ZBA Chairperson Dale Pillow called to order the public hearing at 6:00 p.m. Alternative
Board Member John Gehring made a motion to approve, Vice -Chairperson Mark Lewis
seconded the motion. The motion carried 5-0.

NEW BUSINESS
ZBA APPLICATION NO. VARZ 17-00019
ZBA Chairperson Dale Pillow opened the public hearing for ZBA Application No. VARZ
17-0019 at 6:03 p.m.
CALL PUBLIC HEARING TO ORDER
ZBA Chairperson Dale Pillow read into the record the purpose of the hearing.
PURPOSE OF HEARING:
A request of Mona Miller, applicant, on behalf of 1000 East Broadway LLC,
represented by Christy Buck, owner; for a Special Exception as permitted by the
Unified Development Code, Ordinance No. 2000-T, to waive the Corridor Overlay
District requirements per Section 2.4.5.1. (c).
Legal Description: Being All of Reserve "A" of Final Plat of Sunset Lakes, Section
One (1), a subdivision in Brazoria County, Texas, according to the map or plat thereof,
recorded in Volume 19, Page 377 of the Map Records of Brazoria County, Texas.

Planner Armon Irones gave a presentation with exhibits and informed the Board that
no comment forms were received and 1 phone call inquiring for more information on
the request. Staff recommended approval of the special exception to allow the four
parking spaces to remain within the Corridor Overlay District required 30' building line
setback. The subject property was built in 1995 and the parking configuration is an
existing site condition. Relocating those four spaces on a limited site would be very
challenging. The parking does not create a nuisance or a hazard and to enforce the
COD guidelines upon the property would be burdensome since the new property
owner did not create the original parking layout.
Applicant, Mona Miller, 2524 Westminster, Pearland TX 77581, gave a brief
presentation and was available for comments and questions.

STAFF/BOARD/APPLICANT DISCUSSION
Alternative Board Member Gary Shrum asked Staff if the future expansion on Broadway
St/518 would affect the parking variance request. Planner Armon Irones explained that
it would not be affected.

PURPOSE OF HEARING:
A request of Font Design Studio, represented by C. Davis Wilson, applicant, on behalf
of Renee L. McGuire, owner; for a Special ExceptionNariance as permitted by the
Unified Development Code, Ordinance No. 2000-T, to construction of an accessory
building on a non -conforming land use per Section 2.7.3.7. (a).
Legal Description: A 7.060 acres (307,513 square feet) tract of land out of a called
38.5705 acre tract of land in the H.T. & B. R.R. Survey, A-551 in Brazoria County,
Texas, said 7.060 acre tract being out of and a part of a called 38.5705 acre tract
described in deed to Forgotten Angels recorded under Brazoria County Clerk's File
Number (B.C.C.F. No.) 2005002608 and including a called 2.7108 acre tract
described in the deed to Forgotten Angels.

Planner Armon Irones gave a presentation with exhibits and notified there were no
notices or phone calls received. Staff recommended approval of the special exception
to allow the accessory structure to be placed on a property with an existing
nonconforming land use and to update the site plan.
Applicant C. Davis Wilson and Tim Pylate, 3033 Chimney Rock #430, Houston TX
77042 gave a brief explanation of their request and were available for comments and
questions.

Renee L. McGuire, 7918 Broadway #106, Pearland TX 77581, spoke in favor of the
request.
STAFF/BOARD/APPLICANT DISCUSSION
ZBA Vice -Chairperson Mark Lewis asked applicant what the use for the accessory
building would be. Mr. Davis and Mr. Pylate informed that the building would be used to
facilitate the Forgotten Angels students who will working in horticulture activities.
Alternative Board member Gary Shrum asked Staff what was the current non-
conforming use, Mr. Armon explained the current zone is M1 light industrial.

PURPOSE OF HEARING
A request of Dreyer Capital Management, applicant, on behalf of A -S 143 SC Ranch,
LP, represented by Cindy McGill, and Shadow Creek Plaza LLC, represented by
Hassan B Mohammadian, owners; for a Special ExceptionNariance as permitted by
the Unified Development Code, Ordinance No. 2000-T, to reduce the parking
requirements for a Senior Multi -family facility per Section 2.2.5.2.
Legal Description: Being 11.958 acres of land located in S.G. Haynie Survey,
Abstract 212, City of Pearland, Brazoria County, Texas, more particularly being all of
that certain called 9.458 acre tract (described as Tract IV) conveyed to A -S 143 SC
Ranch LP, by an instrument of record in File Number 2017047179, of the Official
Public Records of said Brazoria County (B.C.O.P.R.), and a portion of that certain
called 8.853 acre tract conveyed to Shadow Creek Plaza, LLC, by an instrument of
record in File Number 20174007313, B.C.O.P.R.
General Location: 12300 Block of Shadow Creek Parkway, Pearland, TX 77584.
Planner Armon Irones gave a presentation with exhibits and notified that there were
no comments or phone calls received. Staff recommended approval of the 33%
reduction in parking for this senior multi -family facility. The site would look more
aesthetically pleasing with the addition of more landscaping as opposed to unused
parking spaces. The reduction of parking and increased landscaping is also good for
the environment because underused parking lots are known to cause raises in
temperature where they are located. By allowing the reduction to the parking, the
property owner can add amenities such as a walking trail and additional landscaping
to the development.
Applicant presentation James Lott 2929 Briarpark Dr., Houston TX 77042 and David
Hoff, 6919 Portwest Dr. #150, Houston, TX 77024 were present and available for
comments and questions.

STAFF/BOARD/APPLICANT DISCUSSION
Alternate Board member Gary Shrum asked Staff for clarification on the 33% reduction.
Mr. Irones and Senior Planner Martin Griggs explained the current parking ratio and the
new reduction numbers. Board member Nita Griffin asked Staff about parking for
visitors. Mr. Lott explained their group analyzed the parking of various senior apartment
developments that were similar in size to the proposed project. A discussion ensued
regarding the independent living and multi -family ratio listed under the UDC. Deputy
City Attorney Lawrence Provins gave an explanation of those different ratios and The
Fair Housing Act. Mr. Shrum was not in favor of the request.

ZBA Chairperson Dale Pillow adjourned the public hearing for ZBA Application No.
VARZ 17-00021 at 6:50 p.m.
CONSIDERATION AND POSSIBLE ACTION
Board member Nita Griffin so moved to approve the request, ZBA Vice Chairperson
Mark Lewis seconded the motion. The motion carried 4-1. Alternative Board member
Gary Shrum was opposed.
