2020-06-15 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES MINUTES OF THE REGULAR MEETING VIA TELEPHONE/VIDEO CONFERENCE OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY, JUNE 15, 2020 AT 6:30 P.M., HELD IN THE COUNCIL CHAMBERS, 3519 LIBERTY DR. CALL TO ORDER Commissioner Ashlee Boswell opened the meeting for the P&Z Regular Meeting at 6:42 P.M. In attendance were: P&Z Commissioner Henry Fuertes P&Z Commissioner Ron Wicker P&Z Commissioner Andrew B. Earles P&Z Commissioner Brandon K. Dansby P&Z Commissioner Layni Cade Also present were Deputy City Attorney Lawrence Provins, Planning Manager Martin Griggs, Planner II Vince Hustead, Assistant City Engineer Parviz Pourazizian and Assistant Director of Engineering Rajendra Shrestha Temporary Chairperson Commissioner Ashlee Boswell read into the record the items on the consent agenda. CONSENT AGENDA All items listed under the "Consent Agenda" are considered to be routine and require little or no deliberation by the P&Z Commission. These items will be enacted / approved by one motion unless a commissioner requests separate action on an item, in which event the item will be removed from the Consent Agenda and considered by separate action (ix. Matters removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation. CONSIDERATION & POSSIBLE ACTION —APPROVAL OF MINUTES 1. Approve the P&Z Regular Meeting minutes for June 1, 2020 a. PLAT20-00048 - Vice-Chairperson Fuertes wanted corrections made on the meeting minutes, for the words "due to" to be changed to "lack of" on the third page, third paragraph. b. CLUS20-00001 - Vice-Chairperson Fuertes wanted corrections made on the meeting minutes, for the word "do" to be changed to "due" on the fourth page paragraph. Vice-Chairperson Fuertes made a motion to approve with changes, Commissioner P&Z Regular Meeting Minutes June 15, 2020 Page 1 of 10 Dansby seconded the motion Motion passed 6-0 NEW BUSINESS Chairperson Boswell read into the record the items on Consideration and Possible Action — Variance to create an irregular shaped lots VARP 20-00012 CONSIDERATION AND POSSIBLE ACTION — VARIANCE TO CREATE AN IRREGULAR SHAPED LOTS VARP 20-00012 A request of Cathy Fontenot of Survey 1, the applicant; on behalf of Kevin Kiran, owner; for approval of Variances Permitted in Section 2.6.1.1 (b) (1) of the Unified Development Code, Ordinance No. 2000-T, from the requirements of Section 3.2.14.2 (c) of the UDC to allow approval of the creation of irregular shaped lots described to wit: Legal Description: A subdivision of 5.367 acres (233,728 sq. ft.) in the W.D.C. Hall Survey, A-23,Brazoria County Texas, and the W.D.C. Hall Survey, A-23, Harris County Texas, also being a Replat of Reserve "A", of Green Tee Terrace, Section 1, as recorded in Volume 170, Page 28 of the Map Records of Harris County, Texas. General Location: 2809 Green Tee Drive Planner Vince Hustead presented the staff report with exhibits and informed. Mr. Hustead informed the commission how the land was located in the island of an oxbow lake, all of which was within the floodway and there were special requirements to allow additional fill within that designated area. Mr. Hustead informed the commission that staff recommended approval of the requested variances per Section 2.6.1.1 (b) (1), from Sections 3.2.14.2 (c) since it conforms to the requirements of the UDC for approval of a Planning and Zoning variance with the following conditions. 1. A Replat application be filed that conforms to the requirements of the Harris County Flood Control District regulations per Section 3.1.3.4. (a) (5) of the UDC. 2. A Replat application be submitted that conforms to the review of storm drainage by the Engineering Department and the Engineering Design Criteria Manual. Cathy Fontenot with Survey 1 informed the commission that BDD4 and Harris County Flood Control were currently reviewing the information. She informed the commission how the property owner had a civil engineer that was working on civil plans and the engineer would be sending information to both drainage districts. Chairperson Boswell questioned Cathy Fontenot if they had a time line of when they would be receiving comments from the districts. Cathy Fontenot informed P&Z Regular Meeting Minutes June 15, 2020 Page 2 of 10 the commission of the district's comments were, BDD4 was requesting an additional drainage easement and coordination with Harris County Flood Control. Harris County Flood Control was requesting an additional drainage easement as well as the civil plans. Public Input; Becky Cornelius — address 2415 Golfcrest Dr. Pearland. TX., Becky has lives in Green Tee for 44 years and knows a lot about the subdivision due to her being a realtor. She was asked to speak on behalf of others, they have many questions and not a lot of answers. She is worried about the impediments in the floodway, like the bridge (more concreate more flooding), the roadway along the side of the house and the wildlife habitat. Many assumed that the property was a wildlife preserve, but it wasn't. She questioned the commission if they had walked the property to see what they were voting on. She informed the commission of many problems in the years passed, with emergency vehicles, during a flood, a house burned down. The flooding makes it difficult for first responders to go through. She questioned if the owner would have a school bus needing to go through there. She informed the commission of how the area floods and how it would take a few days for the water to recede. She informed the commission how that area had a bad curve, adding already to the dangerous entrance into Green Tee, in addition to the bridge. She stated how they had started cutting down trees and if they would be charged for the trees. She questioned what the Flood Control would say about tearing up islands, building in the water way, and if that was even possible. She commented that building a bridge and a large foundation would add more concrete, causing more flooding in addition to the culvert plugging up, causing the City to clean them out. She questioned if they would need to build a retention pond and would that reduce property values and who was the jurisdiction. She concluded by saying that she rejects the variance and the plat, and she wishes they would reconsider everything. Johnelle Locher — address 2810 Green Tee Dr. Pearland, TX. Johnelle lives across the street from the proposed variance, she has lived there for 49 years. She informed the commission that she was opposed to the variance for all the same reasons as Becky stated, and how the oxbow acted as a retention pond for water from the golf course that goes under her property by a giant drainage ditch, depositing water to the property. She informed the commission how it was inadequate many times over the years, by a thunderstorm causing flooding. She thought any intrusion to the oxbow lake would be a disaster and she opposes it. Libby Wootton—address 2709 Green Tee Dr. Pearland, TX. She has lived there for 32 years and had been through hellacious floods. Her property backs up to the oxbow. She stated "to say that all the trees that have been destroyed to make room for the new property would not affect them was not true. We have been subjected or owned into people cutting down trees without a permit after 5pm and all-day Saturday and Sunday". She opposes the ordinance and the variance, and to any of it being done. She had a lot on neighbors who had been flooded countless times and had torn down houses on her street and are preparing to tear down more homes, how could we allow the build and the tearing down of trees that are stopping the water from coming their way. She just can't understand. She opposes everything. Charles Cummings — address 2806 Green Tee Dr. Pearland, TX. He lives directly across from the oxbow, he was opposed to the variance because of the potential flooding. He informed the P&Z Regular Meeting Minutes June 15, 2020 Page 3 of 10 commission of how he was stuck in his home for seven days during Harvey. He had stayed awake, all night to see if the water would rise into his home. He informed the commission how Mrs. Locher his neighbor, had a foot of water in her house. He couldn't see how building on the property would alleviate the flooding that happens when it rains and they can't get out, many times for days during a big rain. He can't see how allowing the big bridge, the home and the desecration of the property of taking down trees and so forth would be any benefit to this community. They have had a lot of flood problems in Green Tee and they had always considered that property a habitat for wildlife. Leslie Cummings — address 2806 Green Tee Dr. Pearland, TX. She lives across the street from the property and she was very opposed to the variance for several reasons, not only regarding the wildlife, but the potential flooding in front of her house and other houses that back up to the creek. She doesn't see any reason why anyone in their right mind would want to build a house on that piece of property, with very limited yard and why they would want to build a bridge, even if they must have one. She doesn't think that the bridge should be allowed and doesn't think that the property should be allowed to be built up, due to the flooding issues in the area. She would really appreciate it if the owner would find another place to build his home and build his bridge. Cynthia Taylor — address 2705 Green Tee Dr. Pearland, TX. She was opposed the variance for all the reasons decided. During hurricane Harvey, within three hours, the oxbow was full, and the water was up to her home. She commented that the oxbow could not be filled up and she doesn't know what would happen if it did. She stated that all the golf-course water causes the houses to flood. She was very much against it. She thanked everyone for their time. Ty Tran - address 2904 Green Tee Dr. Pearland, TX. His house was flooded during Harvey, and every time there is a heavy rain, the street floods. He was against the variance due to the flooding. Robert Roundtree — address 2718 Green Tee Dr. Pearland, TX. He has been a resident in the subdivision for 44 years and he agrees with all the statements that have been made about the flooding. He informed the commission that the flooding in the subdivision was bad, and the worst was on Green Tee Dr. near the oxbow lake, near 2809 Green Tee Dr., were the subject of the variance request was. He stated that in 40 years, they have had more than 21 properties that had flood regularly on Green Tee Dr. Seven of the properties had been behind his house and several people stated that the flooding was so bad it would lock them into the subdivision, and they would not be able to get in or out, with no access, even the emergency vehicles. He informed the commission that they had one property that had burned to the ground during one of the floods and the fire trucks could not get to the home. He expressed that everyone's concern was the drainage, and if it would be affected by the development of the property, especially the bridge necessary to access the oxbow property. The property sat at a higher elevation and would increase the risk of flooding the surrounding properties in addition to the extensive wildlife conditions that was threatened by all the current brush and tree removal that was going on. He had a discussion with all his concerns last week, with Planning Manager, Martin Griggs and Mr. Griggs was quite dismissive with all the concerns he raised especially the flooding. Mr. Roundtree mentioned to Mr. Griggs about the property's being in Brazoria and in Harris County. Mr. Roundtree stated that Mr. Griggs was adamant that both properties were in Harris County. The statement seems to be inconsistent with the agendas approving documentation that identifies the properties deed was reported in Harris County and the oxbows deeds records were reported in Brazoria County. Mr. Roundtree commented that perhaps the review by the commission should P&Z Regular Meeting Minutes June 15, 2020 Page 4 of 10 be conducted with more subdivision input on flooding risk, wildlife habitats, etc., instead it appeared that the issues, are already being dismissed are not really wanted by the City. He informed the commission that very few people had been contacted with the letters, very poor confusing procedures were provided and if the commission had all the facts like the county, of the property's location, flooding and the wildlife habitat, then a no vote on this variance would seem to be appropriate. He concluded, that he and his wife's, voted against on variance. Anastasia Hunt - address 2717 Green Tee Dr. Pearland, TX. She was so opposed, she didn't even understand how they had gotten that far, with all the flooding that they had gone through. She has lived in her home for 15 years, and her mouth dropped at the fact that this was even happening. The fact that they had been cutting down trees, every night after 5'olcock and on the weekends, all the habitat that was moving all over the place. She could currently see through her back-yard across, to the creek. She had bought her home because of the area and how it was aesthetically pleasing. She felt that the value of her home would be depreciated and not to mention the flooding, but the flooding was the primary concerns and the wildlife habitat. She concurred with all that had spoken before her and her concerns are as already stated. She was completely opposed to the variance and she was surprised that it had even come that far, and it was such a disappointment to her. Melinda Keniston—address 2703 Green Tee Dr. Pearland, TX. She was opposed to the variance. Her property backed up to the oxbow. Along with all, that everyone else had said regarding the flooding, there is a storm drain in between her and her neighbor(Cindy Taylor) property that went to the oxbow and if they had anywhere from 8 to10 inches of rain, it would be out of its banks and into their yards. It was a huge concern, knowing that the runoff for the neighborhood would be going somewhere that would not being contained. She was concerned about the trees that had already been torn down and the erosion that would come from that. With the flooding and the drainage, she thought that everyone on that street would all agreed that the ones who lived there should be considered before new built. Kevin Kiran property owner, he stated that it was the first time he had heard some of the complaints and he appreciates all the concerns expressed. In order to mitigate all, they were putting plans in place, and the professionals were working to mitigate all the issues. He informed the commission that his number one commitment and agreement was that he would not build a home that would impede with anyone's home. He informed the commission that there were many ways to mitigate, and his desire was to keep the oxbow clean, so that there could be a better flow of water into the oxbow. The reason why he bought the property was to have plenty of trees and water around the property and that the bridge would not be a culvert type of bridge, it would be free floating, not to block any water flow. He was relying on his civil engineer, who was working on getting everything sorted out. Chairperson Boswell read into the record the items on Consideration and Possible Action - Variance to create an irregular shaped lot. VARP 20-00012. Commissioner Cade made a motion to approve, Vice-Chairperson Fuertes second the motion. P&Z Regular Meeting Minutes June 15, 2020 Page 5 of 10 Commissioners discussion; Commissioner Cade commented, after hearing the residents' concerns and seeing the petition that was hand signed by many people, she would be against it, but she had concerns about the trees being cut down during odd hours before the item was brought to the P&Z, or a Council meeting. Commissioner Cade questioned how that was happening. Deputy City Attorney Mr. Provins questioned if any speakers had footage of somebody braking the law, like tree mitigation, and how that could be submitted to the Code Enforcement department. Mr. Provins informed the commission of a misunderstanding that had been brought to the Code Enforcement department twice, this was as recent as last Friday. Mr. Provins indicated that Code Enforcement and Urban Forestry, advised that cleaning under-bush was not a protected tree and when a surveyor is surveying a property, it was common to clear out the under-bush to complete the survey, and if Harris County or Brazoria County have their trucks out there and when one of the drainage districts does that, that would be their rights to do things within their easement. Mr. Provins informed the commission if somebody was out there after hours and are removing trees that are protected, Code Enforcement does want to know about that and if anyone has evidence of someone removing protected trees, they can contact the Urban Forester, Jerry Bradshaw. Commissioner Cade questioned if the trees would need to be replaced. Mr. Provins responded the Urban Forester would review that. Mr. Provins commented if someone was doing things improper that would tell you what kind of trust to put on that person, but at the end of the day it's a Code Enforcement issue and not an issue to do with the variance request. Mr. Provins informed the commission to make sure they don't go into detail about the Code Enforcement issues, and that the variance request was for the irregular shaped flag lot and how that would need to be the focus of the comments. Mr. Provins informed the commission if the City had documented violations, the City would have brought that to their attention. Mr. Provins informed the commission that it could be a condition for approval. Commissioner Cade thanked Mr. Province, and she wanted to get clarification on it just because of it being mentioned so many times. Cathy Fontenot with Survey 1 informed the commission that they did have a survey done and that could have been some of the noise, from the under-brush. Commissioner Dansby commented, that the commission was looking at a Re-Plat and staff recommends approval of the variance contingent upon, the application conforming with the Harris County Flood District and the submission of review from Engineering. Commissioner Dansby questioned if the case could be tabled or discuses at a future date contingent on the items being brought and cleared and possible approve or disproved, or however needing to work through the Harris County Flood Control and the Engineering or would the commissioners needing to vote yes or no on the variance as it stood as proposed. Mr. Provins explained that they would not be discussing the Re- Plat due to it being withdrawn and the focus would be voting on the variance for the irregular shaped lot and the flag lot to allow the driveway to connect to Green Tee Dr. Mr. Provins informed the commission if they approve the variances, then they could submit for the Re-Plat, and how the application was withdrawn to allow time to resolve the variance and the flag lot. Mr. Provins explained how the lot was within the 2012 USA Army Corp of Engineers, General Re-evaluation Report and how it was an environmentally sensitive area that will be potentially rehabilitated, as part of the Corps - Clear Creek Federal Flood Risk Management Project. Mr. Provins explained how construction within the oxbow area was considered restricted and the guidance prohibits fill in the flood plain and flood way, the oxbow would not be filled within the survey high bank, that would apply with both the structure and ground improvement such as driveways and culverts. Mr. Provins informed the commission that they had four voting options #1 could approve the items conditionally on them getting all the approvals from the appropriate entities and as soon as they provide City staff with all approvals, that condition would be satisfied, #2 can postpone to a definite P&Z Regular Meeting Minutes June 15, 2020 Page 6 of 10 date or event (this could leave the time period for a long time), #3 vote the item no and the reason why (when they re-apply again they would have to show the things, at the time of the application process), #4 vote the item yes (approve variance and flag lot). Commissioner Wicker commented that he had lived there off and on for a few years and he commented that saying that the property would create additional flooding would be an understatement. Commissioner Wicker was there in 79 when they had the big flood and was there through other floods, the property owner has the right to utilize their property if they could solve all the issues that exist, and he was not sure that it would be possible. Commissioner Wicker had seen the property under water more then it had been dried, he felt that the commission had approved many irregular shaped lots in Pearland, they were on almost every P&Z agendas, however the issue was it would be up to the property owner, the Engineers and drainage district to resolve all the problems and whether they can make the property buildable or usable would be up to them. Commissioner Wicker thought if the commission could stop that process, the commission would be in the position of being claimed as they were taking the property. Commissioner Wicker thought it was important to give the applicant the ability to see what they can do and if they could do it, it would be up to them. Mr. Provins informed the commission that drainage and flooding was an infrastructure issue, and both related to the plat or to the building permit, the driveway issue and the irregular shape were the issues on the meeting's agenda. Mr. Provins wanted to make sure that the commission separated the two issues. Mr. Provins informed the commission that if and when they come-in for the Re-plat application, then they would have to show all the requisite, infrastructure and drainage would be included on the Re-plat, in regards to whether or not it might negatively affect people in the neighborhood, that would be a building permit issue and the focus of the meeting was the irregular shape lot and the variance for the flag lot, and were the driveway connection to Green Tee Dr. Commissioner Cade questioned if the applicants Engineer was available to speak. Mr. Provins responded no to the question. Assistant Director of Engineering Rajendra Shrestha informed the commission of the Engineering updates and comments, and the challenges of developing the property. Mr. Shrestha informed the commission of the Risk Management Projects Plan to reutilize and reconnect all the oxbows, not only the one in question, but several of them and to revitalize and reuse them. Mr. Shrestha informed the commission that the City didn't know the exact design, but a few weeks back the City Manager shared a presentation of several oxbows, in the City Council's Thursday's Packet Agenda. He commented that the City would not allow grading in the floodway and the only way to build would be on pier and beam. Mr. Shrestha mentioned that the property was shown to be in Harris County, based on Harris County maps and the City of Pearland's GIS maps, however based on BBD4, the property was shown to be in Brazoria County. Mr. Shrestha informed the commission how the property was sold to a private owner about seven years earlier. Mr. Shrestha informed the commission that the original Clear Creek went through the oxbow and that anyone building in the floodway whether it's Harris County, BDD4 or City of Pearland, all would have to go through the Conditional Level of Map by applying through FEMA, to see if they would allow the proposed future construction, then if FEMA allows the construction the LOMA process would take more then six months. Mr. Shrestha concluded that there were several challenges to develop the land. Mr. Provins questioned Mr. Shrestha if that would pertain to the driveway and the flag lot, as well as the development of the lot. Mr. Shrestha answered that it was for the development of the lot, due to it being surrounded by the oxbow. Mr. Shrestha explained that it was just in general and not looking into the driveway issues, however he didn't have an issue for the variance or flag shaped lot. Chairperson Boswell commented that she felt that the qualifications were met on the criteria for the irregular shaped lot, but the issues came in hand when it was concerning the Re-plat and knowing the process of P&Z Regular Meeting Minutes June 15, 2020 Page 7 of 10 review for the civil engineers and what requirements need to be made to ensure that the area does not flood. Chairperson Boswell commented that the issue concerning the flooding didn't configure the variance for creating the irregular shape lot at that time, but that would come in later, if the commission approved. Commissioner Fuertes commented, with all the discussions they had and having many issues out of their purview, not knowing where the driveway or the flag for the flag lot, he recommended that the variance be tabled and if they try to wait on a LOMAR or the Conditional Map Prevision it could take six months, would that be normal to table for six months and would that be sufficient timing. Commissioner Fuertes was leaning on tabling the variance, but he was not sure if that was appropriate, and he wanted to know how the other commissioners felt. Commissioner Cade mentioned that she lives in the Wood Creek neighborhood and it was very close to Green Tee, she stated that she was trapped for five days after Harvey, she has seen the flooding before. Commissioner Cade commented on the bridge/driveway, not knowing anything about that and not having the confidence in the process that's happening and based on the residents comments, she would vote no. Chairperson Boswell was opened to tabling the item and even though there were questions that were asked, concerning the feedback, the discussions lead provided concerning personal experience and not being able to provide enough detail information. Chairperson Boswell had concerns and was not ready to vote yes, she would want to table the item but like Commissioner Fuertes commented, it would be in the indefinite future, so she was torn however the lack of detail concerning the project at the time was a concern with too many unknowns, she votes to table. Mr. Provins explained that if they were going to postpone making sure they were clear on what they were looking for, in order to knows when to bring it back and if they were going to vote it down it would be helpful for staff to state reason and criteria for the approval, to follow the law. Based on the comments that he heard it would appeared that based on the criteria for approval outlined in section 2.2.5.2 (d) of the UDC the comments that people were having or questions from commission relate to sub paragraph 4 wondering whether or not detrimental to the public health safety or since you know where the driveway is going to be located or how it will be relocated until you hear for the agency approvals and also in relation to sub paragraph 8 making sure your variance was a minimum amount allowed because we don't know the width of the driveway Harris County Flood District, BDD4, or Army Corp of Engineers. Assistant City Engineering Parviz Pourazizian commented that engineering requirements for the location of the driveway separation would need to be 75' feet from any existing and proposed driveway and how the existing driveway to the other 90-degree turnaround was over 300' feet to the other driveway, per the City's requirement there was no issue on location of the driveway. Mr. Pourazizian informed the commission that the dimension of the driveway requirement would be during the permitting stage and in a residential driveway, the minimum would be 10' and the maximum would be 20' and the City would not permit if it didn't meet the development requirements. Commissioner Cade commented reiterated her reasons for saying no was due to the turn out of residents who live there and were all opposed, the fact of the property being in the floodway and how it seemed to be a disaster waiting to happen. Commissioner Dansby wanted to clarify that all they were looking at was the variance for the irregular shaped lot, he understood the drainage problem, the floodway, and the driveway. Mr. Provins informed the commission that the irregular lot was broken down into two issues, one was the shape (not a square) and the other was the flag lot (flag lots go into the irregular shape of the lot) and the question was would the commission approve that flag, typically they would have to be 50' wide (hat was the standard in residential areas) (chapter 2 on configuration of lots) a question could be if they wanted a narrow flag pole or a wide flag pole and where should it be located. Mr. Provins commented that engineering had stated that in relation to the driveway separation, the location would not be an P&Z Regular Meeting Minutes June 15, 2020 Page 8 of 10 issue, a full engineering analysis could say here would be the best place for the curb cut. Mr. Provins explained that the issue was the flag would be where the connection would be based on the hydrology and the drainage, that would be the reason why he thought it would be relevant. Commissioner Dansby commented that the commission was not the drainage commission and for them to make a decision based upon the issues was not necessary in the parameters that they were looking at. Mr. Provins commented that they were looking at approving the flag and where the flag will go. Commissioner Dansby commented that he didn't doubt that there were problem and asked the commissioners to make sure they were all clear on what they were voting on. Planning Manager Mr. Griggs clarified the chapter on where to find the information on the width of the flag lot for residential and where he found the information of the property being in Harris County's GIS and the survey that was submitted with the proposal from Survey One. Mr. Griggs explained if he had misunderstood or construed information, those were his sources. Commissioner Fuertes questioned if the neighbors would be receiving a public notice for the next meeting. Mr. Griggs informed the commission that they would. Commissioner Fuertes made the motion to table the item for 90 days, to allow the owner to get more clarification from the drainage districts; would be either or both Brazoria County BDD4 and/or Harris County Flood Control, it would give the commission a better understanding of the location of the flag lot. Commissioner Wicker second the motion. Motion carried 4 to 2, commissioner Cade and commissioner Earles in Opposition. 90 days would take them to the September 21, 2020 P&Z meeting. She started that driving down Broadway St. there were many of them. Mr. Provins commented that they would not be able to provide additional information during the meeting, due to it not being posted on the agenda under discussion, but he encouraged her to reach out to Mr. Griggs offline. Commissioner Cade informed the commissioners that she drove down Broadway and took photos of all the LED lights.
