2017-10-26 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTESMINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF PEARLAND, TEXAS, MONDAY, OCTOBER 26, 2017, AT 6:00 P.M., HELD IN THE PUBLIC SAFETY BUILDING 2555 CULLEN PARKWAY SECOND FLOOR TRAINING ROOM. CALL TO ORDER P&Z Vice - Chairperson Thomas Duncan opened the meeting for the P&Z Regular Meeting at 6:00 p.m. In attendance were: P&Z Vice -Chairperson Thomas Duncan P&Z Commissioner Mary Starr P&Z Commissioner Darrell Isenberg P&Z Commissioner David Selsky Also present were Deputy City Attorney Lawrence Provins, City Planner Jimontanae McBride, Associate Planner Vince Hustead, Planner Armon Irones and Office Assistant Alma Gonzales. CONSENT AGENDA P&Z Vice - Chairperson Thomas Duncan read into the record the items on the consent agenda. P&Z Commissioner David Selsky made a motion to approve, P&Z Commissioner Mary Starr seconded the motion. The motion passes by a vote of 4-0. CONSIDERATION & POSSIBLE ACTION — APPROVAL OF MINUTES 1. Approve the P&Z Regular Meeting minutes from October 2, 2017. NEW BUSINESS P&Z Vice - Chairperson Thomas Duncan read into the record the items on the Consideration and Possible Action — Variance from Minimum Lot Depth. P&Z Commissioner David Selsky made a motion to approve, P&Z Commissioner Mary Starr seconded the motion. CONSIDERATION AND POSSIBLE ACTION -VARIANCE FROM MINIMUM LOT DEPTH A request by James Roman of Big Red Dog Engineering, applicant, on behalf of Fite Office Park, Ltd., owner; for approval of a Variance Permitted in Section 2.4.4.2 (c) (1) (c), P&Z Regular Meeting Minutes October 26, 2017 Page 1 of 3 of the Unified Development Code, Ordinance No. 2000-T, to reduce the depth from 100 to 0 feet at the northeast corner of a lot located within the Office Professional zoning district on 15.038 acres, described to wit: Legal Description: Being a tract of land containing 15.038 acres, located in the George C. Smith Survey, Abstract 547, in Brazoria County, Texas; Said 15.038 acres being out Section 18 of Kanawha -Texas Company Subdivision, a subdivision of record in Volume 2, Page 52, of the Brazoria County Plat Records (B.C.P.R.), and being all of a called 15.0375 acre tract of land recorded in the name of Fite Office Park, Ltd., in Brazoria County Clerk's File Number (B.C.C.F. No.) 2010019155. General Location: Magnolia Road, just west of the Magnolia and Manvel Road intersection Planner Armon Irones presented the staff report with exhibits. Informed the Commission that Staff recommends approval of the Final Plat of Canterbury Park Section 5 for the following reasons: 1. The Final Plat of Canterbury Park Section 5 conforms to the UDC requirements for a Final Plat. 2. The Final Plat of Canterbury Park Section 5 conforms to the approved preliminary plat. P&Z Commissioner David Selsky was in support of the request. Motion passes 4-0 DISCUSSION ITEMS 1. Commissioners Activity Report — P&Z Commissioner Derrell Isenberg had comments on foot massage establishments in the city. Mr. Derrell asked legal if there was anything the Commission could do to not allow these establishments open for business. Deputy City attorney Lawrence Provins informed that a request had been received from one Commissioner to look further into these type of establishments and at the present time the legal department was waiting for data from the police department to determine how big of an issue it is in Pearland and if this would be an enforcement issue or if recommendations for changes to the UDC would help prevent or regulate this type of businesses. Once the data has been received they will either disseminate it or if they say it's an enforcement issue that will be disseminated as well. 2.
