THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND,
TEXAS, HELD ON APRIL 17, 2006, AT 6:30 P.M., IN THE COUNCIL
CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS
CALL TO ORDER
The public hearing was called to order at 6:34 p.m. Mayor Torn Reid opened the
hearing for both the City Council and the Planning and Zoning Commission, with
the following present:

Mayor Pro-Tem Kevin Cole P & Z Chairperson Jerry Koza, Jr.
Councilmember Steve Saboe P & Z Commissioner Neil West
Councilmember Woody Owens P & Z Commissioner Henry Fuertes
Councilmember Larry Marcott P & Z Commissioner Susan Sherrouse
Councilmember Richard Tetens P & Z Commissioner Darrell Diggs
Also in attendance: City Attorney Darrin Coker; City Manager Bill Eisen; Assistant
City Manager Nicholas Finan; Deputy City Attorney Nghiem Doan, Planning
Director Lata Krishnarao; Senior Planner Theresa Grahmann, and Planning
Administrative Secretary Judy Krajca.
Senior Planner Theresa Grahmann explained the Joint Public Hearing process
for the attending public, and explained that the Planning & Zoning Commission
Meeting will immediately follow the Joint Public Hearing.
Mayor Reid opened the hearing for CUP 2006-1 at 6:36 p.m.
PURPOSE OF HEARING
A. Conditional Use Permit No. CUP 2006-1
A request by FFC, applicant for Franklin Fidelity
Management/Riverway Commercial Development, owner, for approval
of a Conditional Use Permit for a "Telephone Exchange Switching
Relay and Transmitting Equipment" facility in the General Business
Retail District (GB), on the following described property as 5.284 acres
of land, generally located on the North Side of FM 518 (Broadway
Street), and on the East Side of Sunrise Boulevard.
P&Z Vice-Chairperson Sheryl Greiner read the purpose into the record.
Senior Planner Theresa Grahmann presented the Staff Report. Staff
recommends approval of this Conditional Use Permit. Staff received
one Public Comment Form against the application.
The applicant was not present to speak. No one in the audience was
present to speak for or against the Conditional Use Permit.
There was minimal discussion from the Council in regards to
clarification of the location, setback, and if it met the requirements in
the Unified Development Code. Councilmember Owens also asked if
the facility would serve only this property. Senior Planner Grahmann
stated that it could serve surrounding properties, as well. Assistant
City Manager Nicholas Finan stated that he spoke with the applicant.
This facility is already in place in a resident's backyard in Sunrise
Lakes and the applicant needs to move to a GB site to be conforming
and legal.
Councilmembers Marcott and Saboe questioned if antennae's would
be placed on the roof, and Mr. Saboe expressed concern over health
issues. Assistant City Manager Finan stated this was governed by the
FCC.
Discussion ensued regarding the lines and cables being placed
underground, and ensuring that it follow the Unified Development
Code.
There were no further questions from the Council/Commission/Staff.
The Public Hearing for Conditional Use Permit No. CUP 2006-1 was
adjourned at 6:52 p.m.
The Public Hearing for Zone Change No. 2006-14Z opened at 6:52
p.m.
B. Zone Change No. 2006-14Z
A request by Mike Pollak, owner, for an amendment to Ordinance No.
2000M, the Zoning Map of the City of Pearland, for approval of a
change in zoning district from classification Single Family Residential —
1 District (R-1) to General Business Retail District (GB) and
Townhouse Residential District (TH), on the following described
property as 46.01 acres, generally located on the West Side of FM
1128 (Manvel Road), and Approximately 3,000 Feet South of Fite
Road.
P&Z Vice-Chairperson Sheryl Greiner read the purpose into the record.
Senior Planner Theresa Grahmann presented the Staff Report. She
stated that Town Homes is a new district recently added. Staff
recommended approval of this Zone Change. Staff received one
Public Comment Form in favor of this request.
The applicant, Mike Pollak was present but stated he felt Staff covered
everything and would reserve his time for questions.
There was no one present to speak for or against this Zone Change.
Mayor Reid commented that this was good to have a quality project
developed off of 518.
Councilmember Marcott stated that future road plans needed to be
looked into, and Councilmember Saboe asked about the naming of the
road and would it be called Magnolia or Southfork. City Manager Bill
Eisen stated that nothing had been decided, but it would be looked into
soon as addressing would be a concern.
Discussion ensued between Council and Staff on the retail node,
location and site, and GB zoning.
Mr. Pollak spoke of the Hike and Bike trail, and stated that he had met
with the Parks Department. Councilmember Saboe stated this was a
chance to connect the East and West sides of Pearland.
The Public Hearing for Zone Change No. 2006-14Z was adjourned at
7:22 p.m.
The Public Hearing for Zone Change No. 2006-15Z was opened at
7:23 p.m.
C. Zone Change No. 2006-15Z
A request by Jerry McGinty, applicant for Star Two Twin Lakes, L.P.,
owner, for an amendment to Ordinance No. 2000M, the Zoning Map of
the City of Pearland, for approval of a change in zoning district from
classification Planned Development District (PD) to Planned
Development District (PD), an amendment to the existing Planned
Development District (PD) for Twin Lakes, on the following described
property as 64.8110 acres of land, generally located on the East Side
of Veterans Drive, and Approximately 1,000 Feet South of Walnut
Street.
P&Z Vice-Chairperson Sheryl Greiner read the purpose into the record.
Assistant City Manager Nicholas Finan presented the Staff Report.
Staff feels the applicant has met all requirements and recommended
approval of this PD Amendment.
The applicant, Mr. McGinty was present but did not feel a need to
speak.
There was no one present to speak for or against this zone change.
Councilmember Marcott asked about the four constructed home with
conditional Occupancy Permits. Mr. McGinty stated that Lennar
Homes had notified the homeowners of the fence change. Assistant
City Manager Finan stated he had received a call from one of the
homeowners and they were okay with this change.
City Attorney stated that final Occupancy Permits would not be issued
until the fence was completed. The length of time to complete the
fence is approximately 60-90 days.
Councilmember Marcott asked for an emergency approval of the
ordinance on April 24, 2006. Assistant City Manager Finan stated that
the paperwork would be completed and given to the City Secretary.
The Public Hearing for Zone Change No. 2006-15Z was adjourned at
7:38 p.m.
ADJOURNMENT
