1999-09-20 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES MINUTES OF A REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON MONDAY, SEPTEMBER 20, 1999 @ 6:30 P.M., IN THE SECOND FLOOR CONFERENCE ROOM OF THE CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER The meeting was called to order at 6:34 p.m. with the following present: Chairperson Mary Starr Vice-Chairman Tommy Scott Commissioner Emil Beltz Commissioner Donald Glenn Commissioner Todd locco Chief Building Official Gene Tumlinson Planning & Zoning Secretary Jennifer Gonzales II. NEW BUSINESS A. CONSIDERATION & POSSIBLE ACTION —Zoning Application No. 782 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Light Industrial District (M-1) on the following described property, to wit: 1. Zoning Application No. 782 Legal Description: Lot 9, Block 3, Hickory Creek Place subdivision, as recorded in Vol. 11, pgs 1-2 of the map records of Brazoria Co., TX (14004 O'Day Road) Owner: Don and Margarette Chasteen 3202 Ivy Bend Drive Pearland, TX 77584 Chief Building Official Tumlinson stated that these were the zone change requests from the Joint Public Hearing held on September 13, 1999. Commissioner locco questioned what company is next to the property, and Mr. Tumlinson replied that it was Hawks Roofing Company. Commissioner Beltz made a motion to forward Zoning Application No. 782 to City Council for approval, and Vice-Chairman Scott seconded the motion. Motion passed 5 to 0. 1 B. CONSIDERATION & POSSIBLE ACTION — Zoning Application No. 747 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to General Business District (GB) on the following described property, to wit: 1. Zoning Application No. 747 Legal Description: Lot 8A (adjacent to West Lea subdivision), H. T. & B. R.R. Co. survey, according to the plat records of Brazoria Co., TX (FM 1128 @ West Lea) Owner: Lisa M. Massey 3511 Freshmeadows Dr. Houston, TX 77063-6205 Agent: Charlie Eason Chief Building Official Tumlinson stated that this property is not part of West Lea Subdivision. Vice-Chairman Scott made a motion to forward Zoning Application No. 747 to City Council for approval, and Commissioner Beltz seconded the motion. Motion passed 5 to 0. C. CONSIDERATION & POSSIBLE ACTION — Zoning Application No. 756 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Commercial District (C) on the following described property, to wit: 1. Zoning Application No. 756 Legal Description: Being Lot 5, Block 6, Hickory Creek Place subdivision, part of Section 7, H. T. & B. R.R. Co. survey, according to the map recorded in Vol. 11, pgs 1 & 2, plat records of Brazoria Co., TX (14001 Garden Road) Owner: Armando & Emilia C. Jimenez 5902 Marsha Lane Pearland, TX 77581 Chief Building Official Tumlinson stated that this is an existing rooming and boarding business. 2 Commissioner locco stated that there is a resale shop in back of the property. He then reminded the Commissioners that not even the Church spoke against the request. Commissioner locco made a motion to forward Zoning Application No. 756 to City Council for approval, and Commissioner Glenn seconded the motion. Motion passed 5 to 0. D. CONSIDERATION & POSSIBLE ACTION —Zoning Application No. 790 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Single Family Dwelling District (R-1) and Neighborhood Services District (NS) to Neighborhood Services District (NS) on the following described property, to wit: 1. Zoning Application No. 790 Legal Description: Being 1.9 acres, more or less, out of the W.D.C. Hall League, A-70, as recorded in Vol. 6, pg 142, plat records of Brazoria Co., TX (2015 E. Broadway) Owner: Randy K. Ellis, D.D.S., M.S. and Selena Ellis 2501 S. Galveston Pearland, TX 77581 Agent: James L. McGregor Browne Penland McGregor Architects, Inc. Chairperson Mary Starr stated that the front of the property is currently zoned Neighborhood Services and the back part is zoned R-1. Chief Building Official Tumlinson reminded the Commissioners that one lady spoke against the request and her main concern was the drainage. He then assured the Commissioners that there would be no drainage problems once the property goes through the Engineering department. Discussion ensued among the Commissioners about the property and how the previous owner tried to zone the property Commercial, and the request was denied. Vice-Chairman Scott stated that the property owner could get creative like the medical center did by putting a nice ditch that surrounds the property. Vice-Chairman Scott then made a motion to forward Zoning Application No. 790 to City Council for approval, and Commissioner Glenn seconded the motion. 3 Motion passed 5 to 0. E. CONSIDERATION & POSSIBLE ACTION — Zoning Application No. 793 Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Single Family Dwelling District (R-3) on the following described property, to wit: 1. Zoning Application No. 793 Legal Description: Being 40 acres of unimproved land, specifically described as Lots 41, 42, 51 and 52, Allison Richey Gulf Coast Home Co. subdivision, Section 85, recorded in Vol. 2, pgs 107- 108, plat records of Brazoria Co., TX (C.R. 403 & C.R. 93) Owners: Thomas A. Mallynn, Charles Mallynn III, Linda M. Tisdale Agent: S. Kevin Price 143 Port San Leon, TX 77539 Chief Building Official Tumlinson stated that there were no oppositions at the Joint Public Hearing. Vice-Chairman Scott questioned what the subdivision across the street is zoned. Mr. Tumlinson stated that there is R-3, and there is also some Patio Homes which are zoned R-4. Chairperson Mary Starr reminded the Commissioners that the majority of Southdown is zoned R-3. Commissioner Glenn made a motion to forward Zoning Application No. 793 to City Council for approval, and Commissioner Beltz seconded the motion. Motion passed 5 to 0. F. CONSIDERATION & POSSIBLE ACTION — Zoning Application No. 743, 755, 762, 763, 771, and 815. Request of owners for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Single Family Dwelling District (R-1) on the following described property, to wit: 1.
