2020-02-17 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTESMINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY, FEBRUARY 17, 2020 AT 6:30 P.M., HELD IN THE COUNCIL CHAMBERS, 3519 LIBERTY DR. CALL TO ORDER Chairperson Daniel Tunstall opened the meeting for the P&Z Regular Meeting at 9:23 P.M. In attendance were: P&Z Commissioner Ronald Wicker P&Z Commissioner Layni Cade P&Z Commissioner Andrew Earles P&Z Commissioner Ashley Boswell Also present were Deputy City Attorney Lawrence Provins, Planning Manager Martin Griggs, Planner Vince Hustead, Assistant Director of Engineering Raj Shrestha, and Office Assistant Alma Gonzales Chairperson Tunstall read into the record the items on the consent agenda. Commissioner Wicker made a motion to approve, Commissioner Cade seconded the motion. CONSENT AGENDA All items listed under the "Consent Agenda" are considered to be routine and require little or no deliberation by the P&Z Commission. These items will be enacted / approved by one motion unless a commissioner requests separate action on an item, in which event the item will be removed from the Consent Agenda and considered by separate action (ix. VARP 20-00003 A request of Patrick Cook, the applicant; on behalf of W. Berrios Mechanical, LLC, owner ;for approval of a Variance Permitted in Section 2.6.1.1 (b) (1) of the Unified Development Code, Ordinance No. 2000-T,from the required minimum lot size required in Section 2.4.4.2 (c) (1) a, to allow the replatting of an existing lot described to wit: Legal Description: A subdivision of a 0.2047 -acre tract of land located in the H.T.&B.R.R. General Location: 4602 Broadway P&Z Regular Meeting Minutes February 17, 2020 Page 2 of 6 Planner Hustead presented the staff report with exhibits and informed that staff recommended approval of the requested variance of 3,581 square feet from the minimum lot size of 12,500 square feet required by Section 2.4.4.2 (c) (1) a, to allow the replat of an 8,918 square foot lot permitted by Section 2.6.1.1 (b) (1), of the UDC which requires approval by the Planning and Zoning Commission. 1. The variance will allow the applicant's property to be platted. 2. The variance will allow the redevelopment of the property. No further discussion from Staff, P&Z Commission or Public input Motion passed 5-0 Chairperson Tunstall read into the record the items on Consideration and Possible Action- Replat of Lot 15 Darlinda Addition 1 PLAT 20-00009 CONSIDERATION AND POSSIBLE ACTION —REPLAT OF LOT 15 DARLINDA ADDITION 1 PLAT 20-00009 A request of Matthew Sigmon,the applicant; on behalf of Perez Ernesto and Evelyn Pineda, owners; for approval of the Replatof Lot 15 of Darlinda Addition creating 1 non- residential lot on .2047 acres of land located at 4602 Broadway, described to wit: Legal Description: A subdivision of a 0.2047 -acre tract of land located in the H.T.&B.R.R. Co. Survey, Abstract No. 232, Brazoria County, Texas, and being all of Lot 15 of the Darlinda Addition, according to the map or plat thereof recorded in volume 7, page 20 of the plat records of Brazoria County, Texas General Location:4602 Broadway Planner Hustead presented the Staff Report with exhibits and informed staff recommended approval of Replat of Lot 15 of Darlinda Addition for the following reason: 1. Except for the minimum lot area of the OP zoning district, the proposed plat conforms to the UDC requirements of a replat. CONSIDERATION AND POSSIBLE ACTION — ZONE CHANGE APPLICATION NUMBER ZONE 19-00027 P&Z Regular Meeting Minutes February 17, 2020 Page 3 of 6 A request by Duane Bingham, applicant, on behalf of Presidio Equities, LLC., owner, for amendments to the Rice Drier Commerce Park Planned Development (PD) to allow a Farm Supply Store and Outdoor Storage within the PD, on approximately 22.86 acres of land; to wit: Legal Description: Being all of Lots 1,2, 3 and a Detention Reserve of the Rice Drier Commerce Park Addition, an addition in the City of Pearland, Brazoria County as described in the Final Plat recorded in County Clerk's File No. 2019027535 in the Plat Records of Brazoria County, Texas. General Location: West of Main Street, between Halik Road and Orange Street, Pearland, Texas A discussion ensued regarding the sale of baby chicks at this location. Deputy City Attorney Provins explained the prohibited animals listed in chapter 6 in the city's code of ordinances. Chairperson Tunstall made a motion to amend to require no sales of other animals Commissioner Cade second the motion. The motion to amend passed 5-0 Motion passed 5-0 Chairperson Tunstall read into the record the items on Consideration and Possible Action- Zone Change Application Number ZONE 19-00028. Commissioner Cade made a motion to approve, Commissioner Wicker seconded the motion. CONSIDERATION AND POSSIBLE ACTION — ZONE CHANGE APPLICATION NUMBER ZONE 19-00028 A request by Jon Arledge, applicant, on behalf of V & B Cornerstone LLC, owner, for approval of a zoning change from Single-family Residential -3 (R-3) District to General Commercial (GC) District, on approximately 0.63 acres of land; to wit: Legal Description: Being a tract of land containing 0.63 acres, more or less, out of Lots 3 and 4, L.W. Murdock Subdivision, A C. H. & B Survey, Abstract No. 507, Brazoria County, Texas, according to the map thereof in Volume 29, Page 174 of the Deed Records of Brazoria County, Texas. General Location: 3429 Main Street, Pearland, Texas. CONSIDERATION AND POSSIBLE ACTION — ZONE CHANGE APPLICATION NUMBER ZONE 19-00029 A request by Alan Mueller, applicant, on behalf of DMP Acquisition Fund, LLC., owner, for approval of a zone change from Single Family Residential -4 District (R-4) to Light Industrial District (M-1), on approximately 3.08 acres of land; to wit: Legal Description: Being a 3.08 -acre tract of land situated in the George C. Smith Survey, Abstract Number 551 and being a portion of a called 8.430 -acre tract of land conveyed to DMP Acquisition Fund, LLC by the Deed recorded under the Brazoria County Clerk's File Number (B.C.C.F. No.) 2017023566 of the Official Public Records of Real Property of Brazoria County, Texas General Location: East of 4155 S. Main Street, Pearland, Texas. Commissioner Wicker had concerns with the buffers between industrial and residential uses. Motion passed 5-0 Chairperson Tunstall read into the record the items on Consideration and Possible Action- Zone Change Application Number ZONE 19-00030. Commissioner Wicker made a motion to approve, Commissioner Cade seconded the motion. CONSIDERATION AND POSSIBLE ACTION — ZONE CHANGE APPLICATION NUMBER ZONE 19-00030 A request by Jeff Boutte, Windrose Land Services, applicant, on behalf of SR Pearland II, LLC., owner, for amendments to the Center at Pearland Parkway Planned Development (PD), including zero -foot side setbacks, on approximately 52.48 acres of land; to wit: Legal Description: Being Lots A, B, C, D and Reserve A, Block 1 of the Center at Pearland Parkway Addition, an addition in the City of Pearland, Brazoria County as described in the Amending Plat recorded in County Clerk's File No. 2014046177 in the Plat Records of P&Z Regular Meeting Minutes February 17, 2020 Page 5 of 6 Brazoria County, Texas; being Lot A and Reserve A, Block 1 of the Center at Pearland Parkway Phase 11 Addition, an addition in the City of Pearland, Brazoria County as described in the Minor Plat recorded in County Clerk's File No. 2016011948 in the Plat Records of Brazoria County, Texas; and also, being Lots 1, 2, 3 and Reserve A, Block 1 of the Center at Pearland Parkway Phase 111 Addition, an addition in the City of Pearland, Brazoria County as described in the Final Plat recorded in County Clerk's File No. 2018047201 in the Plat Records of Brazoria County, Texas. General Location: 2400-2600 Block of Pearland Parkway. Commissioner Earles asked staff if they had recommended approval for the request.
