R2021-121.2 A Resolution of the City Council of the City of Pearland, Texas, amending the proposed election measure, for submission to the voters at the May 7, 2022 election, seeking authorization to establish a Municipal Drainage Utility System pursuant to Texas Local Government Code Chapter 552 (“Code”) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1.That the Code authorizes the City Council to establish a Drainage Utility System and charge a drainage utility fee for the enhancement, improvement and ongoing renewal of the City’s drainage systems. Section 2.That the City Council has determined that the voters of Pearland should determine whether a Drainage Utility System should be established. Section 3.That an election measure for creation of a Drainage Utility System, as shown on Exhibit “A” attached hereto, shall be presented to the voters at the May 7, 2022 election. COKER CITY ATTORNEY DocuSign Envelope ID: 53457356-37C3-4014-B09A-A79526731266 EXHIBIT A Proposed Measure: Authorizing establishment of a Municipal Drainage Utility in accordance with Chapter 552, Municipal Utilities, Subchapter C, of the Texas Local Government Code, to fund drainage system improvements using monthly drainage utility charges (“Fees”) in the amount of $5 per month for all residential properties and $1.79 per 1,000 square foot of impervious coverage for all non-residential properties, subject to the following Conditions: a) 85% of all Fees shall be designated for capital drainage projects; b) Fees shall not be amended more often than once every 5 years; c) Fee increases shall be limited to the combined increases of a Consumer Price Index (CPI) for the previous 5 year period; and d) proposed amendments to the referenced Conditions shall be subject to voter approval.
