RESOLUTION NO. R2006-22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND,
TEXAS, ADOPTING THE NEWLY ACQUIRED E-SLATE VOTING SYSTEM
FOR CITY ELECTIONS.
WHEREAS, the City of Pearland ("City") currently utilizes optically scanned paper
ballots in its elections; and
WHEREAS, the City contracts with Brazoria County for the provision of election
services, and the county has adopted the Hart InterCivic e-slate voting system for in-person
voting on election day and during early voting by personal appearance and the Hart
InterCivic Ballot Now Voting System for early voting by mail; and
WHEREAS, Section 61.012 of the Texas Election Code has been amended to
require that no later than January 1, 2006 each polling place for every election conducted in
the State of Texas have a voting system accessible to individuals with disabilities; and
WHEREAS, the City Council has determined that adopting an electronic voting
system that coincides with the electronic voting system adopted by the County and that is
accessible to individuals with disabilities will not impede voter access or lessen voter
turnout.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. All of the above paragraphs are incorporated into and made part of this
Resolution.
Section 2. Future City elections shall employ the Hart InterCivic e-slate voting
system for in-person voting on election day and during early voting by personal appearance
and the Hart InterCivic Ballot Now Voting System for early voting by mail.
Section 3. Future City elections shall employ at each polling place called by the
election at least one direct recording electronic voting machine or other voting suitable

equipment that is accessible to individuals with disabilities and complies with Section
61.012 of the Texas Election Code.
Section 4. This Resolution shall become effective from and after its passage
subject to approval under the Voting Rights Act of 1965, as amended.

New Voting Equipment
As everyone is aware, January 1, 2006 was the deadline to provide for accessible voting
statewide. Brazoria County has secured its new voting system that meets the
requirements ofthe Help America Vote Act. Most of you have in the past rented your
voting equipment from the County and we are aware that you will continue this process.
Some of you have held your elections by means of paper ballots and have never rented
equipment from our office. We are sending this letter to all Political Subdivisions in
Brazoria County in order first, to help you with your preclearance submission to the U. S.
Department of Justice; and second, our office needs to hear from the entities that have not
previously rented equipment but may be interested in renting equipment for future
elections.
If you have not previously rented equipment from Brazoria County but are now
considering renting our machines to keep you in compliance with the new HA V A
requirements, we ask that you please contact our office at your earliest convenience. We
have a limited number of machines and we need to know in advance of the May elections
just who needs to rent equipment.
Before a newly acquired voting system may be used in elections, the political subdivision,
by resolution, order, or other official action of the authority, must adopt the system for
use in the elections. {Tex. E1ec. Code 123.001 (a)}
After the court has adopted the new system, it must be submitted for preclearance with
the U. S. Department of Justice (DOJ) under Section 5 of the Voting Rights Act. We
have enclosed a copy of Brazoria County's entire submission letter to the DOJ to assist
you in preparing your submission.
