MINUTES OF A REGULAR MEETING FOR THE PLANNING AND ZONING
COMMISSION OF THE CITY OF PEARLAND, TEXAS, HELD ON JULY 7, 2003 IN
THE SECOND FLOOR CONFERENCE ROOM OF CITY HALL, 3519 LIBERTY
DRIVE, PEARLAND, TEXAS.
I. CALL TO ORDER
The meeting was called to order at 6:34 p.m. with the following present:

II. NEW BUSINESS
A. CONSIDERATION AND POSSIBLE ACTION — Preliminary Plat of The Lakes
at Highland Glen Section Eight, 31.725 acres out of Lots 96 & 97, Zychlinski
Subdivision (Vol. 29 Pg, 43 B.C.P.R.) and being out of the H.T.&B. R.R. Co.
Survey, Abstract-233 and the D.H.M. Hunter Survey Abstract-76 (Brazoria
County), City of Pearland, Brazoria County, Texas.
Plat and Plans Administrator Richard Keller stated staff recommends approval with the
comment that the developer may have to eliminate Lot 9 of Block I due to bridge
improvements on Old Alvin Road.
Commissioner Sederdahl made a motion to approve the Preliminary Plat of The Lakes at
Highland Glen Section Eight with staff's comment. Commissioner Bacon seconded the
motion.
Commissioner Sandars asked if the developer is aware of Mr. Keller's comment. Mr.
Keller replied the developer is aware and he reminded the Commission that this is only
the preliminary plat.
Motion to approve passed 6 to 0.
B. CONSIDERATION AND POSSIBLE ACTION — Final Plat of Lawrence Place,
being 33.623 acres out of the F.B. Drake Survey, Abstract 509, City of Pearland,
Brazoria County, Texas.

Plat and Plans Administrator Richard Keller stated staff recommends approval contingent
upon receiving construction plan approval and complete the recording data for the
adjacent easements.
Commissioner Bacon made a motion to approve the Final Plat of Lawrence Place with
staff's comments. Commissioner Sandars seconded the motion.
Commissioner Sandars stated that the comments listed seem like pretty major comments.
Chuck Davis of C.L. Davis and Company replied the easements were recorded as of
today and the information is on the mylars he has brought with him.
Chairman Iocco asked about the zoning. Planner Theresa Grahmann replied the zoning
is anR-2PUD.
Motion to approve passed 6 to 0.
C. CONSIDERATION AND POSSIBLE ACTION — Final Plat of Bellavita at
Green Tee Section Four, being a subdivision of 32.6281 acres of land out of the
W.D.C. Hall Survey, A-23, City of Pearland, Harris County, Texas.
Variance Request: Request by Eddie A. Taher of Century Engineering, Inc. for
a variance from the Subdivision Ordinance to allow for the construction of the
proposed underground utilities in Bellavita at Green Tee Section 4 to commence
and proceed simultaneously with the construction of the 15-acre detention pond
that will serve Bellavita at Green Tee 4.
This item was removed at the request of the developer. The Commission took no action.
D. CONSIDERATION AND POSSIBLE ACTION—Final Plat of Elim Subdivision,
a subdivision of 8.11 acres of land, out of Lot 46 of the Allison-Richey Gulf Coast
Home Company's Subdivision of Section 8-, H.T.&B. R.R Co. Survey, Abstract
564, Brazoria County, Texas, according to the plat as recorded in Volume 2,
Page 98, Plat Records, Brazoria County, Texas, Part in the City of Pearland,
Brazoria County, Texas.
Plat and Plans Administrator Richard Keller stated that staff recommends approval with
the comment that a revised drainage report needs to be presented.
Commissioner Bacon made a motion to approve the Final Plat of Elim Subdivision with
a second by Commissioner Scherrer.
Motion to approve passed 6 to 0.

E. CONSIDERATION AND POSSIBLE ACTION — Final Plat of Sunrise Lake
Village, a 8.42 acre tract, situated in the John W. Maxey Survey, Abstract 721,
and being part of and out of a 208.10 acre tract described by deed recorded in
Volume 1107, Page 859 of the Deed Records of Brazoria County, City of
Pearland, Texas.
Plat and Plans Administrator Richard Keller stated that staff recommends approval of the
plat as presented.
Commissioner Scherrer made a motion to approve the Final Plat of Sunrise Lake Village
Subdivision with a second by Commissioner Sandars.
Motion to approve passed 6 to 0.
F. CONSIDERATION AND POSSIBLE ACTION—Amending Plat of Twin Wood
Section 2, a tract or parcel of land containing 14.5455 acres being a combination
of a so called 9.8145 acre tract and a so called 4.731 acre tract conveyed by the
City of Pearland in instrument dated June 28, 1995 and recorded in File no.
95020332 of the Real Property Records of Brazoria County, Texas out of Lots 22
& 23 of Walcott's Subdivision Subdivision and out of Lot 91 of the Zychinski's
Subdivision in the H.T.& B. R.R Co. Survey, Abstract 233 in the City of
Pearland, Brazoria County, Texas.
Plat and Plans Administrator Richard Keller stated that staff recommends approval of the
plat as presented.
Commissioner Bacon made a motion to approve the plat with a second by Commissioner
Sandars.
Mr. Keller explained the amending plat is to take small lots and make them into bigger
lots (making 5 lots out of 7 lots).
Motion to approve passed 6 to 0.
G. CONSIDERATION AND POSSIBLE ACTION—Request by Michael D. Kempf,
General Manager of Dynamics Lighting, Inc., for a variance from the
Subdivision Ordinance that requires a property to be platted before a building
permit may be issued. The request is to obtain a building permit for a new office
project at 5220 Shank Road.
Planner Theresa Grahmann explained they are requesting this variance because the
developer was told late in the permitting process that they needed to plat their
property. She stated staff is recommending approval.

Commissioner Bacon made a motion to approve the variance request with a second
by Commissioner Scherrer.
Commissioner Scherrer asked what happened.
Commissioner Sandars stated that these people have been working with the city for
months, and she asked why it wasn't discovered earlier on that the developer needed
to plat their property. She added that should be one of the first things discovered.
Planner Theresa Grahmann stated that staff always recommends for these developers
to attend Pre-Development Meetings before they begin their permitting. She briefly
explained that at these meetings the developers meet with several staff members and
this sort of issue would have been discovered at this time.
Commissioner Greiner asked what size of property is required to be platted. Mr.
Michael Kempf, general manager of Dynamics Lighting, Inc., replied 16 acres.
Paul Horn, General Contractor, stated they have done other building on the property
within the last few years and this wasn't an issue at that time so they did not think it
would be an issue now.
_4... Emil Zapalac, owner, stated that this is just simply an addition to the existing
business.
Planner Theresa Grahmann pointed out that the City's staff does overlook things
from time to time. She also stated that she is not saying this mistake is the
developer's fault by any means.
Motion to approve passed 6 to 0.
