2017-04-06 ZONING BOARD OF ADJUSTMENT REGULAR MEETING MINUTESMINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF PEARLAND, TEXAS HELD ON THURSDAY, APRIL 6, 2017 AT 6:00 P.M. IN THE COUNCIL CHAMBERS, CITY HALL CALL TO ORDER ZBA Chairperson Dale Pillow called to order the public hearing at 6:01 p.m. The following were present: Chairperson Dale Pillow Vice -Chairperson Mark Lewis Board Member Don Glenn Board Member Jerry Acosta Alternate Board Member John Gehring Also in attendance were: Deputy City Attorney Lawrence Provins, City Planner Jai McBride, Senior Planner Martin Griggs, Planning Technician Samin Bazargan and Office Supervisor Judy Brown. NEW BUSINESS ZBA APPLICATION NO. VARZ 17-00001 ZBA Chairperson Dale Pillow opened the public hearing for ZBA Application No. VARZ 17-00001 at 6:02 p.m. CALL PUBLIC HEARING TO ORDER Chairperson Dale Pillow read the purpose of the hearing. PURPOSE OF HEARING: A request of Glenn Alan Balius/SLI Group, Inc., applicant; on behalf of First United Methodist Church, owner; for a Special Exception/Variance as permitted by the Unified Development Code, Ordinance No. 2000-T, to allow for development on a nonconforming site on the following described property Legal Description: Being a tract of land containing 2.818 acres (122,750 square feet), situated in the R.B. Lyle Survey, Abstract 542, Brazoria County, Texas, being Lots 1 through 19 and Lots 30 through 48, in Block 11 and a portion of the 20 foot wide alley between Lots 1 through 8 and Lots 41 through 48, in Block 11, of Pearland Townsite, a subdivision in Brazoria County, Texas, according to the map or plat thereof recorded in Volume 2, Page 17 of the Map Records of Brazoria County, Texas, being all of a tract of land conveyed to Pearland Methodist Church by deed recorded under County Clerk's File No. 2008053045 of the Official Records of Brazoria County, Texas. Page 1 of 3 ZBA minutes 04-06-17 General Location: Between North Houston Avenue and 2314 North Grand Boulevard south of East Jasmine Street. Senior Planner presented the exhibits and staff report. Staff recommends approval of the special exception to allow construction of the proposed expansion to occur as per the attached plans on the same property containing non -conformities already in existence. The nonconformities are building setback, landscaping, and screening for the parking areas. Additional parking will not be required. Mr. Alan Balius, Applicant, 550 Westlake Dr., #300, Houston, TX 77079, spoke briefly of the intent to expand and presented a site plan of the church expansion. Mr. Balius informed that the rear setback requirement of 20ft. would be met and they would be retaining the existing landscaping. The church provides offsite parking, so additional parking would not be required. No persons wishing to speak for or against the proposed request were present. No comments from Staff/Board ADJOURNMENT OF PUBLIC HEARING ZBA Chairperson Dale Pillow adjourned the public hearing for ZBA Application No. VARZ 17-00001 at 6:12 p.m. ZBA Board Member Jerry Acosta made the motion to approve ZBA Application No. VARZ 17-00001 and ZBA Board Member Mark Lewis seconded the motion. The motion carries 5-0 ELECTION OF OFFICERS There were no nominations. ZBA Chairperson Dale Pillow and ZBA Vice -Chairperson Mark Lewis both expressed interest in maintaining respectfully as ZBA Chair and ZBA Vice -Chairperson. Motion to approve Dale Pillow as ZBA Chairperson and Mark Lewis as ZBA Vice -Chairperson was made by ZBA Board Member Don Glenn and ZBA Board Member Jerry Acosta seconded the motion. BYLAWS Deputy City Attorney Lawrence Provins informed Staff and Board that the Bylaws were outdated as they referred to the Old Land Use and Urban Development Plan and should be referred to the Unified Development Code. City Planner Jai McBride will send Bylaws by email for members to review and add comments. The revised Bylaws will be included in the next ZBA agenda for vote and approval. Staff provided the training.
