subject.
WHEREAS, Nita Christian, applicant, on behalf of R. West Development Co.,
Inc., owner, for approval of a zone change from the Single-family Residential-2 (R-2)
District to the Office Professional (OP) District, on approximately 0.72 acres of land on
the following described property; said property being legally described in the legal
description attached hereto and made a part hereof for all purposes as Exhibit "A," and
more graphically depicted in the vicinity map attached hereto and made a part hereof for
all purposes as Exhibit "B"; and
WHEREAS, on the 21st of June, 2021, a public hearing was held before the
Planning and Zoning Commission of the City of Pearland, Texas, notice being given by
online publication on the City website, a copy of which being attached hereto and made
a part hereof for all purposes as Exhibit "C," said call and notice being in strict
conformity with provisions of Section 1.2.2.2 of Ordinance No. 2000T; and
WHEREAS, the Planning and Zoning commission having fully heard the
testimony and argument of all interested parties, and having been fully advertised in the
premises, submitted its report and recommendation to the City Council regarding the
proposed change in zoning classification from the Single-Family Residential-2 (R-2)
district to the Office Professional (OP) district, said recommendation attached hereto
and made a part hereof for all purposes as Exhibit "D"; and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, City Council considered this application and the recommendation of the
Planning and Zoning Commission at their regular meeting on the 21st day of June 2021;
and
WHEREAS, on the 22nd of June, 2021, the City Council having fully heard the
testimony and argument of all interested parties, and having been fully advised in the
premises, finds that in the case of the application for approval for the change in zoning
classification from the Single-Family Residential-2 (R-2) district to the Office
Professional (OP) district; presented which, in the judgment of the City Council, would
justify the approval of said application; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section I. The following described property located within the corporate City
Limits of the City of Pearland, Texas, and presently being located within the
Stonebridge Planned Development District, is hereby granted approval for change in
zoning classification from the Single-Family Residential-2 (R-2) district to the Office
Professional (OP) district, in accordance with all conditions and requirements of the
current Unified Development Code and the amendments approved by the City Council;

General Location: Southeast Corner of English Lakes Drive and Village Drive,
Pearland, TX.
Section II. The City Council of the City of Pearland finds and determines that the
recitations in the preamble hereof are true and that all necessary prerequisites of law
have been accomplished and that no valid protest of the proposed change has been
made. The City Council further finds and determines that there has been compliance
with the mandates of law in the posting and presentation of this matter to the Planning
and Zoning Commission for consideration and decision.
Section III. The City Council of the City of Pearland finds and determines that
the amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
Section IV. If any section, subsection, sentence, clause, phrase, or portion of
this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct, and
independent provision and such holding shall not affect the validity of the remaining
portions thereof.
Section V. All rights and remedies, which have accrued in the favor of the City
under this Ordinance and its amendments thereto, shall be and are preserved for the
benefit of the City.

Section VI. This Ordinance shall become effective after its passage and
approval on second and final reading.

At their regular meeting on June 21, 2021, the Planning and Zoning Commission
considered the following:
Request: A request by Nita Christian, applicant, on behalf of R. West
Development Co., Inc., owner, for approval of a zone change from the Single-
family Residential-2 (R-2) District to the General Commercial (GC) District, on
approximately 0.72 acres of land.
General Location: Southeast Corner of English Lakes Drive and Village Drive,
Pearland, TX.
The Commission conducted a public hearing for the proposed zone change request.
The applicant was available and discussed the history and potential development of the
property for office use. There were two public comments from residents in the
neighborhood who discussed being opposed to the request, traffic, additional uses, and
lowering of property values. The P&Z discussed the assigning a less intense zoning
classification of Office Professional (OP). The applicant stated that they would be ok
with the less intense category and staff stated that the OP would be the preferred
district if approval was sought. After discussion, the P&Z voted to approve a
recommendation for OP instead of GC by a vote of 6-0. Should the City Council choose
to vote on a more intense district then a super-majority vote will be required.

Excerpts from the Minutes of the Planning & Zoning Commission June 21 Meeting:
ZONE 21-00008 (R-2 to GC)
Applicants, Nita Christian, and Renee McGuire on behalf of R.West Development Co., Inc. were
in attendance in City Council Chambers to present to the P&Z Commission. Ms. McGuire stated
that she was fine with the parcel being zoned to a lesser zoning. Ms. Christian stated the
purpose of this rezoning is to combine with another tract.
Chairperson Cade called for public input.
Resident, Marion Boister of 3015 Eagle Lake Drive, Pearland, Texas 77581 stated that she is
opposed to this rezoning. Ms. Boister said that her family purchased a house in Townlake
Estates in 2007 because of the surrounding zoning and believes that this change would be
inconsistent with the area. Ms. Boister said that she thinks this would make property values go
down and that the development may cause drainage issues for their neighborhood. Ms. Boister
is concerned about R.West Development Co., Inc.
Resident, Natalie Gassen of 3013 Eagle Lake Drive, Pearland, Texas 77581 echoed Ms.
Boisters thoughts. Ms. Gassen stated that she also purchased a home in Townlake Estates due

to the surrounding zoning.
Ms. McGuire stated that they were studying the drainage and traffic. She said that they
completed the TIA and there is no additional traffic impact. Ms. McGuire said that there is an
existing drainage plan that had already been approved by the city.
Vice Chairperson Fuertes stated that GC zoning would be intense near the neighborhood and
that he would prefer OP zoning there.
Commissioner Dansby agreed and said that OP zoning would be best to restrict this unique
piece of property.
Commissioner Henrichs agreed with Vice Chairperson Fuertes and Commissioner Dansby and
that it should not keep its current zoning.
Chairperson Cade agreed with the other commissioners.
No further discussion from Staff, P&Z Commission or Public input.
Chairperson Cade read into the record the items on Consideration and Possible Action —Zone
Change Application: ZONE 21-00008. Commissioner Dansby made a motion to recommend
approval to City Council, Commissioner Henrichs seconded the motion.
Vice Chairperson Fuertes made an amendment to the motion to recommend zone change from
R-2 to OP to City Council, Commissioner Henrichs seconded the amended motion.
Motion passed 6-0.

RESPONSIVE RESULTS-ORIENTED TRUST-BUILDERS ACCOUNTABLE
This is a request for approval of a zone change from Single Family Residential-2 (R-2) District to General
Commercial to accommodate an office development. The zoning for the 0.72-acre parcel is split between the
General Commercial (GC) District and the Single Family Residential -2 (R-2) District. The property is sandwiched
between single family residential and general commercial (GC) zoned properties.
The criteria for approval of a requested zoning change, per Section 2.2.1.4 of the Unified Development Code is
as follows:
1. Whether the proposed zoning map amendment implements the policies of the adopted Comprehensive
Plan, including the land use classification of the property on the Future Land Use Map and any
incorporated sector plan maps; (Does not conform to criteria)
2. Whether the uses permitted by the proposed change in zoning district classification and the standards
applicable to such uses will be appropriate in the immediate area of the landto be reclassified;(Does not
conform to Criteria)
3. Whether the proposed change is in accord with any existing or proposed plans for providing public
schools, streets, water supply, sanitary sewers, and other public services and utilities to the area;
(Conforms with Criteria) and
4. Any other factors which will substantially affect the public health, safety, morals, or general welfare.
SITE HISTORY
The subject property was annexed into the City in 1983. According to the City's GIS records the subject property
appears to have been split up from a larger property along Main Street when the access road to the adjacent
Villages of Towne Lake planned development was developed in 2008.The subject property has since been
separated from similarly zoned property along Main Street.
STAFF RECOMMENDATION
Staff has evaluated the request zone change request based on the criteria above and recommends denial of
the proposed zone change for the following reasons:
• Proposed zoning is not supported by the underlying future land use designation of Medium Density
Residential which is intended for light industrial, manufacturing, wholesale and service type uses,
including manufacturing, assembly, and high-tech industries.
• The proposed GC zoning permits a wide range of uses, some of which may be incompatible with the
adjacent single-family zoning
• There are other transitional districts that will support the applicant's proposed office use without allowing
uses that may be incompatible with the adjacent single-family zoning.
The proposed GC zoning does not reflect the city's vision for the district and is not compatible with the adjacent
R-2 District. Staff however believes a zone change to a less intense transitional zoning district will be more
appropriate. Staff recommends a zone change to a transitional zoning district such as Neighborhood Service
(NS) or Office and Professional (OP), which permit less intense commercial uses that are more compatible with
single family residential zoning.

The subject property is designated on the 2015 Future Land Use Plan as "Medium Density Residential". The
intent of the Medium Density Residential District is to permit Single-family detached dwellings including patio
homes, plus townhomes with appropriate open space. The relevant land use policies in the comprehensive plan
include:
1. Land uses should not detract from the enjoyment or value of neighboring properties.
2. Potential negative land use effects (noise, odor, dust, excessive light, traffic, etc.) should be considered
in development review/approval and mitigated.
3. Residential and commercial areas may be adjacent if separated by a buffer

CONFORMANCE WITH THE UNIFIED DEVELOPMENT CODE (UDC)
The subject property abuts single family residential development. If the zone change request is approved there
will be a landscape buffer required between any commercial development and the existing Single-Family
Residential. The subject property is not platted and will be required to be platted prior to the issuance of building
permit.
CONFORMANCE WITH THE THOROUGHFARE PLAN
The subject property is located along two local street and will not impact the thoroughfare plan.
UTILITIES AND INFRASTRUCTURE
The City records show that utilities are available to the subject property for sewer and water connections along
Village Drive and English Lake Drive.
DRAINAGE
Drainage will analyzed and provided for during the building permit process.
PARKS, OPEN SPACE, AND TREES
Parks are not applicable for a commercial development. Open space and trees will be provided for in
conformance with the UDC.

The subject property is surrounded by a mix of single-family residential zoning and general commercial zoning.
Some of the uses permitted in the General Commercial District may be incompatible with the uses in the single-
family residential district. A transitional less intense commercial district will allow the property to be developed
for commercial uses and yet ensure that those commercial uses are compatible with single family residential.
Additionally, the required buffering between commercial development adjacent to single family residential zoning
will ensure further compatibility.
PUBLIC NOTIFICATION
A notice of the public hearing was published in the Pearland News Reporter. In addition, staff sent notices of the
public hearing with a vicinity map to the applicant, the owner of the property, and to property owners within 200
feet of the subject property under consideration for the zone change. A zoning change sign was posted on the
subject property by the applicant.
OPPOSITION TO OR SUPPORT OF PROPOSED REQUEST
Staff has not received any public comments in support or opposition of the proposed zone change request at the
time of this report.
ADDITONAL COMMENTS
The request was reviewed by the City's Development Review Committee and no comments were received.

We are in the process of having plans drawn for our new offices to be located on
the property at the SE corner of English Lakes Drive and Village Drive, which will
be in a portion of the land zoned GC. However, a small portion of our parking lot
will extend over into an area of our property that is zoned R-2. We are requesting
that the 0.72-acre triangular area be re-zoned from R-2 to GC to accommodate
this area of our parking lot, and possibly some time later a one -story office
building in addition to the one that will be our office building.

Sign Acknowledgement Form
This form is required to be signed by the property owner and applicant.
Any person, firm or corporation requesting a zoning change, a conditional use permit (CUP), or
a variance/special exception shall be required to erect and maintain a sign(s), to be inspected
by the City, upon the property for which a variance or zoning change has been requested.
Such sign(s) shall be located as follows:
1. One (1) sign per street frontage shall be located within thirty (30) feet of the abutting street, or
as determined by the City.
2. So as to be clearly visible and readable from the public right-of-way and not obstructed in any
manner.
3. So as not to create a hazard to traffic on the public rights-of-way abutting the property.
4. On the subject property at least ten (10) days prior to the hearing of the Zoning Board of
Adjustment for variance/special exceptions and of Planning and Zoning Commission for zone

• Upon making an application for a zoning change, a conditional use permit (CUP), or a
variance/special exception, the applicant shall place sign(s) as required. The City shall
inspect such sign(s)to ensure compliance as required by the UDC.
• After the zoning change, a conditional use permit(CUP), or a variance request is
approved by the City Council, denied by the City Council, or withdrawn by the applicant,
the applicant shall remove the sign from the area of the request within ten (10) days of
such event.
• tt shall be unlawful for anyone to remove, destroy, deface or obstruct the view of a sign
which gives notice that a zoning change, a conditional use permit (CUP), or a
variance/special exception has been requested.
• In the event the applicant fails to erect and/or maintain signs in accordance with this
section, the public hearing before the Planning and Zoning Commission/City
Council/Zoning Board of Adjustment shall be postponed to a date in the future, which
would allow time for compliance.
• The erection of any sign required by this section shall not require a permit under Section
4.1.2.6 of this UDC.
• The owner or applicant shall promptly notify the Planning Department of any sign
required by this section, which becomes lost, stolen or vandalized. The Planning and
Zoning Commission or Zoning Board of Adjustment, depending on the type of case, shall
have the power to decide whether or not there has been substantial compliance with the
posting requirements in the case of lost, stolen or vandalized signs.
