FAILED 02/13/06 ORDINANCE NO. 509-811 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AMENDING ORDINANCE NO. 509, THE LAND USE AND URBAN DEVELOPMENT ORDINANCE OF THE CITY OF PEARLAND, TEXAS, FOR THE PURPOSE OF CHANGING THE CLASSIFICATION OF CERTAIN REAL PROPERTY, LOCATION BEING 2.00 ACRES OF LAND, BEING LOTS 3 AND 4, BLOCK 2, OF SKYWAY MANOR, ABSTRACT 241, H.T. & B.R.R. COMPANY SURVEY, CITY OF PEARLAND, BRAZORIA COUNTY, TEXAS (GENERALLY LOCATED ON THE WEST SIDE OF PIPER ROAD, AND SOUTH OF FM 518 (BROADWAY STREET)) (ZONE CHANGE APPLICATION NO. 2006-08S) FROM CLASSIFICATION SINGLE FAMILY DWELLING DISTRICT (R-1) TO SINGLE FAMILY DWELLING DISTRICT, WITH A SPECIFIC USE PERMIT FOR A CHURCH AND CHURCH FACILITIES (R-1(S)), AT THE REQUEST OF K. A. ABRAHAM, APPLICANT FOR VO VI FRIENDSHIP ASSOCIATION, OWNER, PROVIDING FOR AN AMENDMENT OF THE LAND USE DISTRICT MAP; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE DATE AND OTHER PROVISIONS RELATED TO THE SUBJECT. WHEREAS, K. A. Abraham, applicant for Vo Vi Friendship Association, owner, filed on December 16, 2005, an application for amendment pursuant to Section 28 of Ordinance No. 509, the Land Use and Urban Development Ordinance of the City, for approval of a change in the land use as provided for in said Section 28, said property being legally described in the original applications for amendment attached hereto and made a part hereof for all purposes as Exhibit "A"; and WHEREAS, on the 16th day of January, 2006, a Joint Public Hearing was held before the Planning and Zoning Commission and the City Council of the City of Pearland, Texas, notice being given by publication in the official newspaper of the City, the affidavit of publication being attached thereto and made a part hereof for all purposes, as Exhibit "B", said call and notice being in strict conformity with provisions of Section 28.3 and 28.4 of Ordinance No. 509; and WHEREAS, on the 1st day of February, 2006, the Planning and Zoning 1 ORDINANCE NO. 509-811 Commission of the City submitted its report and recommendation to the City Council regarding the proposed amendment application by K. A. Abraham, applicant for Vo Vi Friendship Association, owner, whereby the Commission recommended denial of the Specific Use Permit for a church and church facilities in the Single Family Dwelling District (R-1 (S)); and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, the City Council considered this application and the recommendation of the Planning and Zoning Commission at a regular meeting on February 13, 2006; and WHEREAS, the City Council having fully heard the testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application of K. A. Abraham, applicant for Vo Vi Friendship Association, owner, presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: I. The following described property located within the corporate City limits of the City of Pearland, Texas, and presently classified as Single Family Dwelling District (R- 1) is hereby zoned to Single Family Dwelling District (R-1 (S)), with a Specific Use Permit for a church and church facilities, such property being more particularly described as: 2.00 acres of land, being Lots 3 and 4, Block 2, of Skyway Manor, Abstract 241, H.T. & B.R.R. Company Survey, City of Pearland, Brazoria County, Texas (Generally Located on the West Side of Piper Road, and South of FM 518 (Broadway Street)) 2 ORDINANCE NO. 509-811 II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission and to the City Council for consideration and decision. III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. V. All rights and remedies, which have accrued in the favor of the City under this Ordinance and its amendments thereto, shall be and are preserved for the benefit of the City. VI. The City Secretary is hereby directed to cause to be prepared an amendment to the official Land Use District Map of the City, pursuant to the provisions of Section 2 of 3 ORDINANCE NO. 509-811 Ordinance No. 509 and consistent with the approval herein granted for the reclassification of the herein above described property. Abraham, applicant for Vo Vi Friendship Association, owner, for an amendment to the Land Use and Urban Development Ordinance of said City, for approval of a Specific Use Permit for a church and church facilities, in the Single Family Dwelling District (R-1(S)) LEGAL 2.00 acres of land, being Lots 3 and 4, Block 2, of Skyway DESCRIPTION: Manor, Abstract 241, H.T. & B.R.R. Company Survey, City of Pearland, Brazoria County, Texas GENERAL LOCATION: Generally Located on the West Side of Piper Road, and South of FM 518 (Broadway Street) APPROVAL PROCESS: After this Joint Public Hearing, the requested zone change application will be considered as follows: Planning and Zoning Commission: January 16, 2006* City Council for First Reading: February 13, 2006* City Council for Second Reading: February 27, 2006* (*dates subject to change if item is tabled) SUMMARY: The applicant is requesting approval of a Specific Use Permit for a church and related church facilities. The subject property is currently zoned as Single Family Dwelling District (R-1). The subject property is currently developed with a building that does not appear to be a single family residence. The applicant has indicated that they plan to utilize the existing building for a church on the subject property. JPH 01-16-06 2006-08S Page 1 SURROUNDING ZONING AND LAND USES: North South East Zoning Single Family Dwelling District (R-1) Suburban Development District (SD) Single Family Dwelling District (R-1) and Suburban Development District (SD) West General Business District (GB) Land Use Single family residence Single family residence Single family residence Commercial businesses CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The subject property is currently zoned as R-1. The minimum lot size for the R-1 district is 8,800 square feet and the minimum lot width is 80 feet. The subject property currently consists of 2 lots, which together meets these minimum lot size and lot width requirements. The applicant will be required to comply with all other requirements of the Land Use and Urban Development Ordinance. PLATTING STATUS: The subject property consists of 2 lots. It appears that these two lots were originally platted as part of Skyway Manor subdivision. However, a plat may need to be submitted and approved, combining both lots into one lot, prior to the issuance of a building permit. CONFORMANCE TO THE COMPREHENSIVE PLAN: The Comprehensive Plan (2004 update adopted on July 26, 2004) recommends "Low Density Residential" for the subject property and for many of the surrounding properties on Piper Road. The Comprehensive Plan further indicates that the appropriate zoning districts for "Low Density Residential" are the Estate Lot Single Family Dwelling District (R-E) and the Single Family Dwelling District R-1. Therefore, the proposed Specific Use Permit does not conflict with the Comprehensive Plan. CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage on Piper Road, local/residential street. The Thoroughfare Plan does not specify any JPH 01-16-06 2006-08S Page 2 improvements to Piper Road. No other roadways affect the subject property. AVAILABILITY OF UTILITIES: There is currently a 12 inch water line on the west side of Piper Road. There is a 12 inch gravity main sanitary sewer line within Piper Road. Availability and adequacy of utilities will be reviewed during the review of any subdivision plat or building permit applications submitted for the subject property. IMPACT ON EXISTING AND FUTURE DEVELOPMENT: The subject property is currently zoned as R-1. A church is permitted by approval of a Specific Use Permit in any of the residential zoning districts. A church is permitted by right in the other non-residential zoning districts, such as OP, NS, GB, and C. The applicant chose to keep the residential zoning district rather than change to a non-residential zoning district due to the adjacent land uses within the subject area, due to the low density residential recommendation in the Comprehensive Plan, and to be more compatible with the existing and future land uses within the area. If the church project does not occur for whatever reason, the subject property would have an underlying zoning district of R-1 and could be developed with single family residences. If the zone change and specific use permit are approved, the applicant may be responsible for the submittal of a traffic impact analysis (TIA) in order to determine the impact of the proposed development on adjacent roadways and adjacent properties, as well as the locations of driveways. The applicant has not submitted a site plan for informational purposes. Staff requested that the applicant submit a site plan, so that we could have a general idea about the layout of the proposed church, parking areas, etc. The existing building on the subject property does not appear to be a single family residence, but rather a large building. The applicant has indicated that they intend to utilize the existing building for the church. The applicant has also indicated that, in the future, they may wish to add additional buildings to the subject property. The applicant should also be aware that the Building Code/Fire Code may require updates to the existing building. Specific Use Permit Considerations: The proposed Specific Use Permit is a discretionary item for review by the Planning and Zoning Commission and City Council, and additional safeguards and conditions can be JPH 01-16-06 2006-08S Page 3 placed on the approval of the Specific Use Permit. With the subject property being zoned for R-1 zoning, several ordinances would not apply to residential properties. A church is not a residential use, but is not considered a commercial use and would not be subject to certain ordinances under the R-1 district regulations. Because of this, Staff recommends that the following items be taken into consideration: 1. Dumpster screening. Tracts zoned R-1 typically do not have dumpsters located upon them. Landscaping. The Landscape Ordinance does not apply to R-1 zoned properties. Screening (fence) between uses. The subject property is directly adjacent on the north side to a tract of land zoned R-1, and the property to the south, although zoned Suburban Development District (SD), is developed with a single family residence. If the Commission and Council believe that a screening fence is necessary, the type, height, and location of the fence would have to be specified in the motion. Staff is of the opinion that a screening fence is not necessary, and would provide obstacles to linkages between the residential properties within the area.
