R2021-218 2021-09-20 RESOLUTION NO. R2021-218 A Resolution of the City Council of the City of Pearland, Texas, temporarily waiving certain building permits and fees associated with the repair of homes and businesses damaged by Hurricane Nicholas. WHEREAS, winds and rains associated with Hurricane Nicholas severely damaged residential and businesses properties in the City; and WHEREAS, it is in the City's best interests to assist affected residents and business owners who are required to repair and renovate structures damaged by Hurricane Harvey; and WHEREAS, temporarily suspending the permit review and inspections process for minor residential fence and roof repairs, while focusing the building permit.review and inspections process on larger concerns will ensure compliance with building codes and life safety that are in the best long-term interests of residents, business owners and the City; and WHEREAS, normal building permit fees related to damage caused by Hurricane Nicholas would add financial costs to affected property owners, and the City is willing to absorb the expense of staff time and expertise to provide this service; and BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That certain building permit fees associated with the repairs of homes and businesses damaged as a result of Hurricane Nicholas are temporarily suspended for 28 days beginning Tuesday, September 14, 2021 through Tuesday, October 12, 2021. Section 2. Eligibility for the building permit fee waiver shall be contingent on the following conditions: a) Filing of a complete building permit application by the property owner or a licensed contractor in accordance with the City's unified development Code; and b) Issuance of the building permit by the City; and c) No expansion shall be made to, or any change in use or occupancy of any building on the applicants property; and d) Acknowledgement that any repairs to non-conforming structures will not change their non-conforming status. e) Building permits for residential property owners shall be waived for the following specific permit types: a. Fences. When it is determined the damage suffered is less than fifty percent (50%) of the total fence area, and the fence is to be replaced with the same material, and in the same location, and b. Roofing. When the roofing material is composition shingle, and when the damage suffered is less than twenty-five percent (25%) of the total area of , the roof.
