1998-12-07 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES MINUTES OF A REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON DECEMBER 7, 1998 AT 6:00 P.M. IN THE SECOND FLOOR CONFERENCE ROOM OF THE CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER The meeting was called to order at 6:07 p.m. with the following present: Chairperson Mary Starr Vice-Chairperson Tommy L. Scott Commissioner Emil A. Beltz Commissioner Pat Lopez Commissioner Jack D. Mathis City Engineer John Hargrove Planning and Zoning Secretary Jennifer Mattingly II. APPROVAL OF MINUTES Commissioner Mathis made a motion to approve the November 16, 1998 minutes and Commissioner Beltz seconded the motion. Motion passed 5 to 0. II. NEW BUSINESS A. CONSIDERATION AND POSSIBLE ACTION — Final Plat of Rehoboth Acres, 36.676 acres. City Engineer Hargrove recommended staff approval with the comment that the submitter needs to turn reserves C, D, and A from Commercial zoning to General Business. Commisioner Lopez made a motion to approve the final plat of Rehoboth Acres with the comment made by the City Engineer to change the zoning of Reserves C, D, and A from Commercial to General Business, and Commissioner Mathis seconded the motion. Motion passed 5 to 0. • B. CONSIDERATION AND POSSIBLE ACTION — Final Plat of Scofield Section 1 at Silverlake, a subdivision of 33.8662 acres of land out of R.B. Lyle Survey, Abstract No. 539, Brazoria County, Texas. 1 Variance Request: 1. Use of 20-foot building line setbacks on lots fronting the bulb portion of cul-de-sacs. 2. Use of 5-foot side lot building line setbacks. City Engineer Hargrove recommended approval with two comments: 1. On page 1 the back lines fronting on Netherwood Court need to have the recording information on the 8' Utility Easement. 2. Commissioner Emil A. Beltz needs to be added to the plat. Commissioner Mathis made a motion to approve the final plat of Scofield Section 1 at Silverlake with the comments made by the City Engineer to add Emil Beltz's name to the plat and to add the recording information on the backline of the lots fronting Netherwood Court, and Commissioner Beltz seconded the motion. Motion passed 5 to 0. C. CONSIDERATION AND POSSIBLE ACTION — Final Plat of Woodbend Section 2 at Silverlake, a subdivision of 27.8842 acres of land out of R.B. Lyle Survey, Abstract No. 539, Brazoria County, Texas. Variance Request: 1. Use of 20-foot building line setbacks on lots fronting the bulb portion of cul-de-sacs. 2. Use of 5-foot side lot building line setbacks. 3. Use of cul-de-sacs greater than 600 feet in length. City Engineer Hargrove stated that he recommended approval as presented. Commissioner Lopez made a motion to approve the final plat of Woodbend Section 2 at Silverlake, and Commissioner Mathis seconded the motion. Motion passed 5 to 0. C. CONSIDERATION AND POSSIBLE ACTION — Final Plat of Villages of Edgewater Estates Section 3, 12.242 acres out of the H.T. & B. R.R. Co. Survey, A-309. Variance Request: 1. Use of a 20-foot building line on cul-de-sac lots. City Engineer Hargrove stated that on the lots north and adjacent to Lakecrest Lane the reserve lines are closer than the 10 foot building lines to the future houses. He then stated that the building lines should be the reserve lines. Mr. Hargrove then 2 ,�. pointed out that if you look to the extreme left side of the plat you will see where the reserve line is showing to be 16.98 feet and the building line is 10 feet. What they are showing the building line to be is unclear. Mr. Hargrove then requested permission to require the submitter to make the lines more clear. Vice-Chairperson Scott made a motion to approve the final plat of Villages of Edgewater Estates Section Three with the allowance of the City Engineer to require the submitter to eliminate the confusion of lot lines, and Commissioner Mathis seconded the motion. Motion passed 5 to 0. E. CONSIDERATION AND POSSIBLE ACTION — Final plat of Westlake Residential, a subdivision of 34.6800 acres out of section 15, H.T.& B. R.R. Company Survey, Abstract No. 241. City Engineer Hargrove recommended approval with the comment that on page 2 there needs be a title block. Mr. Hargrove then apologized and stated that this comment was missed on the staff review. Vice-Chairperson Scott pointed out that note 12 "PVM" should read "PBM". Al Lentz from Lentz Engineering made a request to change one phone number, and City Engineer Hargrove responded that this would not be a problem. Commissioner Mathis made a motion to approve the final plat of Westlake Residential with the correction requested from the City Engineer that a title block needs to be added to page 2 and on note 12 "PVM" should read "PBM", and Commissioner Lopez seconded the motion. Motion passed 5 to 0. V. NEXT MEETING DATE: January 11. 1999 (JPH meeting) January 18, 1999 (Reg. meeting) IV. Vice-Chairman Scott made a motion to approve the final plat of Southdown Commercial Reserve B with the signature of the City Engineer be withheld until he receives the year of adjustment for the benchmark, and Commissioner Mathis seconded the motion. Motion passed 4 to 0. F. CONSIDERATION AND POSSIBLE ACTION — Final Plat of Southdown Commercial Reserve, Tract C, 11.91 acres of land out of the J. Crawley Survey, Abstract— 174, Brazoria County, Texas. City Engineer Hargrove recommended approval with the same comment that the year of adjustment needs to be added to the benchmark and his signature would be withheld until this is added to the plat. Commissioner Mathis made a motion to approve the final plat of Southdown Commercial Reserve with the signature of the City Engineer be withheld until the year of adjustment is added, and Commissioner Beltz seconded the motion. Motion passed 4 to 0. G. CONSIDERATION AND POSSIBLE ACTION — Final Plat of Ashton Park Section Two, being a 7.7178 acres of land situated in the southeast one- quarter (SE VI) of section 13, H.T.&B. R.R. Co., Survey, Abstract 240, Brazoria County, Texas. City Engineer Hargrove recommended approval as presented. Commissioner Beltz made a motion to approve the final plat of Ashton Park Section Two as presented, and Commissioner Mathis seconded the motion. Motion passed 4 to 0. IV.
