2016-07-18 JPH PLANNING AND ZONING COMMISSION MEETING MINUTES MINUTES OF THE JOINT PUBLIC HEARING FOR THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION, CITY OF PEARLAND, TEXAS, HELD ON JULY 18, 2016 AT 6:30 P.M., IN THE COUNCIL CHAMBERS - CITY HALL - 3519 LIBERTY DRIVE CALL TO ORDER Mayor Tom Reid opened a series of public hearings at 6:30 p.m. The following were present: Mayor Tom Reid P&Z Chairperson Daniel Tunstall Mayor Pro Tem Tony Carbone P&Z Vice-Chairperson Thomas Duncan Council Member Keith Ordeneaux P&Z Commissioner Mary Starr Council Member Derrick Reed P&Z Commissioner Derrell Isenberg Council Member Gary Moore P&Z Commissioner Ginger McFadden Council Member Greg Hill P&Z Commissioner David Selsky Council Member Trent Perez Also present were City Attorney Darrin Coker, Director of Community Development Lata Krishnarao, City Planner Frankie Legaux, Senior Planner Martin Griggs, Director of Engineering Susan Polka, Assistant Director of Engineering Richard Mancilla, Associate Engineer Matt Brown and Office Assistant Alma Gonzales. PURPOSE OF HEARING Mayor Tom Reid opened the public hearing for Zone Change Application No. Zone 16-00003 @ 6:30 p.m. P&Z Chairperson Daniel Tunstall read the purpose of the hearing into the record. Zone Change Application No. Zone 16-00003 A request of Beverly Childs, owner/applicant; for approval of a change in zoning from the Suburban Development (SD) zoning district to the Office & Professional zoning district; on approximately 4.1919 acres of land. Legal Description: Being a tract of land containing 4.1919 acres of land out of Lot Forty-One (41), Section 25, H.T. & B. R.R .Company Survey, Abstract 245, Brazoria County, Texas, and being designated on the Block Books of Brazoria County, Texas of Section 25 and being a part of the same land described in Deed from C. W. Boots, et. ux. to Joe H. Reeder, by Deed dated June 22, 1959, recorded in Volume 744, Page 457, Deed Records, Brazoria County, Texas, Less, Save and Except a 20.00 foot strip along the North side reserved in Deed recorded in Volume 116, Page 581, Deed Records, Brazoria County, Texas, and lying in the road. General Location: 5134 Bailey Road. APPLICATION INFORMATION AND CASE SUMMARY The Applicant withdrew application by email on July 18, 2016 There was no staff wrap up. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST There was no present to speak. COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION No discussion PURPOSE OF HEARING Mayor Tom Reid opened the public hearing for Conditional Use Application no. CUP 16-00009 @ 6:35p.m. P&Z Chairperson Daniel Tunstall read the purpose of the hearing into the record. Zone Change Application No. CUP 16-00009 A request of Kris Szecsy applicant, on behalf of George Gartner, owner; for approval of a an amendment to the Baks Brewery PD to change the name to Bakfish Brewing Co. PD and to allow a maximum of three food trucks and/or on site food sales from outside vendors during operating hours of the brewery; on approximately 2.939 acres of land. Legal Description: Being a tract of land containing 2.939 acres out of Lots 20, 21 and 22 of the George W. Jenkins Subdivision, in Brazoria County, Texas, according to the map or plat thereof recorded in Volume 2, Page 20, of the Brazoria County, Texas Plat Records. General Location: Northeast corner of Broadway and Shauntel Streets, Pearland, TX. APPLICATION INFORMATION AND CASE SUMMARY Senior Planner Martin Griggs read the staff report and presented aerials, exhibits, zoning maps. Staff recommended approval with conditions along with the conditions that were proposed. The applicant, Kris Szecsy, gave a verbal presentation and was available to any comments or questions. There were no staff wrap up. PERSONS WISHING TO SPEAK FOR OR AGAINST THE PROPOSED REQUEST The following speakers were opposed to Zone Change Application No.16-00009 due to concerns with traffic and parking issues, increase of noise to surrounding subdivision, property values decreasing, location where the food trucks would be placed on the property, and concerns that the property would be an eyesore for the beautification of a major highway : Jennifer Bean, 2722 Hazel Street, 77581 – Opposed Julie H. Bennett, 1410 Pineland Drive, 77581 – Opposed Lance Botkin, 3701 Pine Forest Place, 77581 – Opposed Christopher Chomenko, 3021 Green Tee Drive, 77581 - Opposed COUNCIL/PLANNING COMMISSION/STAFF DISCUSSION Mayor Pro Tem Tony Carbone questioned if notifications were mailed out and if signs had been posted, inquired if the PD review had been City initiated and asked about parking requirements. Senior Planner Martin Griggs answered yes to the postings and PD reviews and explained the parking requirements from a portion of the UDC and Land Use Matrix. Councilmember Derrick Reed asked if the food trucks would move each night and if so what time would they have to move. The applicant, Mr. Szecsy, answered yes the food trucks would be require to move each night before closing time of the Brewery. Councilmember Gary Moore had concerns with the food trucks in front of establishment, preferred the food trucks to be behind the screening and Mr. Moore commented on the traffic impact the Brewery would bring and was not in favor of the food trucks coming in from other cities to make profit. Councilmember Keith Ordeneaux made comments regarding the size of tents that would be placed in the parking lot.
