RESOLUTION NO. R2007-114
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO
NEGOTIATE A GMP COST PLUS DESIGN/BUILD CONTRACT WITH
GILBANE BUILDING COMPANY FOR CONSTRUCTION OF A PUBLIC
SAFETY BUILDING.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: •
Section 1. That the City Manager or his designee is hereby authorized to
negotiate a GMP Cost Plus design/build contract with Gilbane Building Company for
construction of.a Public Safety Building .

Re: City of Pearland Design/Build Selection for the Public Safety Building
Dear Mr. Palmer:
This letter is to provide you with an update on the City of Pearland's selection of a
Design/Build Firm for the City's Public Safety Building. After a series of workshops the
Council has decided to move forward with a motion that was passed at the May 14, 2007
City Council Meeting. The motion stated that the City will "proceed with Design Build
as the delivery process for the Public Safety Building and require the two candidates to
submit a Guaranteed Maximum Price proposal."The intent of this motion was clarified at
the June 11,2007 meeting and staff is preparing to move forward with the process.
With that direction, both firms that were short listed for Phase 2 of the Request for
Qualifications are being asked to re-submit their Phase 2 submittal,based on the original
published selection criteria. Addendum#13 is forthcoming and will clarify the original
published criteria, clarify the proposed contract, and rescind previous addenda that
changed the original published selection criteria.
We appreciate your patience throughout this process and encourage you to remain a
candidate for this project as we bring the selection process to its conclusion.

ADDENDUM NO. THIRTEEN

This Addendum forms a part of the Request For Qualifications Document and will be
incorporated into this document as of the date above. Questions concerning this
addendum should be addressed to the City's Consulting Architect.
PART 1 — Modifications to Previous Addenda
I Item No. 1: Modify Addendum No, 8,Answer No. 5, Sentence No. 4 as follows:
" The City will require a GMP prior to execution of a contract for Design-Build
Services."
AND, Sentence No. 6 as follows:
"The City will ask for a GMP, to include all work contained by the project that will form
the basis for the agreement between the Design builder and the City. This GMP will be
refined as design progresses to ultimately produce a final project cost."
Item No. 2: Modify Addendum No. 9,Item No. 1 as follows:
"Item No. 1: Additional Direction for Step Two Submittal:
Delete the following: " Should the Design Build Firm wish to present alternative
approaches to the RFQ such as Stipulated Sum or Cost plus fee, they should be clearly
defined as such and clearly separated at the end of the Step Two Response. The City will
entertain merits of the various options for the AIA A141 contract during the interview
process. Design Build firms will not be penalized for not completely answering the Step
Two Response. "
Item No. 3: Modify Addendum No. 10,Item No. 1 as follows:
"Item No. 1:
1. Question: Based on Addenda 9, is the data required in Exhibits B, C & D
optional? Is the selection criteria changing? Can you please provide those
changes prior to our submittal on the 21st of March?
Answer: Addenda 9 has been changed and the Exhibits are not optional. The
selection criteria will be based on the RFQ as originally issued. The revised
responses for Step Two will be evaluated based on the originally published
criteria. The City will schedule a second interview as a component of the Step
Two submittal. The City will contact Offerors to schedule interviews.
2. Question: Addenda 9 eludes to alternative delivery methods such as
stipulated sum or cost plus.
a. Are you still planning to use the AIA 141 as the contract?
b. How will the selection criteria be used in evaluating alternative
responses when the original RFQ process allowed for GMP responses
only? (This is not an apples to apples comparison). If not, how can
we know what to propose on?
Answer: Alternative deliveries to the GMP process will not be considered.
Prospective Offerors shall submit based on Cost Plus GMP contract. The City is
still anticipating using the AIA A141 contract.
Item No. 4: Modify Addendum No. 11,Item No. 1 as follows:
"Item No. 1:
1. Question: Are we to assume that we should omit the second part to
Section F1.1 which asks "Submit how approved changes to the contract
would be marked up including all fees and overhead and other costs"?
Answer: The second part to Section F1.1 should be completely answered as part
of the Step Two Submittal."
Item No. 5: Modify Volume 1, Request For Qualifications; Section IX—Submitting
Step Two Additional Information:
Replace the first paragraph, with:
"Sealed responses shall be addressed and delivered to the City of Pearland City
Secretaries Office, City of.Pearland City Hall, on or before 2:00 PM on Monday July 9th,
2007, at 3519 Liberty Drive Pearland, Texas 77581 (281) 652-1706. Submittals not date
stamped by the City of Pearland City Secretaries Office by the time listed above will not
be opened."
