2002-05-20 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES Planning and Zoning Commission MINUTES OF A REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON MAY 20, 2002 IN THE SECOND FLOOR CONFERENCE ROOM, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER The meeting was called to order with the following present: P&Z Chairman H. Charles Viktorin P&Z Commissioner Kevin McDonald P&Z Commissioner Don Sederdahl P&Z Commissioner Russ Selemon Plat and Plans Administrator Richard Keller Secretary Jennifer Gonzales Vice-Chairman Donald Glenn, Commissioner's Iocco and Scherrer were absent. H. APPROVAL OF MINUTES: May 6, 2002 May 13, 2002 May 6, 2002 Commissioner Sederdahl made a motion to approve the May 6, 2002 minutes with a second made by Commissioner Selemon. Motion to approve passed 4 to 0. May 13, 2002 Commissioner Selemon made a motion to approve the May 13, 2002 minutes with a second made by Commissioner McDonald. Motion to approve passed 4 to 0. M. NEW BUSINESS A. CONSIDERATION & POSSIBLE ACTION — Preliminary Right-of-way Plat of Shadow Creek Ranch North Clear Lake Loop, Regents Bay Drive, and Kingsley Drive, being 13.377 acres out of the T.C.R.R Co. Survey, Section 3 Abstract 648, The S.G. Haynie Survey, Abstract 212 and the H.T&B. R.R. Co. Survey, Section 82, Abstract 565, City of Pearland, Brazoria County, Texas. Mission Statement: To make informed recommendations regarding zoning change requests,capital improvements,and other tasks as mandated by the City Charter. Page 1 of 6 Planning and Zoning Commission Plat and Plans Administrator Richard Keller made a motion to approve the plat with the following corrections: 1. Provide a scale on sheet 1. 2. "Regents Bay" needs to be"N. Clear Lake Loop" for continuation 3. Show the existing right-of-way on Kingsley Drive 4. Show the existing 5' electrical easement along Shadow Creek Parkway 5. Show recordation data for Reflection Bay Drive Mr. Keller explained that "Kingsley Drive"used to be"Almeda School"Road. Commissioner Sederdahl made a motion to approve the Preliminary Plat of Shadow Creek Ranch North Clear Lake Loop, Regents Bay, and Kinglsey Drive with staff's recommendations. Commissioner Selemon seconded the motion. Commissioner McDonald expressed concern regarding the gentleman (Mr. Weems) who stated he has property along Clear Lake Loop and he asked if the dispute has been worked out. James Ross of LJA Engineering replied that the title company is still working that out. Commissioner Selemon stated that he would like to see some open communication about this issue. Motion to approve passed 4 to 0. B. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Shadow Creek Ranch SF-21, 15.983 acres being out of the T.C.R.R. Co. Survey, Section 3 Abstract 678, City of Pearland, Brazoria County, Texas. Plat and Plans Administrator Richard Keller stated that staff recommends approval with the following comments: 1. They need to change "Rushing Spring Ct"to"Amber Creek Ct". 2. Plot a 10' sanitary sewer easement is reserve area along Clear Lake Loop. 3. Remove 2 '/2' electrical easement on platted lots that is not needed. Commissioner McDonald made a motion to approve the Preliminary Plat of Shadow Creek Ranch SF-21 with staff's comments. Commissioner Selemon seconded the motion. Motion to approve passed 4 to 0. C. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Shadow Creek Ranch SF-22, 16.253 acres being out of the H.T.&B. R.R Co. Survey, Section 82 Mission Statement: To make informed recommendations regarding zoning change requests,capital improvements,and other tasks as mandated by the City Charter. Page 2 of 6 Planning and Zoning Commission Abstract 565 and the T.C.R.R. Co. Survey, Section 3, Abstract 678, City of Pearland, Brazoria County, Texas. Plat and Plans Administrator Richard Keller made a motion to approve the plat with the following comments: 1. Label the water surface elevation on the lake. 2. Notes 10 & 14 need to add"W. Clear Lake Loop." Commissioner Sederdahl made a motion to approve the Preliminary Plat of Shadow Creek Ranch SF-22 with staff's recommendations. Commissioner Selemon seconded the motion. Motion to approve passed 4 to 0. D. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Shadow Creek Ranch SF-23, 29.779 acres being of the T.C.RR. Co. Survey, Section 3, Abstract 678 and the H.T.&B. RR. Co. Survey, Section 82, Abstract 565 and also being a replat of all the west 'h of lot 9, Section 82 of the Allison-Richey Gulf Coast Home Co's. Part of Suburban Gardens of Record in Volume 2, Page 99 of the Plat Records, Brazoria County, Texas. City of Pearland, Brazoria County, Texas. Plat and Plans Administrator Richard Keller stated that staff recommends approval as Ago- presented. Commissioner Selemon made a motion to approve the Preliminary Plat of Shadow Creek Ranch SF-23 with a second made by Commissioner McDonald. Motion to approve passed 4 to 0. E. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Shadow Creek Ranch SF-24A, 25.297 acres being out of the H.T.&B. R.R. Co. Survey, Section 82 Abstract 565 and the S.G. Haynie Survey, Abstract 212, City of Pearland, Brazoria County, Texas. Plat and Plans Administrator Richard Keller stated that staff recommends approval with four comments and listed them as: 1. They need to show the radii of the cul-de-sacs and eyebrows. 2. Sidewalk note 14 needs to include "W. Clear Lake Loop" and "Kingsley Drive". 3. "Regents Bay Drive" should be changed to "North Clear Lake Loop" for continuity. 4. Add label for 10' water and sewer easement along"Clear Lake Loop". Page 3 of 6 Planning and Zoning Commission Commissioner McDonald made a motion to approve the Preliminary Plat of Shadow Creek Ranch SF-24A with staff's comments. Commissioner Sederdahl seconded the motion. Motion to approve passed 4 to 0. F. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of The Estates of Dixie Farm, a tract or parcel of land containing 3.0245 acres out of lots 83 and 84 of George W. Jenkins Subdivision in the W.D.C. Hall League, Abstract 70 in the City of Pearland, Brazoria County, Texas. Plat and Plans Administrator Richard Keller stated that staff recommends approval with the following comments: 1. Need surveyors seal and signature on plat. 2. Provide a scale for the vicinity map. 3. Another driveway needs to be shown. 4. They need to provide only three benchmarks rather then four. Mr. Keller stated that this is four lots on the south side of Dixie Farm Road. Commissioner Sederdahl made a motion to approve the Preliminary Plat of The Estates of Dixie Farm with staff's recommendations. Commissioner Selemon seconded the motion. Commissioner McDonald stated he lives in Oakbrook and has concerns about this being a "Preliminary Plat". He stated that there is currently an existing house and other homes are being built. He asked why they are building when it hasn't been platted. Discussion ensued on the exact location of the property. Secretary Jennifer Gonzales pointed out that the final plat was previously approved over a year ago and this the second round of plat approval. She explained the surveyor did not get their final plat recorded within the one-year time frame that is allowed after final plat approval. Commissioner Sederdahl questioned whether or not it matters that a structure is on the property. Plat and Plans Administrator Richard Keller stated he wpuld get an inspector to check it out. Motion to approve passed 4 to 0. G. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Southgate Section One, A subdivision of 72.18 acres of land out of and a part of a 173.49 acre tract situated in the H.T.&B. R.R Company Survey, Section 81,Abstract 300 City of Pearland, Brazoria County, Texas. Mission Statement: To make informed recommendations regarding zoning change requests,capital improvements,and other tasks as mandated by the City Charter. Page 4 of 6 Planning and Zoning Commission Plat and Plans Administrator Richard Keller stated that he would like to recommend approval; however there are 31 items outstanding and at least 8 were listed on the staff review. He stated they still have not come to any agreement regarding the volume of detention required per acre. He believes this development does extend into Manvel City limits and has requested plans on this. Commissioner Selemon made a motion to deny the Preliminary Plat of SouthGate Section One with a second made by Commissioner McDonald. Commissioner Selemon stated that it sounds like it is more then just dotting the i's and crossing the t's. He stated that it sounds a little premature to approve. Dale Hardy of Hardy Surveying stated that he apologizes and this is the first plat he has done of this magnitude. He explained this is a complicated project. Commissioner Selemon stated that his concern is if the plat is tabled then in 30-days it could be automatically approved if no further action is taken. Commissioner Sederdahl suggested tabling the plat with a request that the plat be placed on the next agenda. The Commission requested that the items be read into the record. Plat and Plans /Mb' Administrator read into the record the following comments: 1. Correct spelling of"Viktorin". 2. Move Streetlights: Lot 2-3 to Lot 3-4 of Block 7 Lot 1-2 to Lot 2-3 of Block 3 Lot 15-16 to Lot 14-15 of Block 3 3. Add street name between blocks 2 and 7. 4. Add cul-de-sacs on Block 5 and Block 4. 5. Show driveways on other side of CR 59; also right-of-way line. 6. Need Surveyor's signature. 7. Show width and description of dashed line at the north edge of blocks 7 and 2. 8. Provide recordation data for offsite easements. 9. Is note number 6 correct? 10. Show proposed street lights along CR 59 11. Lot 17 of Block 1 and Lot 1 of Block 6 need a 15' building line 12. Pipeline statement?? 13. Traffic Impact Analysis is required 14. They need to show two sets of coordinates on plat boundary 15. Add the note"Water and Sewer Utilities are not available at the time of platting" 16. Provide a development plan for area south of CR 59 17. Has the general land plan for the entire subdivision been approved with the resolution of Kirby Drive issues? Provide alignment of Kirby Drive to FM 518. .m. Page 5 of 6 Planning and Zoning Commission 18. Change "Jefferson Ln" 19. Reverse numbering of sheets with vicinity map on sheet 1 20. Curve table and Line table be placed on same sheet as plat. 21. Unrestricted reserve not allowed in City. Must be consistent with zoning 22. Provide permission from the American Canal Company to use 60' wide easement for Kirby Road. 23. Show north arrow on Sheets 3 and 4 24. Utility service issues need resolution 25. City Council wishes that no building permits be issued until the SH 288 overpass is complete 26. Mr. Eisen wishes to see concurrence of offsite property owners with proposed Kirby Drive Alignment before any plats are approved. 27. the detention volume per acre is still not agreed upon with City Engineer. Commissioner Selemon withdrew his motion for denial. Commissioner McDonald withdrew his second. Commissioner Sederdahl made a motion to table the Preliminary Plat of SouthGate Subdivision Section One with the request to bring it back to the Commission on the June 31a agenda. Commissioner Selemon seconded the motion. Motion to table passed 4 to 0. IV. NEXT MEETING DATE: June 3, 2002 (Regular P&Z) June 10, 2002 (JPH & Regular P&Z) V.
