2003-11-17 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES PLANNING AND ZONING COMMISSION MINUTES OF A REGULAR MEETING FOR THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON NOVEMBER 17, 2003, IN THE FIRST FLOOR COUNCIL CHAMBERS OF CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS I. CALL TO ORDER The Meeting was called to order at 7:29 p.m. with the following present: Chairman Todd Iocco Vice Chairman Sheryl Greiner Commissioner Ruby Sandars Commissioner Don Sederdahl Commissioner David Ransom Commissioner Linda Cowles Secretary Trish Broussard Also in attendance: Deputy City Attorney Nghiem Doan, Executive Director of Community Services Tobin Maples, Planning Manager Lata Krishnarao, Planner I Theresa Grahmann, Plats and Plans Administrator Richard Keller. Commissioner's + Don Sederdahl and Ray Bacon were absent. H. NEW BUSINESS A. CONSIDERATION & POSSIBLE ACTION — ZONING APPLICATION NO. 1135 Request for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to Neighborhood Service District (NS), on the following described property, to wit: Legal Description: Lot 23 and Lot 24, Block 3, Wagon Wheel Subdivision, Abstract 509, H.T. & B.R.R. Company Survey, Brazoria County, Texas (6017 Larrycrest Drive) Owner: Billy K. Davis 3318CR89 # 5 Pearland, Texas 77584 Applicant: Same as Owner O - Page 1 of 6—P&Z Minutes PLANNING AND ZONING COMMISSION t, Commissioner David Ransom made a motion to approve with a second made by Chairman Todd Iocco. Commissioner David Ransom stated Neighborhood Service is not good for the dirt, but who are we hurting or helping. Commissioner Ransom asked when the adjacent M-1 property was zoned. Executive Director of Community Services Tobin Maples replied in May of 1999. Commissioner Linda Cowles stated she did not know what anyone would want to do with this property if it were not zoned Neighborhood Services. Executive Director of Community Services Tobin Maples replied the property could be leveled, and new single family homes could be built. Mr. Maples added the structure was a non conforming use, and the adjacent M-1 land was a open and running business at the time of zoning. Deputy City Attorney Nghiem Doan stated if the balance is between precedence and zoning the dirt, we need to look at what is the highest and best use for the land. Chairman Todd Iocco stated if we do anything else, then all the other surrounding businesses will try to get zoned. Motion to approve failed 0-5 B. CONSIDERATION & POSSIBLE ACTION — ZONING APPLICATION NO. 1133 Request for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to General Business District (GB), on the following described property, to wit: Legal Description: Being the west 5.00 acres of Lot 45 of the H.T. & B.R.R. Company Survey, Section 20,Abstract 506, Brazoria County, Texas (Northeast corner of FM 518 and Hillhouse Road) Owner: Laurence D. Vincent Gary Blalock 508 N. Texas Avenue 8701 W. Commissioner David Ransom asked who decides when a Traffic Impact Analysis is required. Executive Director of Community Services Tobin Maples stated in the back of the Land Use and Urban Development book there is a criteria manual with three separate items, one if there are 1,000 or more trips, 50 or more trips during the peak hour of the business, or the City Engineer determines a need for one. Motion to approve passed 5-0 C. CONSIDERATION & POSSIBLE ACTION —ZONING APPLICATION NO. 1134 Request for an amendment to the Land Use and Urban Development Ordinance of said City from classification Suburban Development District (SD) to General Business District (GB), on the following described property, to wit: Legal Description: Lot 2 and Lot 3, Detenbeck and Barnhart Subdivision, Brazoria County, Texas (5905 Bardet Street) Owner: Berta Hales 5909 Bardet Street Pearland, Texas 77581 Applicant: Darla Lynn Hoggard 3007 E. Broadway Street Pearland, Texas 77581 Commissioner David Ransom made a motion to approve with a second made by Commissioner Linda Cowles. Chairman Todd Iocco stated recently we approved a specific use permit to move a manufactured home onto this property. Executive Director of Community Services Tobin Maples stated the applicant indicated they were going to move the mobile home. ow- Commissioner Sheryl Greiner asked if we could set a time and schedule to Page 3 of 6—P&Z Minutes PLANNING AND ZONING COMMISSION move the mobile home off the property. Executive Director of Community Services Tobin Maples replied the City Council would have to approve it. Motion to approve passed 5-0 D. CONSIDERATION & POSSIBLE ACTION— SPECIFIC USE PERMIT APPLICATION NO. 129 Request for an amendment to the Land Use and Urban Development Ordinance of said City for a Specific Use Permit for Storage and Mini- Warehouse in a Commercial District (C(S)), on the following described property, to wit: Legal Description: Lots 20 and 21 of the George W. Jenkins Subdivision in the W.D.C. Hall League, Abstract 70, Brazoria County, Texas (1729 E. Broadway Street) Owner: Four Seasons Self Storage at Broadway Dixie, L.P. 1729 E. Broadway Street Pearland, Texas 77581 Applicant: Robert Burnham 12810 Chriswood Drive Cypress, Texas 77429 Commissioner David Ransom made a motion to approve with a second made by Commissioner Linda Cowles. Commissioner David Ransom asked are specific use applications similar to Planned Unit Developments, were you can place stipulations to them. Executive Director of Community Development Tobin Maples replied yes. Chairman Todd Iocco stated his concern was with the detention on the property. Executive Director of Community Services Tobin Maples stated if the application is approved the next step after zoning would be to engineer the property to our standards and demonstrate compliance during the building permit process. Motion to approve passed 5-0 E. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Shadow Creek Ranch SF-24B, 26.411 acres being out of the H.T. & B.R.R. Page 4 of 6—P&Z Minutes PLANNING AND ZONING COMMISSION Co. Survey, Section 82, Abstract 565, City of Pearland, Brazoria County, Texas Plats and Plans Administrator Richard Keller stated staff recommends approval as presented. Commissioner Ruby Sandars made a motion to approve with a second made by Commissioner David Ransom. Motion to approve passed 5-0 F. CONSIDERATION & POSSIBLE ACTION—Preliminary Plat of Shadow Creek Ranch SF-25, 55.241 acres being out of the H.T. & B.R.R. Co. Survey, Section 82, Abstract 565 and the T.C.R.R. Co.Survey, Section 3, Abstract 678, City of Pearland, Brazoria County, Texas Plats and Plans Administrator Richard Keller stated the access street has not been constructed so we will need to approve the West Clear Lake Loop plat before finaling this plat. Commissioner Ruby Sandars made a motion to approve with a second made by Commissioner David Ransom. Motion to approve passed 5-0 G. CONSIDERATION & POSSIBLE ACTION—Preliminary Plat of Brazoria County Municipal Utility District No. 35, a subdivision of 110.410 acres located within TCCR Co Survey, Section 4, Abstract Number 675 Brazoria County, Texas Plat and Plans Administrator Richard Keller stated this plat is located at Broadway and State Highway 288. Mr. Keller stated the applicant has resolved issues to staff s satisfaction, therefore we recommend approval. Commissioner Ruby Sandars made a motion to approve with a second made by Commissioner David Ransom. Motion to approve passed 5-0 H. CONSIDERATION & POSSIBLE ACTION— Second Amending Plat of Towne Lake Estates Section Two, being 30.3614 acres of land composed of two tracts in the L.W. Murdock Subdivision recorded in Volume 29, Page 174 of the Brazoria County Deed Records, and out of the A.C.H. & B. Page 5 of 6—P&Z Minutes PLANNING AND ZONING COMMISSION All". Survey, A-507 and the H. Stevens Survey, A-594, Brazoria County, Texas Brazoria County M.U.D. No. 18 Plats and Plans Administrator Richard Keller stated this is the second amending plat of Towne Lake Estates Section Two. Mr. Keller stated the developer has changed the building line on the cul-de-sac lots from 25 ft to 20 ft. Mr. Keller stated staff recommends approval as presented. Commissioner Sheryl Greiner made a motion to approve with a second made by Commissioner Linda Cowles. Motion to approve passed 5-0 I.
