MINUTES OF A REGULAR MEETING FOR THE PLANNING AND ZONING
COMMISSION OF THE CITY OF PEARLAND, TEXAS, TO BE HELD FEBRUARY 3,
2003, IN THE SECOND FLOOR CONFERENCE ROOM, CITY HALL, 3519 LIBERTY
DRIVE, PEARLAND, TEXAS
I. CALL TO ORDER
The meeting was called to order at 6:34 p.m. with the following present:

H. APPROVAL OF MINUTES: December 16, 2002

Commissioner Sheryl Greiner made a motion to approve with a second by Ruby Sandars.
Motion to approve passed 7-0
HI. NEW BUSINESS
A. CONSIDERATION & POSSIBLE ACTION — Preliminary Plat of Pearland
Central Wal-Mart, a subdivision of 27.02 acres of land being a partial replat of
the Ferri Subdivision, Vol. 19, pg. 75-76, B.C.P.R., Zychlinski Subdivision, Lots
82-85, Vol. 29, Pg. 43, B.C.P.R., Located in the H.T. & B. R.R. Co. Survey,
Section 2, A-542 City of Pearland, Brazoria County, Texas.
Plats and Plans Administrator Richard Keller stated the Engineer has addressed
staffs' comments and we are recommending approval.
Commissioner Ruby Sandars°made a motion to approve with a second by Ray Bacon.

Commissioner Russ Selemon stated he has no problem with large box retail except
when they are abandoned. Chairman Todd Iocco stated he thought maybe we needed
to have a workshop about big boxes and leaving them empty.
Commissioner Sheryl Greiner asked if there would be drainage. Hugh Blanchard,
agent for Brown & Gay Engineering, replied there would be a detention pond between
the store and Glenda Street.
Motion to approve passed 7-0
B. CONSIDERATION & POSSIBLE ACTION-Guidelines for Towne home
development in the ETJ.
Planner I Theresa Grahmann stated based on last weeks discussion, if we can vote on
this for Silverlake.
Commissioner Ray Bacon made a motion to approve with a second by Don Sederdahl.
Commissioner Russ Selemon stated they might want stricter rules. Ruby Sandars replied
townehomes don't normally have open space.
400.• Chairman Todd Iocco asked if this was just for the two projects. Miss Grahmann replied
yes.
Motion to approve passed 7-0
C. DISCUSSION ITEM- Discussion of storm water detention
Russ Selemon stated he wanted to see responsible development.
Sheryl Greiner stated she agreed it would be a good idea to fund the study. Plats and
Plans Administrator stated the design would be for all frequency of flows.
Todd Iocco asked if this would be individual or regional. Richard Keller replied all.
Russ Selemon stated that pump drainage helps mitigate but it is not a long-term solution.
City Engineer John Hargrove stated the best out fall is natural.
Sheryl Greiner stated the most affected area is on Hatfield and west to the ETJ.
Ruby Sandars stated that at Cherry Street and Mykawa subdivision she personally looked
AD- at ditches and there was trash and debris filling culverts.

Russ Selemon stated he felt the city was doing a good job but the county is not.
Don Sederdahl stated he worked personally for the Drainage District in Alvin. He stated
a place that is low is low; we have low property in Pearland. Todd Iocco replied not low
but flat. Don Sederdahl also stated he has walked Mary's Creek and there are some areas
that are impossible to clean.
Ray Bacon stated we need to know what to do on variances for pump detention.
Sheryl Greiner stated we need to look at single ownership.
Todd Iocco stated we need to stick to the ordinance; we as a governing body have a
written code of ordinances that we interpret and make rulings. He stated we should abide
by them or grant variances to everyone.
Ruby Sandars stated she felt it should be consistent. Ray Bacon stated he thought it was
a poor ordinance.
Robert Scherrer stated he felt a variance should not be approved unless there is a
hardship; having to buy more land is not a hardship.
Ruby Sandars stated maybe experts could convince the City Council. Mrs. Sandars asked
Mrs. Greiner what she was worried about. Sheryl Greiner replied weither they truly meet
the definition of hardship.
Sheryl Greiner stated she felt the experts in the engineering department are saying it is
necessary to have pumped detention.
Don Sederdahl stated he felt there is no issue, we live in South Texas, the ordinance is
there and it can be changed in one meeting, but we need to refer to City Council and the
professionals to make the decision.
Russ Selemon stated we should uphold the ordinance.
Ruby Sandars stated she felt it was not right for the city to be able to use pumps if others
cannot use them. Todd Iocco replied a pump costs $20,000 and; the city has budget to
maintain these pumps.
Ruby Sandars stated businesses are a part of why we are flooding and we cannot do
anything personally.
Don Sederdal stated what is the conclusion, do we uphold ordinance and uphold elected
officials. Ray Bacon replied he felt we all agree on not approving variances, now that
City Council cannot overturn, end of discussion.
Planning and Zoning Commission
Theresa Grahmann stated that the Rules and Procedures have been tabled by Council, and
she would update you at the next meeting on the revisions.
