2017-05-18 ZONING BOARD OF ADJUSTMENT REGULAR MEETING MINUTESMINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF PEARLAND, TEXAS HELD ON THURSDAY, MAY 18, 2017 AT 6:00 P.M. IN THE COUNCIL CHAMBERS, CITY HALL CALL TO ORDER The following were present: ZBA Chairperson Dale Pillow Board Member Don Glenn Board Member Gary Shrum Alternate Board Member John Gehring Also in attendance were: Deputy City Attorney Lawrence Provins, City Planner Jai McBride, Planning Technician Samin Bazargan and Office Assistant Alma Gonzales. ZBA Chairperson Dale Pillow called to order the public hearing at 6:02 p.m. Alternate Board member John Gehring made a motion to approve, Board member Don Glenn seconded the motion. The motion carried 3-0. APPROVAL OF MINUTES 1. ZBA Minutes for April 6, 2017 meeting NEW BUSINESS ZBA APPLICATION NO. VARZ 17-00003 ZBA Chairperson Dale Pillow opened the public hearing for ZBA Application No. VARZ 17-00003 at 6:03 p.m. W_-IA0ali14 101 W -.11 P11 Eel - Z 7 7 Chairperson Dale Pillow read the purpose of the hearing. A request of Ernesto Quintanilla, applicant; on behalf of Shoukat Dhanani, owner; for a Special Exception/Variance as permitted by the Unified Development Code, Ordinance No. 2000-T, for a reduction in required parking spaces from 47 spaces to 41 spaces in order to retain two mature oak trees on the following described property Legal Description: Being a tract of land containing 2.2764 Acres of land situated in the H.R. & B.R.R. Company Survey, Abstract No. 24, Brazoria County, Texas, said 2.2764 Acre tract of land also being out of and part of Lot 48, of Allison Richey Gulf Coast Home Company, Section 19, as recorded in Volume 2, Page 23 of the Brazoria County Map Records. Page 1 of 2 ZBA minutes 05/18/17 General Location: 8027 Broadway Street, Pearland Texas, 77581 City Planner Jai McBride presented the exhibits and staff report. One comment form was received. Staff recommends approval of the variance to allow a reduction in required parking from 47 spaces to 41 spaces in order to preserve the 42 -inch caliper and 47 -inch caliper oak trees by incorporating existing trees into the site plan. The applicant was not present. Jerry Bradshaw, City of Pearland Urban Forester, 3509 Orange St., Pearland TX 77581. Mr. Bradshaw explained to the Board the history of the tree and the importance of preserving and was in favor of the variance. Board Member Gary Shrum questioned if changing the footprint effect the size of the detention and outdoor lighting, City Planner Jai McBride informed him that it would not have any effects and all requirements would stay the same. Board Member Don Glenn made a motion to approve, Board Member Gary Shrum seconded the motion.
