2010-02-15 JPH PLANNING AND ZONING COMMISSION MEETING MINUTES MINUTES OF THE JOINT PUBLIC HEARING OF THE CITY COUNCIL AND PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON FEBRUARY 15, 2010 AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS CALL TO ORDER Mayor Tom Reid and P&Z Chairperson Jerry Koza, Jr. called the public hearing to order at 6:34 p.m. with the following present: Mayor Tom Reid P&Z Chairperson Jerry Koza, Jr. Mayor Pro Tern Felicia Kyle P&Z Commissioner Ron Capehart Council Member Steve Saboe P&Z Commissioner Susan Sherrouse Council Member Scott Sherman P&Z Commissioner Darrell Diggs Council Member Woody Owens P&Z Commissioner Neil West Council Member Kevin Cole P&Z Commissioner Henry Fuertes Also in attendance: Deputy City Attorney Nghiem Doan, Assistant City Manager Mike Hodge, Assistant City Manager Jon Branson, Planning Director Lata Krishnarao, Senior Planner Angela Gantuah, and Planning Office Coordinator Judy Krajca Senior Planner Angela Gantuah explained the Joint Public Hearing process for the attending public, and explained that the Planning & Zoning Commission meeting will immediately follow the Joint Public Hearing. Mayor Tom Reid called to order the Public Hearing for Conditional Use Permit No. 2009-19 at 6:36 p.m. CONDITIONAL USE PERMIT NO. 2009-19 A request of Clear Wireless, LLC, applicant for PMSV Broadway West Storage, owner, for a conditional use permit to allow the addition of and antenna or co-location of a cellular antenna in the General Commercial (GC) Zoning District, on the following described property, to wit: Legal Description: Approximately 8.870 acres (386,368 square feet) more or less being that same certain tract conveyed from Eastgroup-LNH Corporation to Palms Properties. L.L.C. as recorded in file No. 96-021151, Official Records of Brazoria County, Texas, same being out of Lot 20, Allison Richey Gulf Coast Home Company's Suburban Section 85, Abstract No. 304, in Brazoria County. Texas. General Location: 2850 Wooten Rd., Pearland TX P&Z Chairperson Jerry Koza, Jr. read the purpose into the record. Senior Planner Angela Gantuah presented the staff report and stated staff recommends approval of the Conditional Use Permit. JPH Minutes 2/15/10 Page 1 of 3 Mr. Blake Griggs with Clear Wireless, LLC of 3300 Carillion Point, Kirkland, WA gave a brief presentation. There was no one present to speak for or against the Zone Change. Council Member Kevin Cole commented that Council encourages co-location. P&Z Commissioner Henry Fuertes inquired if the tower could be "dressed up", as it is a self support tower, instead of a model pole. Mr. Griggs replied that they are not the owner of the tower. Mayor Tom Reid inquired about the elevated platform verses a slab. Mayor Reid's concern had to do with varmints gathering underneath. Mr. Griggs replied that it is a metal grate. P&Z Vice-Chairperson Ron Capehart questioned the height of the tower; and, asked if a CUP was issued at the time the tower went in. Vice-Chairperson Capehart also asked why landscaping was not being required. Senior Planner Angela Gantuah stated that a CUP was not required at the time the tower was put in place. Staff was not requiring landscaping due to the fact that it is hidden behind the strip center, and sit off from the road, closest to Wooten Road. Council Member Scott Sherman inquired what year the tower went up. Senior Planner Angela Gantuah stated she was unsure of the date, but did know it was permitted by the county. P&Z Commissioner Darrell Diggs inquired who the owner was. Mr. Griggs replied that the owner was GTP — Global Towers.
