ON NOVEMBER 17, 2008, AT 6:30 P.M., IN THE COMMUNITY CENTER, TEMPORARY
CITY HALL, 3523 LIBERTY DRIVE, PEARLAND, TEXAS
CALL TO ORDER
The public hearing was called to order at 6:45 p.m. Mayor Tom Reid opened the hearing
for the City Council, and P&Z Chairperson Henry Fuertes opened the hearing for the
Planning and Zoning Commission, with the following present:

Also in attendance: City Manager Bill Eisen; City Attorney Darrin Coker; Assistant City
Manager Mike Hodge; Planning Director Lata Krishnarao; and Planning Administrative
Secretary Judy Krajca.
Planning Director Lata Krishnarao explained the Joint Public Hearing process for the
attending public, and explained that the Planning & Zoning Commission Meeting would
follow the Joint Public Hearing.
Mayor Tom Reid opened the public hearing for Zone Change No. 2008-16Z at 6:48 p.m.

P&Z Chairperson Henry Fuertes read the purpose of the hearing.
Request of Mike Pollack, applicant for Signature Eubanks, owner, for approval of a change
in zoning district from classification Townhouse Residential District (TH) to General
Business Retail District (GB) and Office Professional (OP) with a Conditional Use Permit
(CUP) to permit a hospital facility.
LEGAL DESCRIPTION: Tract 1 with 15.0373 acres and Tract 3 with 13.0933
acres out of Kanawha-Texas Company Subdivision of
Sections 18 & 22 (Vol. 2, pg 51 B.C.P.R) and Section
18 H.T. & B. R.R. Co. Survey, A-547, Houston, Harris
County, Texas
GENERAL LOCATION: Located on the North side of proposed Magnolia Road
and East side of FM 1128 (Manvel Road).

Planning Director Lata Krishnarao read the staff report stating the applicant is
request a change in zoning for GB (General Business), and (OP) Office
Professional with a Conditional Use Permit(CUP)to permit a hospital. Specifically,
the applicant is seeking to change 15.0373 acres, north of proposed Magnolia Road
to OP zone with a CUP to permit a hospital use; and, 13.0933 acres south of
proposed Magnolia Road to GB. The applicant has indicated that the purpose of
the zone change is to develop a physician owned community hospital with medical
office buildings. Ms. Krishnarao stated that staff received 3 public comment forms
in opposition, with two of those being from the same address.
Mr. Mike Pollack, applicant and owner, 9525 Katy Freeway, Suite 130, Houston,
Texas spoke of the need for hospital/medical facilities, and displayed two pictures.
One picture was of the proposed site and a potential look, while the other was an
example of another location with a similar medical business.
Dr. Monica J.R. Graham, 3303 Charles Ave., Pearland, Texas spoke with regards to
the 10 acres referred to as low-density. Dr. Graham commented that she hopes to
build and live on the 10 acres someday, building her dream home and owning
horses. She expressed concerns with traffic and noise. Dr. Graham also stated
that a hospital would be busy, and stated she was concerned because of her
children and the horses.
Dr. Akili Graham, 3303 Charles Ave., Pearland, Texas inquired about the proximity
of this medical center and what exactly was going to be placed on what parcel of
land.
Council Member Steve Saboe asked the Planning Director to address Dr. Graham's
question of layout. Planning Director used the drawing Mr. Pollack had shown
earlier, next to the layout of the land, outlining roads, creek, and detention area.
Council Mr. Kevin Cole inquired about the road known as CR 107F and how traffic
would flow in the area described as low density. There was also discussion with
regards to drainage, the proposed 80-feet wide hike and bike trail, and the width of
the creek.
P&Z Chairperson Henry Fuertes expressed concern to the secondary thoroughfare
plan, and the potential of having ambulances driving on Southfork Drive, during the
early morning hours, coming off of Hwy. 288, and residences lying on both sides of
the road.
Council Member Steve Sabao asked the Planning Director for clarification of the
zone change being both GB and OP. Planning Director Lata Krishnarao went back
to the power point slide demonstrating staff's recommendation for the GB zone, and
the OP zone with a CUP.
