2004-01 05 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES PLANNING AND ZONING COMMISSION r MINUTES OF A REGULAR MEETING FOR THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD AT 6:30 P.M. ON JANUARY 5, 2004, IN THE SECOND FLOOR CONFERENCE ROOM OF CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS I. CALL TO ORDER The meeting was called to order at 6:31 p.m. with the following present: Chairman Todd Iocco Commissioner Linda Cowles Commissioner Neil West Commissioner David Ransom Commissioner Ruby Sandars Commissioner Don Sederdahl Secretary Trish Broussard Also in attendance: Planning Manager Lata Krishnarao, Planner I Theresa Grahmann, Deputy City Attorney Nghiem Doan, City Engineer Doug Kneupper, and Plats and Plans Administrator Richard Keller. Vice Chairman Sheryl Greiner was absent. r II. NEW BUSINESS A. DISCUSSION ITEM—Proposed Planned Unit Development (PUD) for Twin Lakes, approximately 65 acres, located on the East side of Veterans Drive, on the West side of the railroad, and South of Walnut Street. Planning Manager Lata Krishnarao stated the proposed Planned Unit Development (PUD) is located south of Walnut Street, south of the City of Pearland's Police Department, and west of the railroad tracks. The property is currently zoned "M- 1" Light Industrial, the southern 22 acres of the property is located in the floodway. Mrs. Krishnarao indicated the net density of the proposed subdivision is not higher than 3.5 and the developer indicated they plan to dedicate 3.4 acres at the northwest corner for parkland. Mrs. Krishnarao stated staff has discussed with the developer some design elements and staff proposes that they add landscaping with a masonry wall. She added that staff would like to see more meaningful open spaces, with walking trails, and a ten- foot wide landscape buffer in the northern parcel of the property. Kevin Price, developer, stated they are using less than 50% of this tract, and the rneighbors across the street are in support of this development. Mr. Price indicated Page 1 of 6—P&Z Minutes PLANNING AND ZONING COMMISSION they would build as far away from the railroad tract for safety, and also, Fred Welch with Pearland Economic Development has given them a letter in support. Mr. Price indicated the R-2 zoning is the highest and best use for this development. Commissioner Neil West asked who would maintain the detention area. Chairman Todd Iocco replied the maintenance would fall under the Municipal Utility District. Chairman Todd Iocco stated he would like to see at least 300 feet separation from the Railroad tracts. Commissioner David Ransom stated this development is not appropriate for residential use. Commissioner Ruby Sandars stated the M-1 zoning will bring money from Pearland Economic Development, and she disagreed with giving up the light industrial zoning. Mrs. Sandars commented that the light industrial zoning should be replaced somewhere else in the city. Commissioner Don Sederdahl stated he was in favor of the re-zoning. B. CONSIDERATION & POSSIBLE ACTION — Final Plat of Savannah Meadows Section Four, a subdivision of 45.84 acres of land out of the J.S. Talmage Survey, A-562 Brazoria County, Texas also being a partial replat of Emigration Land Company subdivision, being all of Lot 31 and a portion of Lots 34, 39, and 40, Block 76, as recorded in Vol. 2, Pg. 81, B.C.P.R. Plats and Plans Administrator Richard Keller stated we are down to three comments, remove "Construction By Others" from the 30' Right of Way dedication, five foot electrical easement should be centered on Right of Way line at Reserve"D", and add recordation data for off-site easements. Commissioner Ruby Sandars made a motion to approve with staffs comments, Commissioner David Ransom seconded the motion. Motion to approve passed 6-0. C. CONSIDERATION AND POSSIBLE ACTION— Preliminary Plat of Shadow Creek Ranch SF-26, 34.069 acres being out of the H.T.& B.R.R. Co. Survey Section 82 Abstract 565, City of Pearland, Brazoria County, Texas Plats and Plans Administrator Richard Keller stated staff recommends approval as presented. Co.Survey, Section 82 Abstract 565, City of Pearland, Brazoria County, Texas Plats and Plans Administrator Richard Keller stated there are no comments. Commissioner Ruby Sandars made a motion to approve with a second made by Commissioner David Ransom. Motion to approve passed 6-0. E. Survey, Section 82 Abstract 565, City of Pearland, Brazoria County, Texas Plats and Plans Administrator Richard Keller stated there are no comments. Commissioner David Ransom made a motion to approve with a second made by Commissioner Don Sederdahl. Motion to approve passed 6-0. G. CONSIDERATION & POSSIBLE ACTION —Preliminary Plat of Shadow Creek Ranch SF-30, 33.100 acres, being out of the H.T. & B.R.R. Co. Survey, Section 82, Abstract 565, City of Pearland, Brazoria County, Texas r Page 3 of 6—P&Z Minutes PLANNING AND ZONING COMMISSION Plat and Plans Administrator Richard Keller stated that Brazoria County Drainage District#4 wants a 150 foot wide right of way ditch for Reserve "H", add streetlights along Broadway at 250 feet plus or minus intervals, reserve acreage in title block does not match table on sheet 2. Commissioner Don Sederdahl made a motion to approve with comments and Commissioner Ruby Sandars seconded the motion. Motion to approve passed 6-0. H. CONSIDERATION & POSSIBLE ACTION—Preliminary Plat of Shadow Creek Ranch SF-37, 21.887 acres being out of the H.T. &B.R.R. Co, Section 83, Abstract 305, the H.T. &B.R.R. Co. Survey. Section 82, Abstract 565, and the S.G. Haynie Survey, Abstract 212, City of Pearland, Brazoria County, Texas Plat and Plans Administrator Richard Keller stated staff has no comments. Commissioner Ruby Sandars made the motion to approve with a second made by Commissioner David Ransom. Motion to approve passed 6-0. I. CONSIDERATION & POSSIBLE ACTION—First Amending Plat of Southgate Section One, a subdivision of 72.65 acres of land out of and part of a 173.49 acre tract situated in the H.T. &B.R.R. Company Survey, Section 81, Abstract 300, City of Pearland, Brazoria County, Texas Plat and Plans Administrator Richard Keller stated there is one comment to change note no. 7 on sheet 2 to read that the zoning is R-2, not R-3. Commissioner David Ransom made a motion to approve with staff comments with a second made by Commissioner Linda Cowles. Motion to approve passed 6-0. J. CONSIDERATION & POSSIBLE ACTION—A variance request on behalf of Laney Surveyors, agent for Dynamic Lighting to not place street lights along Woody Road. Plat and Plans Administrator Richard Keller stated staff recommends that a single streetlight be placed at Shank Road and Woody Road. City Engineer, Doug Kneupper, stated there will be a street light at Woody Road that goes North and South, they have frontage on Woody Road, but at this time Page 4 of 6—P&Z Minutes PLANNING AND ZONING COMMISSION there are no streets. Mr. Kneupper stated if you grant the variance we recommend only one streetlight. Commissioner Ruby Sandars made a motion to approve with staff comments with a second made by Commissioner David Ransom. Motion to approve failed 0-6. K. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Dynamic Lighting, a 16.537 acre tract out of lots 6 and 15 of the H. Masterson Subdivision of Section 5, of the H. T. & B.R.R. Co. Survey, Abstract 237, City of Pearland, Brazoria County Plat and Plans Administrator Richard Keller sated staff recommends approval. Commissioner Ruby Sandars made a motion to approve with a second made by Commissioner David Ransom. Motion to approve passed 6-0. L. CONSIDERATION & POSSIBLE ACTION —Preliminary Plat of Kandiland Pearland being a subdivision of 1.137 acres of land out of the T.C.R.R. Co. Survey, Section 3, Abstract No. 678, City of Pearland, Brazoria County, Texas Plat and Plans Administrator Richard Keller stated there are no comments. Commissioner Linda Cowles made a motion to approve with a second made by Commissioner David Ransom. Motion to approve passed 6-0. M. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of JIB No. 3974 Subdivision, being 1.2857 acres (56,007 s.f.) of land located in the A.C.H. & B. Survey, Abstract No. 147 Brazoria County, Texas and also being a partial replat of Magnolia Business Park, a subdivision per map or plat thereof recorded in Volume 18, Page 39 plat records Brazoria County, Texas City of Pearland Plat and Plans Administrator Richard Keller stated staff has two comments. Water and Sewer Easement to be concentric with proposed Right of Way line, and provide 25 foot Water and Sewer Easement behind Main Street Right of Way.
