R2006-26 A RESOLUTION AND ORDER OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, ORDERING THE HOLDING OF A GENERAL AND SPECIAL ELECTION TO BE HELD ON SATURDAY, MAY 13, 2006, FOR THE PURPOSE OF ELECTING TWO MEMBERS OF THE CITY COUNCIL IN AND FOR THE CITY OF PEARLAND, TEXAS; AND FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF THE CITY OF PEARLAND, TEXAS, CERTAIN PROPOSED CHARTER AMENDMENTS; ESTABLISHING POLLING PLACES; NAMING CLERKS; AND ESTABLISHING PROCEDURES FOR SAID REGULAR CITY OFFICERS AND SPECIAL ELECTION. WHEREAS, the laws of the State of Texas provide that on the second Saturday in May, a General Election and Special Election shall be held within the City; and WHEREAS, the City Charter of the City of Pearland and the laws of the State of Texas provide that the Election Code of the State of Texas is applicable to said General Election and Special Election, and in order to comply with said Code, an Order and/or Resolution should be passed ordering the call of said General Election and Special Election, establishing procedures to be followed in said election and to designate the voting places of said election; therefore, BE IT RESOLVED AND ORDERED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. The General Election of the City of Pearland, Texas, shall be held for the purpose of electing the following officials for said City, to -wit: Member of the City Council, Position Number Two (2), for a three-year term. Member of the City Council, Position Number Four (4), for a three-year term. Section 2. The Special Election of the City of Pearland, Texas, shall be held for the purpose of submitting to the qualified electors of the City of Pearland, Texas, a proposition, to -wit: RESOLUTION NO. R2006-26 Five (5) proposed Charter Amendments attached hereto as Exhibit "A" Section 3. The election precincts for the Election shall include county election precincts located within the limits of the City of Pearland, City of Pearland Voting Precinct No. 546 will consist of Brazoria County Precinct Numbers 28, 46, 51, 61 and 68, Harris County Election Precinct Numbers 537 and 654 shall be held at the Melvin Knapp Activity Building, 2425 S. Grand Boulevard, Pearland, Texas and City of Pearland Voting Precinct No. 512 will consist of Brazoria County Precinct Numbers 12, 26, 29, 36, 58, 59, 60, 62, 63, 64, 65, 67, 76, and 77, Harris County Election Precinct Numbers 131 and 630, and Fort Bend County Precinct Number 2003 shall be held at the Jamison Middle School, 2506 Woody, Pearland, Texas. The polls on said Election Day shall be open from 7:00 a.m. until 7:00 p.m. Section 4. Wanda Heard is hereby appointed as Presiding Judge and Adela Villarreal as Alternate Presiding Judge for City of Pearland Precinct No. 546. Cheryl Barnett is hereby appointed Presiding Judge and Susan Cullen as Alternate Presiding Judge for City of Pearland Precinct No. 512. The Presiding Judge shall appoint the necessary clerks to assist her which shall be not less than two (2) nor more than nine (9) clerks. Notice of appointment of Presiding Judge shall be in accordance with Section 32.009 of the Texas Election Code. Section 5. Early Voting by mail for the General and Special Election may be conducted by making application for an early voting ballot with Young Lorfing, Early Voting Clerk, 3519 Liberty Drive, Pearland, Texas 77581-5416. Voters qualified to vote early by mail may begin applying for a ballot by mail on Tuesday, March 14, 2006. Section 6. In accordance with Texas Election Code, early voting by personal appearance shall be conducted each weekday between the hours of 7:30 a.m. and 5:30 p.m. at Pearland City Hall, First Floor Conference Room, 3519 Liberty Drive, 2 RESOLUTION NO. R2006-26 Pearland, Texas 77581 and between the hours of 8:00 a.m. and 5:00 p.m. at Westside Event Center, 2150 Countryplace Parkway, Pearland, Texas 77584. The period for early voting by personal appearance shall begin on Monday, May 1, 2006, the 12th day before Election Day and continue through Tuesday, May 9, 2006, the 4th day before Election Day. If the 12th day for beginning the period of early voting is a Saturday, Sunday, official City holiday, or legal State holiday, the period will begin on the next regular business day. Late voting by sick or disabled voters after close of regular early voting period shall be in accordance with Chapter 102 of the Texas Election Code. Early Voting on Monday, May 8, and Tuesday, May 9, 2006, will be conducted from 7:00 a.m. until 7:00 p.m. at the aforementioned voting locations. Section 7. Young Lolling is hereby appointed Clerk for early voting and Sonia Blair, and Jane Taylor are hereby appointed Deputy Clerks for early voting. Section 8. The City of Pearland contracts with Brazoria County for the provisions of election services and on January 3, 2006, the County adopted the Hart InterCivic eSLATE voting system for in -person voting on election day and during early voting by personal appearance and the Hart InterCivic Ballot Now Voting System for early voting by mail. The City Council of the City of Pearland adopted Resolution No. 2006-22 on February 13, 2006, adopting the electronic voting system that coincides with the electronic voting system adopted by Brazoria County and that is accessible to individuals with disabilities will not impede voter access or lessen voter turnout. Section 9. Cheryl Barnett is hereby appointed as the Presiding Judge of the Early Voting Ballot Board for said election. The Presiding Judge shall appoint the necessary clerks to assist her which shall be not Tess than two (2). Section 10. The above -called elections shall be held in accordance with the Election Code of the State of Texas and only resident qualified voters of the City of Pearland shall be eligible to vote at said election. 3 RESOLUTION NO. R2006-26 Section 11. Notice of the above -ordered election shall be given in accordance with the terms and provisions of Chapter 4 of the Texas Election Code and the City Secretary is hereby instructed to have said notice posted and/or published in accordance with said Chapter 4. Section 12. Immediately after said General and Special Election is held, the officer holding the same shall make known results of the returns thereof to the Mayor in accordance with the Texas Election Code. Section 13. All independent candidates for the General Election to be held on May 13, 2006, for Council Position Number Two (2) and Council Position Number Four (4), shall file their applications to become candidates for said positions with the City Secretary of this City at the City Hall, 3519 Liberty Drive, Pearland, Texas 77581-5416, on or before 91 days before the date of said election. The earliest day for filing applications shall be 91 days before the deadline for filing. Section 14. All candidates for the General Election shall file, along with said applications, the loyalty affidavit and nepotism law as required by Section 141.031 of the Texas Election Code. Section 15. The City Secretary of the City shall post in his office the names of all independent candidates who have filed their applications in accordance with the terms and provisions of this Resolution and Order, and said names shall be posted at a conspicuous place in said office for at least 10 days before said Secretary orders the same to be printed on the Official Ballot for said election. The order in which the names of the candidates are to be printed on the ballot shall be determined by a drawing by the City Secretary as provided by Section 52.094 of the Texas Election Code. Section 16. The City Secretary is hereby authorized and instructed to provide and furnish all necessary election supplies to conduct said election. 4 RESOLUTION NO. EXHIBIT \‘/9 // The inhabitants of the City of Pearland in Brazoria, and Harris and Fort Bend Counties, Texas, within the corporate limits as now established and as hereafter altered, shall continue to be and are hereby constituted a municipal body politic and corporate, in perpetuity, under the name "CITY OF PEARLAND," hereinafter referred to as the "city," and having such powers, privileges, rights, duties and immunities as are herein provided. Section 3.01. Number, selection and term. The legislative and governing body of the city shall consist of mayor and five (5) council members and shall be known as the "city council of the City of Pearland, Brazoria, and Harris and Fort Bend Counties, Texas." (a) The mayor shall be elected from the city at large. The councilmembers shall be elected from the city at large by positions and shall be known as positions 1, 2, 3, 4 and 5. (b) The mayor shall be the presiding officer of the city council and shall be recognized as the head of the city government for all ceremonial purposes and by the governor for purposes of military law. The mayor shall be allowed to vote only in case of a tie vote. The mayor shall not be included in any calculation of the number of votes needed for the city council to take any action authorized by this charter, except when the mayor is allowed to vote in the case of a tie vote. Section 3.08. Meeting of the city council. The city council shall hold at least two (2) regular meetings in each month at a time to be fixed by said city council by ordinance or resolution fixing the dates of such regular meetings. As many additional special meetings may be held during the month as may be necessary for the transaction of all business of the city and its citizens. All meetings shall be public, except where authorized by law, and shall be held at the city hall, provided, however, the city council may designate another place for such meetings after publishing the due notice thereof in one (1) issue of the official newspaper of said city. The city secretary, upon written request of the mayor or any two councilmembers, shall call special meetings of the city council, notice of such special meetings shall be given to 2005 Proposed Amendments each member of the city council at least seventy-two (72) hours before the start of the meeting, which said notice shall state the date for such meeting and the subject to be considered at such meeting, and no other subject shall be there considered except with unanimous consent of the city council. Said notice to the city council shall be sufficient if delivered to the councilmembers in person, or in the event of the inability to locate said councilmember within the City of Pearland, Texas, delivery of such notice to his or her home shall be sufficient. Section 4.08. Department of Health and Sanitation. (c) Duties of the health authority: The city health authority shall advise the city manager on a program of public health; shall cooperate in the preparation of sanitary code; shall cooperate with nearby cities on problems of health and sanitation; shall cooperate with the commissioner's court of Brazoria, and Harris and Fort Bend Counties, Texas and its (their) agencies, and with the state health department and other departments of the state government in matters pertaining to health and sanitation. Section 6.13. Initiative. Qualified voters of the City of Pearland may initiate legislation by submitting a petition addressed to the city council which requests the submission of a proposed ordinance or resolution to a vote of the qualified voters of the city. Said petition must be signed by qualified voters of the city equal in number to of at least thirty (30) per cent of the number cast at the regular last municipal election of the city, or one hundred fifty (150) qualified voters, whichever is greater, and each copy of the petition shall have attached to it a copy of the proposed legislation. The petition shall be signed as provided in section 6.03 of this charter. The petition may consist of one (1) or more notarized copies as permitted in section 6.05 of this charter. Such petition shall be filed with the person performing the duties of city secretary. Within five (5) days after the filing of such petition, the person performing the duties of city secretary shall certify such petition or return same to petitioners. After certification, the person performing the duties of the city secretary shall present said petition and proposed ordinance or resolution to the city council at the next regular meeting. Upon presentation to the city council of the petition and draft of the proposed ordinance or resolution, it shall become the duty of the city council within ten (10) days after receipt thereof, to pass and adopt such ordinance or resolution without alteration as to meaning or effect in the opinion of the persons filing the petition or to call a special election, to be held within thirty (30) days thereafter, at which the qualified voters of the City of Pearland shall vote on the question of adopting or rejecting the proposed legislation. However, if any other municipal election is to be held within sixty (60) days after the filing of the petition, the question may be voted on at such election. No ordinance shall be proposed by an initiative petition which is on the same subject as an ordinance so submitted and defeated at an election held within the proceeding twelve (12) months. 2005 Proposed Amendments Section 6.14. Referendum. Qualified voters of the City of Pearland may require that any ordinance or resolution with the exception of ordinances or resolution levying taxes or issuing tax or revenue bonds, passed by the city council be submitted to the voters of the city for approval or disapproval , by submitting a petition for this purpose within thirty (30) days after final passage of said ordinances or resolution or within thirty (30) days after is publication. Said petition shall be addressed, prepared, signed and verified as required for petitions initiating legislation, as provided in section 6.13 of this charter and shall be submitted to the person performing the duties of city secretary. Immediately uUpon the filing of such petition, the city secretary shall present said petition to the city council at the next regular meeting of the city council. Thereupon the city council shall immediately at the same meeting reconsider such ordinance or resolution and if it does not entirely repeal the same, shall submit it to popular vote as provided in section 6.13 of this charter. Pending the holding of such election, such ordinance or resolution shall be suspended from taking effect and shall not later take effect unless a majority of the qualified voters voting thereon at such election shall vote in favor thereof.
