track
• Review right-of-way map, field notes, and parcel sketch for unusual conditions
such as contamination, underground storage tanks, etc.
• Conduct ail negotiations and contacts with the property owners.
® Prepare the initial offer letter, instruments of conveyance, and other documents
required by TC&B on approved forms.
• Contact each property owner, or owner's designated representative, to present the
written offer and appraisal report.
Maintain follow-up contacts and secure the necessary instruments upon
acceptance of the offer for the closing
• Respond to property owner inquiries, maintaining written documentation of
inquiries and responses
IP Prepare a separate negotiator report for each tract.
e If the offer is accepted, prepare tbedeed and other necessary items and deliver for
owner's signature.
® Maintain tract file for delivery to TC&B.
Transmit to TC&B any written counter offer from property owners, including
supporting documentation, and provide a recommendation with regard to
proposed settlements.
• Prepare final offer letter and forward to property owner.
• Perform follow-up contact with property owner concerning final letter offer_
• If the property owner does not accept final offer letter, prepare the tract file for
condcuuiation and send to TC&B.
Closing Services
• Coordinate with the Title Co>npany to obtain an updated title commitment along
with other forms necessary when requesting the payment.
+ Attend closings and provide closing services.

We are pleased to submit our proposal to provide right of way services for the above referenced
project
We propose to provide right of way acquisition services for the Walnut Road Project for a total
cost of $40,500.00. This proposal is based on providing acquisition services for fifteen (15)
parcels at $2,700.00 per parcel
Our proposal to provide right of way acquisition services is based upon our estimate that a total
of fifteen parcels will have to be acquired for this project. Our proposed scope of work for this
project is listed on the attachment entitled, City of Pearland Mobility and Drainage Bond
Program, Right -of -Way Acquisition Assistance. The proposal does not include provisions for
providing appraisal reports, condemnation support or providing appraisals for condemnation
proceedings
We understand that the effort described in this proposal is of highest immediate priority, and we
will begin work upon notice to proceed and your provision of parcel maps and metes and bounds
descriptions.
