CALL TO ORDER Chairperson Ron Wicker opened the meeting for the P&Z Regular Meeting at 6:30 P.M. In attendance were: P&Z Commissioner Layni Cade P&Z Commissioner Andrew B. Earles P&Z Commissioner Ashlee Boswell P&Z Commissioner Henry Fuertes Also present were Deputy City Attorney Lawrence Provins, Planning Manager Martin Griggs, Planner Vince Hustead, Assistant City Engineering Parviz Pourazizian Commissioner Fuertes made a motion to appoint Commissioner Ronald Wicker as Temporary Chairperson. Commissioner Earles seconded the motion. The motion passed 5-0 Temporary Chairperson Commissioner Ronald Wicker read into the record the items on the consent agenda. No items for approval CONSENT AGENDA All items listed under the “Consent Agenda” are considered to be routine and require little or no deliberation by the P&Z Commission. These items will be enacted / approved by one motion unless a commissioner requests separate action on an item, in which event the item will be removed from the Consent Agenda and considered by separate action (ix. Matters removed from Consent Agenda). Approval of the Consent Agenda enacts the items of legislation. NEW BUSINESS Chairperson Wicker read into the record the Consideration and Possible Action – Approval of an irregular shaped lot to allow approval of an amending plat of a property. VARP 20-00005 CONSIDERATION AND POSSIBLE ACTION – APPROVAL OF AN IRREGULAR SHAPED LOT TO ALLOW APPROVAL OF AN AMENDING PLAT OF A PROPERTY. VARP 20-00005 A request of Chad Gormly, the applicant; on behalf of Denise Vargo, owner; for approval of a Variance Permitted in Section 2.6.1.1 (b) (1) of the Unified Development Code, Ordinance No. 2000-T, to allow approval of the creation of an irregularly shaped lot described to wit: P&Z Regular Meeting Minutes April 6, 2020 Page 2 of 6 Legal Description: A plat of 0.85 acres, being all of Lot 3, and the west 10 feet of Lot 2, Block 3 Skyway Manor Subdivision, as recorded in Volume 7, Page 67, Plat Records, Brazoria County, Texas. General Location: 2723 Manvel Road Planner Hustead presented the staff report with exhibits and informed that staff recommended approval of the requested variance regarding the creation of an irregularly shaped lot regulated by Section 3.2.14.2 (c), permitted by Section 2.6.1.1 (b) (1), which requires approval by the Planning and Zoning Commission for the creation of irregularly shaped lots for the following reason: 1. Motion passed 5-0 Chairperson Wicker read into the record the items on Consideration and Possible Action - Final plat of Stewart Heights at Savannah section 14 PLAT 20-00024 CONSIDERATION AND POSSIBLE ACTION – FINAL PLAT OF STEWART HEIGHTS AT SAVANNAH SECTION 14 PLAT 20-00024 A request of Cameron Lowe, of LJA Engineering, the applicant; on behalf of Savannah Development, LTD., owner; for approval of the Final Plat of Stewart Heights at Savannah Section 14 creating 55 single family lots, and 6 reserves on 16.078 acres of land located north of County Road 58, west of Augusta Manor Drive, described to wit: Legal Description: A subdivision of 16.078 acres of land situated in the A.B. Langerman Survey, Abstract 456, Fort Bend County, Texas General Location: North side of County Road 58 west of Augusta Manor Drive. Planner Hustead presented the staff report with exhibits and informed that staff recommended approval of the Final Plat of Stewart Heights Section 14 as proposed by the applicant for the following reason: 1. The plat conforms to the Savannah Lakes Development Agreement. 2. The Final Plat of Stewart Heights at Savannah Section 14 conforms to the UDC requirements for a final plat. 3. The Final Plat of Stewart Heights at Savannah Section 14 conforms to the Preliminary Plat of P&Z Regular Meeting Minutes April 6, 2020 Page 3 of 6 Stewart Heights Section 14. P&Z Commission and staff discussion, Chairperson Ron Wicker questioned why the City was approving plats in Fort Bend County. Planner Vince Husted answered by explaining how the property was in the City of Pearland’s ETJ and how the City had a Lakes of Savannah Development Agreement. Deputy City Attorney Lawrence Provins informed the Commission how the City of Pearland had already approved portions of Lakes of Savannah. Motion passed 5-0 Chairperson Wicker read into the record the items on Consideration and Possible Action – Preliminary plat of Stewart Heights at Savannah section 15 PLAT 20-00029 CONSIDERATION AND POSSIBLE ACTION - PRELIMINARY PLAT OF STEWART HEIGHTS AT SAVANNAH SECTION 15 PLAT 20-00029 A request of Jennifer Curtis, of META Planning and Design, the applicant; on behalf Brian Gibson of Savannah Development, LTD., owner; for approval of the Preliminary Plat of Stewart Heights at Savannah Section 15 creating 48 single family lots, and 5 reserves on ±21.0932 acres of land located north of County Road 58 / Post Road west of the Brazoria / Fort Bend County line. Legal Description: Being ± 21.0932 acres of land containing 48 lots (50’ × 120’ type) and 5 reserve in three blocks out of the A.B. Lagemann Survey, A-456 Manuel Escalera Survey, A-170 Fort Bend County, Texas General Location: North of County Road 58 / Post Road west of the Brazoria / Fort Bend County Line. Planner Hustead presented the Staff Report with exhibits and informed staff recommends approval of the Preliminary Plat of Stewart Heights Section 15 as proposed by the applicant for the following reasons: 1. Langerman Survey, Abstract 170, Fort Bend County, Texas General Location: North side of Post Road west of Hawthorne Village Drive. Planner Hustead presented the Staff Report with exhibits and informed staff recommends approval of the Post Road Street Dedication Section 1 for the following reasons: 1. The proposed right of way dedication will improve a link between Brazoria County and Fort Bend County. 2. The proposed plat improves public access to and from Fort Bend County. 3. Planner Hustead presented the Staff Report with exhibits and informed staff recommends approval of the Replat of the Center at Pearland Parkway Phase II for the following reasons: 1. The Replat of The Center at Pearland Parkway Phase II conforms to the UDC requirements for approval of a Replat. 2. The area of the Replat of The Center at Pearland Parkway Phase II conforms to the approved Planned Unit Development. 3. The Replat of The Center at Pearland Parkway Phase II conforms to the Master Plan of The Center at Pearland Parkway Phase II.
