2000-11-02 ZONING BOARD OF ADJUSTMENT REGULAR MEETING MINUTES MINUTES - REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENTS OF THE CITY OF PEARLAND, TEXAS, HELD ON THURSDAY, NOVEMBER 2, 2000, AT 6:00 PM, IN THE COUNCIL HAMBERS OF CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS CALL TO ORDER The meeting was called to order at 6:04 PM with the following present: Chairperson Gil Boyles Vice-Chairperson Suzanne Tullis Board Member Marvin Elam Board Member Harold Slagle Board Member Don Liddle Director of Community Development & Services Gene Tumlinson Secretary Trish Broussard II APPROVAL OF MINUTES - October 5, 2000 Vice-Chairperson Suzanne Tullis made a motion to approve the minutes as submitted. Board Member Harold Slagle seconded the motion. Motion passed 5 to 0 III NEW BUSINESS A. CONSIDERATION AND POSSIBLE ACTION - V00- 41, Request of Jack McGuff, Jr., AIA, agent for Hiep Pham, D.D.S., for a variance from Section 15.4.3.Yard (setback) requirements,for a 15'encroachment into the required 25' rear yard, at 5105 Broadway, Lots 10-12, Block 12, Mimosa Acres Jack McGuff, 5208 Broadway Ste 208, Pearland, explained that he started the project in May of 1999, then in June they attended a pre-development meeting with the City. At that time, there was a 0 rear yard set back, the construction plans were drawn with a 10' rear yard set back. The new ordinance calls for a 25' rear yard set back. The drawings are 60% complete. Director of Community Development Gene Tumlinson explained that we do not like a 0' rear lot line, but a 10' is workable. The project was already going on and they are caught in the middle. He stated the request is justified. Board Member Marvin Elam asked if they could move the parking to the rear. Mr. McGuff stated that there would not be enough room. Gene explained that parking spaces have to be large enough to back out of , therefore a safety issue may arise, with employees exiting out of the back rather than the front. Vice-Chairperson Suzanne Tullis made a motion, seconded by Chairperson Gil Boyles, to approve V00-41. Motion passed 5-0. B. CONSIDERATION AND POSSIBLE ACTION - V00-42 , Request of Bernard A. Correia, owner,for two variances from Section 22.6. Building Facades., 1) for a proposed warehouse to be built without any facade requirement; and 2) for a proposed office building to be built without meeting the facade on the East side, at 3807 Magnolia Street Pat Stair, 214 Bluebonnet, Clear Lake Shores, Manager for Crest Industrial, stated they have owned the property for 2 years. They are now ready to start the construction. They have 17 '/Z acres and plan to establish on Magnolia Rd but have been delayed due to the Magnolia overpass. The trees will be part of the landscape. He stated the building will not be seen from Magnolia. On the West side, the railroad blocks the view. A nd on the East side, the trees will be blocking the view of the building. Chairperson Gil Boyles asked what is going on the front of the warehouse. Mr. Stair stated that it would be a metallic building. Board Member Marvin Elam asked will you be bricking the south side. Mr. Stair stated that yes they would. Board Member Don Liddle asked are there any trees to block part of the view in front. Director of Community Development Gene Tumlinson stated there are no trees, but there are plans to have plenty of landscaping. Vice-Chairperson Suzanne Tullis made a motion, seconded by Chairperson Gil Boyles to approve V00-42. Motion passed 5-0 C. CONSIDERATION AND POSSIBLE ACTION - V00-43, Request of Kirk and Christine Scruggs, owner, for a variance from Section 7.4.2.b. Rear yard (setback) requirements, for a 5' encroachment into the required 20' rear yard, at 1504 Fallen Oak Ct, Lot 22, Block 1, Dixie Woods Kirk Scruggs, owner at 1504 Fallen Oak, Pearland, stated they would like a 12' extension built off the back of their house. It will be a covered patio and a study room for work. Director of Community Development, Gene Tumlinson, stated there are letters supporting his request from his neighbors. Vice-Chairperson Suzanne Tullis asked do you have someone behind you and are they aware of what you are wanting to do. Mr. Scruggs, stated that there is someone behind them and one of the letters is from the owner off Hickory Court. Vice-Chairperson Suzanne Tullis motion, seconded by Board Member Harold Slagle to approve VO0-43 Motion passed 5-0 D. DISCUSSION ITEM III ADJOURNMENT The meeting adjourned at 6:30 PM. 4.
