Vice Chairperson Sheryl Greiner stated that this was tough, focusing on the comprehensive plan and the vision or forming of Pearland where the traffic and business growth opportunities are coming from. The concern is that we are doing a longer-term injustice or unjustice to the people were we are to approve this; they could end up being surrounded by businesses. P&Z Chairman Todd locco stated the commission has to look at the overall picture. Voting "Aye" Commissioners locco, Greiner, Sandars, Ransom, West, and Cowles. Chairman Todd locco stated that the point was a good one, but the 2004 Comprehensive Plan shows that area as General Business. A discussion among the Commissioners and staff followed clarifying the uses according to the 2004 Comprehensive Plan. Mr. E.R. Milstead stated that the individual purchasing the property knows what Pearland wants to see built as General Business. Commissioner Ruby Sandars is concerned about the traffic going through the Sunrise Lakes Subdivision. She stated the builder needed to make another access from FM 518 to the site. Chairman Todd locco stated that they could build a construction access to allow the construction traffic. Planning Manager Lata Krishnarao stated that if the commissioners agreed to the changes, those changes would be incorporated into the final PUD document submitted to Council. Jay Carr, Hamilton Homes also reiterated that those changes would be incorporated into the final PUD document. Chairman Todd locco stated that another concern would be the fire gate access being built first. He had not seen anything on the drawings to indicate this. Vice Chairperson Cheryl Greiner stated that she would go on record stating that she feels that this was not a good use of the property, should not be residential. Commissioner Ruby Sandars asked to amend the motion that no infrastructure, site prep or any type of construction begin until a construction access is constructed, and a fire gate goes up first. Chairman Todd locco asked staff if it would be possible to not allow any permits until these points were met. Planning Manager Lata Krishnarao stated that was possible. Voting "No" Commissioner Greiner Motion to approve amendment passed 5-1 Voting to accept the PUD with the amended motion "Aye" Commissioners locco, Cowles, Sandars, Ransom, and West. Voting "No" Commissioner Greiner Motion to approve the PUD with amendment passed 5-1 Planner I Theresa Grahmann stated that staff had not finished mapping the 20% of property owners around the area, and as soon as that was completed the information would be forwarded. Chairman Todd locco asked for a motion to combine agenda items S-Y as a consent agenda due to Shadow Creek Ranch has handled all platting accordingly. Commissioner Neil West made a motion to move S-Y to a consent agenda, Commissioner Ruby Sandars seconded. Voting "Aye" Commissioners locco, Sandars, Greiner, Cowles, Ransom, and West. Motion to approved passed 6-0 Commissioner Linda Cowles asked if it would be possible to get a copy of the lot sizes from the Shadow Creek PUD, since some members were not on the Commission at the beginning. Plats and Plans Administrator Richard Keller stated that would not be a problem. I. CONSIDERATION & POSSIBLE ACTION — CONDUCT A PUBLIC HEARING Replat of a Portion Commercial Reserve Block 12, West Lea, Section 3, Section 16 H.T. & B.R.R. Survey Abstract 546, City of Pearland, Texas, Volume 12, Page 23 & 24, Plat Records of Brazoria County. The public hearing for the Replat of West Lea, Section 3 was called to order at 10:25 p.m. Martha Maxwell, 3649 Wingtail Lane asked why replatting this property. It was changed from commercial reserve in 1979 by the developers and has had deed restrictions on as individual lots since this property has been residential for a long time. Plats and Plans Administrator Richard Keller stated that the area was rezoned but the property was not replatted according to State Law. The original plat showed Commercial Reserve. Visseta Brown, 10615 Hockley Drive, owner of the property, stated that the replat was being done because of the ROW dedication and she and her husband wanted to build a home on the lot. Plats and Plans Administrator Richard Keller stated that this plat needed to be replatted due to the records showing the property was in the Commercial Reserve and this would take it out. There were no further staff or Commissioner comments. The public hearing for Replat of West Lea, Section 3 was adjourned at 10:27 p.m. I-1. Hunter t Survey, Abstract 76, City of Pearland, Brazoria Count, Texas The public hearing for the partial replat of Creekside Section One was called to order at 10:30 p.m. Plats and Plans Administrator Richard Keller stated that this was a replat to remove a drainage easement off the back of the lots. Commissioner Ruby Sandars asked why were we giving drainage easement away. Plats and Plan Administrator Richard Keller asked that the developer of Creekside and adjoining property drain away. City Engineer Doug Kneupper explained that this was not a drainage easement as a drainage easement but for standing water nuisance. The developer of the adjacent property has agreed to allow Creekside to slope and drain onto the adjacent property, and when the adjacent property starts to develop the lots will have to be graded to the same height. There were no citizens speaking for or against the replat. There were no other staff or Commissioners comments or questions. CONSIDERATION & POSSIBLE ACTION — Variance Request for CVS/Pharmacy Construction, Sherwood Subdivision FM 518 and Pearland Parkway to begin construction. Plats and Plans Administrator Richard Keller stated that this was a proposed CVS Drugstore and there is a proposed street Cruz Lane and the developer wants to begin construction before Cruz Lane is complete, and staff feels that both the drugstore and construction on Cruz Lane can occur concurrently. Chairman Todd locco asked that if the CO would not be issued until Cruz Lane is complete. Joe Mahar, who is with the contractor, stated that there would be a two construction entrances. Commissioner Ruby Sandars made a motion to approve with the specifications of Cruz Lane being completed before a Certificate of Occupancy is issued, Commissioner Neil West seconded. Mr. Keller explained that this was in the ETJ and there were no zoning requirements. There were no citizen comments for or against the request. City Engineer Doug Kneupper stated that the ordinance states that there has to be a driveway or a garage area large enough to turn around before entering the street. A. ELECTION OF CHAIRMAN AND VICE CHAIRMAN Chairman Todd locco made a motion to nominate Ruby Sandars as Chairman of the Planning & Zoning Commission, Commissioner David Ransom seconded.
