2006-11-27 JPH PLANNING AND ZONING COMMISSION MEETING MINUTES MINUTES OF THE JOINT PUBLIC HEARING OF THE CITY COUNCIL AND THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON NOVEMBER 27, 2006, AT 6:30 P.M., IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS CALL TO ORDER The public hearing was called to order at 6:31 p.m. Mayor Tom Reid opened the hearing for the City Council and Ruby Sandars opened the hearing for the Planning and Zoning Commission, with the following present: Mayor Tom Reid P & Z Chairperson Ruby Sandars Mayor Pro-Tern Richard Tetens P & Z Vice Chairperson Sheryl Greiner Councilmember Kevin Cole P & Z Commissioner Neil West Councilmember Felicia Kyle P & Z Commissioner Henry Fuertes Councilmember Steve Saboe P & Z Commissioner Jerry Koza, Jr. Also in attendance: City Attorney Darrin Coker; City Manager Bill Eisen; Assistant City Manager Nicholas Finan; Assistant City Manager Mike Hodge; Deputy City Attorney Nghiem Doan; Planning Director Lata Krishnarao; Senior Planner Theresa Grahmann; Plan and Plat Administrator Richard Keller; and Planning Administrative Secretary Judy Krajca 411111. Mayor Reid opened the hearing for the Proposed Amendment to Lifestyle Center Planned Unit Development District (PUD) at 6:32 p.m. PURPOSE OF HEARING A. PROPOSED AMENDMENT TO LIFESTYLE CENTER PLANNED UNIT DEVELOPMENT DISTRICT A request by Kerry R. Gilbert & Associates, Inc., Land Planner for Poag and McEwen, for an amendment to the proposed amendment to the Lifestyle Center Planned Unit Development District (PUD), on the property generally located at the Southwest corner of Beltway 8 and State Highway 288. P&Z Chairperson Sandars read the purpose into the record. Planning Director Lata Krishnarao read the Staff report. Staff has worked with the applicant on all the items that were outstanding. All the items have been completed. Parking was an issue at the workshop and has been addressed in the PUD Amendment, on page 7. Kerry Gilbert of Kerry Gilbert & Associates, made a presentation of the Planned Unit Development for the Promenade Shops at the Spectrum. Mr. Harry Reid was also in attendance, but did not speak. Page 1 of 3 JPH Minutes, 11/27/06 No one was present to speak for or against the proposed amendments to the PUD. Councilmember Cole inquired about whether this should be a replat or amending plat. City Attorney Darrin Coker explained that this needed to be done as a replat. Councilmember Cole asked about the 7.23 acres required for open space, and does staff normally count esplanades. Planning Director Krishnarao stated if the amenities were considered then yes this would be counted as open space. Councilmember Cole stated he wants to make sure we are consistent. Councilmember Cole asked if a detailed landscape plan existed, and Mr. Gilbert replied it does not exist at this time. He stated that Pad sites will have their own set of guidelines and will have to comply with this PUD and the UDC. Councilmember Cole asked how we would know if they will comply with the UDC, and Planning Director Krishanaro stated the residential will fall under the UDC and non residential will fall under the Land Use & Urban Development Ordinance. Ms. Krishnarao added that architectural guidelines fall under the PUD. Councilmember Saboe inquired about pages 1, 4, and 9, specifically residential, retail, and entertainment. Councilmember Saboe asked Mr. Gilbert to meet the requirements of open space and to look at the wording in the PUD, and the use of the word "Open space", so that his meaning of the word means the same as ours in the UDC. Mr. Gilbert stated that he might have to find a new word to use. Much discussion ensued regarding open spaces, amenities, and park space. Mr. Gilbert stated that the 5.9 acres could be platted and maintained by them, but the City would have to relinquish them from the contract. Councilmember Kyle inquired about the phasing issue, as referenced on page 11 of the proposed amendment. Councilmember Sabao asked about signage. Commissioner asked about open space, detention and calculations, and the town homes (TH) and multi-family (MF) residences over the retail shop. He asked if these will be constructed and leased in phases. Mr. Gilbert explained that the construction will be done at one time, and then they will lease at one time. Commissioner Koza, Jr. inquired about the private parking for residents. He also inquired if the 75 ft. height requirements included rooftop Page 2 of 3 JPH Minutes, 11/27/06 screening (such as A/C's). Planning Director Krishnarao stated Staff would need to get clarification on this. Discussion continued among the Councilmember's, Commission, and Staff. Commissioner Fuertes commented on the trail system and water features. He asked about the number of bedrooms to parking ratio. He noted that it is short of what the UDC requires, and was Staff comfortable with this. Planning Director Krishnarao replied that staff was comfortable with this because of the Mixed Use District (MU). Planning Director Krishnarao ask the Council and Commission when the site plans come in, what phase do they want to see the park at. The response was that no Certificate of Occupancy be issued until all of Phase 1B is completed and park built.
