R2000-124 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO ENTER INTO A SUPPLEMENTAL CONTRACT WITH WALSH/FREESE AND NICHOLS, INC. FOR ADDITIONAL ENGINEERING SERVICES ASSOCIATED WITH THE DIXIE FARM ROAD WATER AND SEWER PROJECT. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain supplemental contract by and between ,the City of Pearland and Walsh/Freese and Nichols, Inc.,a copy of which is attached hereto as Exhibit "A" and made a part hereof for all purposes, is hereby authorized and approved. Section 2. That the City Manager or his designee is hereby authorized to execute and the City Secretary to attest a supplemental contract with Walsh/Freese and Nichols, Inc. for additional engineering services associated with the Dixie Farm Road Water and Sewer Project. COKER CITY ATTORNEY EXHIBIT a THE STATE OF TEXAS § THE COUNTY OF BRAZORIA § SUPPLEMENTAL AGREEMENT NO. 1 TO CONTRACT FOR ENGINEERING SERVICES DIXIE FARM ROAD WATER AND SANITARY SEWER IMPROVEMENTS This Supplemental Agreement to contract for engineering services is made by and between the City of Pearland hereinafter called the"Owner" and Walsh/Freese and Nichols, Inc. "Engineer," for engineering services concerning the Dixie Farm Road Water and Sanitary Sewer Improvements project. WHEREAS, Section V, Fees, states certain basic engineering fee based on a preliminary construction cost, and also limits the amount payable for additional services to $22,915, and WHEREAS,the Owner desires to expand the Scope of Work to include additional sanitary sewer lines, and WHEREAS,this Scope of Work change results into changes in preliminary construction cost, basic engineering fee,-and additional services fees , and contract time, NOW THEREFORE,the Owner and the Engineer agree that said contract is amended as follows: (1) Section II: Character and Extent of Services 1. Conduct supplemental topographical field survey to gather the necessary information for the purpose of additional sanitary sewer line design (Additional Services). 2. Prepare construction plans and details for approximately 1,930 feet of 21" gravity sanitary sewer line to be extended along Dixie Farm Road from Mary's Creek bypass to Oakbrook Drive. 3. Prepare construction plans and details for approximately 1,000 feet of 6" force main to be extended along south side of Oakbrook Drive from an existing lift station to Dixie Farm Road. 4. Conduct additional geotechnical investigation along 21" gravity sanitary sewer line(Additional Services). Sub-consultant proposal is attached. 1 5. Modify current gravity sewer line and lift station designs between Mary's Creek Bypass and F. M. 518 to tie-in the additional sanitary sewer line (Additional Engineering Services). 6. Modify and revise current plans, specifications, and quantities to incorporate the additional gravity sanitary sewer and force main. (2) Section III-Period of Services is revised to change the one hundred fifty(150) calendar days to two hundred seventy(270) calendar days. (3) Section V-Fees, is revised to change the basic engineering fee based on a preliminary construction cost of$1,500,000 at 8.25%fee to a preliminary construction cost of $1,874,385 at 8%fee, resulting into the following revised fees: • Preliminary& Design Phases (85% of fee) $127,457 Construction Phase (15% of fee) $ 22,493 Total Estimated Basic Fee. $149,950 The Engineer's fee for Additional Services for the Project shall be revised to state as follows: 1. Topographical Field Survey and preparation Of Lift Station Easement(Not-to-Exceed) $ 26,000 2. Geotechnical Boring plus 10% $ 4,565 3. Additional services to modify design and revise plans (Not-to-Exceed) $ 10,000 $ 40,565 All other terms and conditions of the contract are unchanged and remain in full force and effect. . • • 2 IN WITNESS WHEREOF,the City of Pearland and the Engineer have executed duplicate counterparts of the Supplemental Agreement.
