COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON
SEPTEMBER 20, 2004, IMMEDIATELY FOLLOWING THE JOINT PUBLIC
HEARING, IN THE SECOND FLOOR CONFERENCE ROOM OF CITY HALL,

The meeting was called to order at 8:13 p.m. with the following present:

Commissioner Todd locco stated that modular homes are allowed in residential
areas by Federal law. Mobile homes are different than modular, the difference is
that modular homes are brought in on a truck and offloaded. If a piece of
property is zone R1, R2, or R3, that owner could put a modular home on the
property.
Rachel Enriquez explained that the home meets HUD standards and meets Wind
Zone 2 standards, and will be placed on a concrete slab.

Discussion ensued between the Commissioners and Staff regarding this zone
change and the replat of the property.
Planning & Zoning Chairperson Ruby Sandars asked should the property be
replatted first then come back to for a zone change. A discussion ensued
between the Staff and the Commissioners. After the discussion and upon advise
of the Deputy City Attorney, the original motion is invalid.
Commissioner Sheryl Greiner made a motion to approve, Commissioner Neil
West seconded.
Commissioner Peter Dumont asked for clarification regarding the detention
ponds and zoning. There still was a question regarding the primary use of the
property. Executive Director of Community Services Nick Finan explained what
the possible scenarios regarding this property being platted or possibly if the
owner wanted to get a building permit.

Deputy City Attorney Nghiem Doan stated that there was interest from Council to
table this zone change application so the developer could combine this property
with another and bring both for rezoning at the same time.
Commissioner Todd locco stated for a Point of Information that a motion to table
means that all questions and discussion ends.
There was discussion among the Commissioners, the developer and Staff
regarding several issues and questions that the Commissioners had. Some of
the concerns raised by the Commissioners are that this property does not
conform to the updated Comprehensive Plan, and a concern with the detention
pond encroaching into the residential zone. Commissioner Todd locco asked
what the property behind the Home Depot was zoned. It was clarified that the
property in question is zoned Suburban Development.
Commissioner Sheryl Greiner made a motion to table, Commissioner Todd locco
seconded.

Commissioner Sheryl Greiner stated that this does not conform to the newly
adopted Comprehensive Plan.
Commissioner Peter Dumont asked when this General Business zoning was
originally approved. Commissioner Todd locco, stated he thought about 2 years
ago.
Commissioner Peter Dumont asked if there were any other event centers in
Pearland. Planning & Zoning Chairperson Ruby Sandars stated that there was
one in Manvel.
Planning & Zoning Chairperson Ruby Sandars stated that she had several
concerns, one there was no guarantee that this would be an event center,
second, is there any guarantee that this event center would have enough parking
on this piece of property.
Executive Director of Community Services Nick Finan stated that the event
center would have to conform to the parking requirements as stated in the
ordinance.

Commissioner Peter Dumont asked if a parking garage would be an option.
Commissioner Todd locco stated that the Commissioners needed to focus on the
dirt and what is the best use of the dirt. Commissioner David Ransom stated that
he agreed with Commissioner locco, and maybe an alternative would utilize a
Planned Unit Development (PUD).
The developer stated that they had attended a pre-development meeting, and
they also have a second set of plans showing a parking garage. Planning
Manager Lata Krishnarao stated that yes they had a pre-development meeting,
and a Planned Unit Development was discussed.
There were questions from the audience regarding the drainage and the traffic
issues. Planning Manager Lata Krishnarao stated that during the platting
process, the Engineering department would require a Traffic Impact Analysis and
look at the drainage issues.

General Business or an Office Professional zoning would be a better use of the
land for this property.
The Commissioners asked if the developer if he would be willing to change from
a General Business zoning to an Office Professional zoning. The developer
stated that he would not.

G. CONSIDERATION & POSSIBLE ACTION — A variance request on behalf of
Ken Caffey, agent for AMVEST Corporation, to issue building permits for
construction of single family homes in the areas completed in Pearland Park
Estates.
Plans & Plats Administrator Richard Keller stated the developer would like to
begin construction while a temporary lift station is being constructed.
City Engineer Doug Kneupper explained due to delays in the sewer work at John
Lizer the developer would have to construct a temporary lift station. Due to the
delays, this is creating a delay in getting the subdivision accepted with City
Council, so a variance is required so that the developer can get building permits.

H. CONSIDERATION & POSSIBLE ACTION — A second Amending Plat of Lot

Plans & Plat Administrator Richard Keller gave a brief history of this property.
There were a few minor outstanding items. The items were showing new
commissioners, showing a streetlight, and a title report. Mr. Keller stated that the
signatures were corrected. Planning & Zoning Chairperson Ruby Sandars asked
if the remaining items were major. Mr. Keller stated the remaining items were
Arab not.

Survey, Section 11 , A-239, Pearland, Brazoria County, Texas.
Plans & Plat Administrator Richard Keller explained that due to state law, when a
replat is being done, a public hearing needs to be held.
Jesus Vitela, Lentz Engineering, the owner is platting for selling purposes.
There were no public comments either for or against the replat.

Plans & Plat Administrator Richard Keller stated that this was a Planned Unit
Development (PUD), which was approved a while back, has a couple of
outstanding items; a 25 ft Water and Sewer easement behind the right-of-way
line, and 2 streetlights.
Commissioner Neil West made a motion to approve wth Staff's comments
excluding the water and sewer easement. Commissioner Sheryl Greiner
seconded.
A discussion ensued regarding the required easements in the ordinance about
the required water and sewer easements.
Planning & Zoning Chairperson Ruby Sandars made a motion to amend the
motion to only require a 10 ft Water and Sewer easement as such stated in the
Planned Unit Development (PUD) documents. Commissioner Todd locco
seconded.

Planning & Zoning Chairperson Ruby Sandars asked of Staff if it would be
possible to make sure that the Commissioners were aware of times of any joint
workshops that the Commissioners would also be required to attend.
Commissioner Todd locco and Staff discussed the pump detention issue, and
whether this was an item for Planning & Zoning to discuss or City Council.
Commissioner Sheryl Greiner asked if it would be possible to state a more
accurate time on the agenda when there is a Joint Public Hearing also being
conducted. Staff did explain that the meeting times were set by the City
Secretary's office, and it would be difficult to project a time when the Planning &
Zoning Commission meeting would be held.
Planning Manager Lata Krishnarao stated that there would be a Joint Workshop
between City Council and the Planning & Zoning Commission regarding
discussion of the Unified Development Code. At this time, the agenda time has
not been determined; as soon as the information was available it would be
forwarded.
