WHEREAS, Paul Grohman, applicant, on behalf of Musgrave-Grohman Ventures LTD, owner, for approval of an amendment to the Stonebridge Planned Development (PD) District, to accommodate a proposed residential development consisting of 57 single-family residential lots, on approximately 32.667 acres of land on the following described property; said property being legally described in the legal description attached hereto and made a part hereof for all purposes as Exhibit "A," and more graphically depicted in the vicinity map attached hereto and made a part hereof for all purposes as Exhibit"B"; and • WHEREAS, on the 21st of June, 2021, a public hearing was held before the Planning and Zoning Commission of the City of Pearland, Texas, notice being given by online publication on the City website, a copy of which being attached hereto and made r a part hereof for all purposes as Exhibit "C," said call and notice being in strict conformity with provisions of Section 1.2.2.2 of Ordinance No. 2000T; and WHEREAS, the Planning and Zoning commission having fully heard the • testimony and argument of all interested parties, and having been fully advertised in the premises, submitted its (report and recommendation to the City Council regarding the proposed amendment to the Stonebridge Planned Development (PD) District, to accommodate a proposed residential development consisting of 57 single-family residential lots, said recommendation attached hereto and made a part hereof for all purposes as Exhibit "D"; and WHEREAS, upon receipt of the report from the Planning and Zoning Commission, City Council considered this application and the recommendation of the Planning and Zoning Commission at their regular meeting on the 21st day of June 2021; and WHEREAS, on the 22nd of June, 2021, the City Council having fully heard the . testimony and argument of all interested parties, and having been fully advised in the premises, finds that in the case of the application for approval for an amendment to the Stonebridge Planned Development (PD) District, to accommodate a proposed residential development consisting of 57 single-family residential lots; presented which, in the judgment of the City Council, would justify the approval of said application; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section I. The following described property located within the corporate City Limits of the City of Pearland, Texas, and presently being located within the Stonebridge Planned Development District, is hereby granted approval for amendment, to accommodate a proposed residential development consisting of 57 single-family Page 2 of 10 Ord. No. 2000M-212 residential lots, in accordance with all conditions and requirements of the current Unified Development Code and the amendments approved by the City Council and incorporated for all purposes as Exhibit "E"; and, such property being more particularly described as: • Legal Description: Being 32.667 acres of land located in the Derril H.M. Hunter Survey, Abstract No. 76, Brazoria County, Texas, being a portion of certain called 39.50-acre tract conveyed to Musgrave-Grohman Ventures, Ltd., by instrument of record under Document No. 2004027202, Official Records of Brazoria County, Texas. • General Location: Eastern Side of Stable Stone Lane, Pearland, TX. Section II. The City Council of the City of Pearland finds and determines that the recitations in the preamble hereof are true and that all necessary prerequisites of law have been accomplished and that no valid protest of the proposed change has been made. The City Council further finds and determines.that there has been compliance with the mandates of law in the posting and presentation of this matter to the Planning and Zoning Commission for consideration and decision. • Section III. The City Council of the City of Pearland finds and determines that the amendment adopted herein promotes the health, safety, and general welfare of the public and is a proper valid exercise of the City's police powers. Section IV. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be. deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Description of the Subject Property The portion of this Planned Development that is being amended consists of 32.667 acres (Property) at the eastern end of Stable Stone Lane. The Property is located behind the Centre at Pearland Parkway retail center and adjacent to a section of the Lakes at Highland Glen. The land is vacant, partially wooded, and contains an existing detention pond for the Stonebridge subdivision. A significant portion of the Property is encumbered by Clear Creek floodplain and floodway. Two fault zones traverse the Property which place an additional constraint on utilization. 2. Description of Proposed Development The proposed development consists of 57 single family residential lots consistent with the quality and character of the adjacent subdivision. Beazer Homes, the developer/builder of Highland, will develop and be the homebuilder for the Property. The amenity level and home quality for this Property will be commensurate with the high standards constructed in previous sections of Highland Glen. 3. Description of the Area The Property consists of 32.667 acres as shown in Exhibit A. 4. Purpose Statement This PD amendment will allow development of a quality single family residential community. Several non-residential uses for this portion of the PD have been attempted subsequent to the original approval in 2004 without success. The goal of the development is to create a single- family residential enclave that will harmoniously blend with adjacent development. 5. Comprehensive Plan The Future Land Use Plan depicts the Property as residential. The proposed use is consistent with the Comprehensive Plan and will provided much-needed single family residential housing in a desirable area. 6. Applicability The Property is already within the boundaries of a Planned Unit Development. B. Zoning and Land Use 1. Existing Zoning The Property is currently zoned PUD. 2. Development Standards Development on the Property will follow R-4 regulations. Typical lots will be 55’ x 125’, however, lot width and area shall be governed by standard R-4 regulations. Density calculations are according to the following definitions from the UDC: Density, Net Residential: The number of dwelling units per net acre. Net density calculations are made using net acreage, exclusive of thoroughfare rights-of-way and retentions/detention areas, and public or private streets that are platted or are to be platted as part of the development of the property, but inclusive of open space, recreational areas, or parks. Density, Gross Residential: The number of dwelling units per gross acre used for residential use. All density calculations shall be made using gross acreage dedicated for residential use, exclusive of easement and thoroughfare rights-of-way, and inclusive of retention/detention areas, public or private streets that are platted or will be platted as part of the development of the property, open space, recreational areas, and parks provided within the development. Permitted, Conditional, and Accessory Uses Development within the Property will be regulated based on the R-4 zoning district standards, except as noted herein. C. Design Standards 1. Signage, Landscaping, Fencing Signage: Entry monumentation will be provided at the entrance to the Property on Stable Stone Lane. The style and scale will be consistent with the character image shown on Exhibit D. Monumentation will conform to UDC criteria. Landscaping: Street trees and landscaping will be provided in the areas shown on Exhibit D, however, exact locations and species are subject to final design. The minimum quantities for street trees, ornamental trees, shrubs, and grasses are shown in the landscape table on Exhibit D. Landscaping requirements for the single-family lots per the Unified Development Code are applicable to this development. A detailed tree mitigation plan will be prepared after a current tree survey is completed prior to application for a clearing permit. Satisfaction of tree mitigation requirements may be satisfied by tree planting in the detention pond area, other open spaces, or as otherwise allowed by the UDC. Fencing: Context-sensitive fencing is critical to the overall design plan for the community. A masonry wall will buffer the western edge of the Property from the existing retail center. A majority of the lots will back up to the amenitized detention ponds or open space – each of these lots will have open metal fencing along the rear property line to enhance the open space look and feel of the community. Fence locations are shown on Exhibit D. 2. Design Plan The proposed street plan, lot, and detention pond layout is shown on Exhibit C. The final configuration may shift slightly during platting, but the overall street pattern and layout are not expected to deviate substantially from this plan. The other items will be placed throughout the open spaces and neighborhood park. A 4’ sidewalk shall be required on both sides of the streets per the UDC. 3. The north line is constrained be an existing subdivision with no street stub outs provided. The east line is bounded by Clear Creek while the south line is encumbered with an existing drainage channel. The only access point is via the existing Stable Stone Lane on the west line of the Property. A second point of access for emergency use is provided via an access easement dedicated across the retail center in front of the property. This easement will be extended to provide paved access along the west side of the front detention pond with an additional emergency access connecting the internal streets as shown on Exhibit C. The final emergency access arrangement shall be approved by the Fire Marshall. 4. Unified Development Code Compliance The property will conform to the requirements of the Unified Development Code unless specifically called out in this PD. D. Required Dedications of Public Land or Public Improvements The detention pond will be deeded to Brazoria County MUD #28 with maintenance by a HOA to be created. The existing detention pond on the property will be cleaned up and graded. Required right-of-way for Clear Creek will be dedicated to Brazoria Drainage District #4. E. He stated that originally, they had planned to have a hospital organization developed in this PD that did not happen. Mr. Grohman stated that now they like to sell this land and have Beazer Homes develop a neighborhood. Mr. Grohman stated that the biggest challenge in this development will be access. Shannon Wesipoppy with Beazer Homes described the type of development this would be. Ms. Wesipoppy stated that the homes would be like homes located in the Enclave at Highland Glen. Chairperson Cade called for public input. There were no persons wishing to speak for or against the proposed request. City Council Regular Meeting - Jul 26 2021 Page 202 of 926 RESPONSIVE RESULTS-ORIENTED TRUST-BUILDERS ACCOUNTABLE The subject 32.667-acre land is part of the larger 123.34-acre tract of land upon which the Stonebridge Planned Development was established in 2004 and subsequently developed into a master-planned residential development with a small commercial development along the frontage of Pearland Parkway. The 32.667-acre property subject to the request was rezoned in 2012 to accommodate the mixed use medical and specialty care campus. In 2020, 3.17 acres of the subject site was rezoned to accommodate a pet store and care facility located on the west portion of the subject property. However, none of these projects moved forward and the subject site has remained undeveloped to this date. The applicant seeks to amend the PD for the 34.42 acres to accommodate a proposed residential development consisting of 57 single-family lots in conjunction with amenitized detention ponds and open space. Beazer Homes will develop and be the homebuilder for the Property. The subject property currently has access to Pearland Parkway through Stable Stone Lane, which is a 60’ wide public street that stubs at the western end of this property. The Unified Development Code has established seven (7) criteria for evaluation and approval of a PD or a PD amendment, which are listed below: 1. The extent to which the land covered by the proposed PD district fits one or more of the special circumstances in Section 2.2.2.1(b) warranting a PD district classification. Conforms to criteria. 2. The extent to which the proposed PD district furthers the policies of the City’s adopted Comprehensive Plan (as amended) and other formally adopted City planning documents, such as the Parks Plan. Does not conform to criteria. 3. The extent to which the proposed PD district will result in a superior development than could not be achieved through conventional zoning classifications. Conforms to criteria. 4. The extent to which the proposed PD district will resolve or mitigate any compatibility issues with surrounding development. Conforms to criteria. 5. The extent to which proposed uses and the configuration of uses depicted in the Design Plan are compatible with existing and planned adjoining uses. Conforms to criteria. 6. The extent to which the proposed development is consistent with adopted public facilities plans, including those related to water, wastewater, transportation, drainage and other public facilities. The extent to which the proposed open space and recreational amenities within the development provide a superior living environment and enhanced recreational opportunities for residents of the district and for the public generally. Conforms to criteria. SITE HISTORY The subject property is currently vacant. The site was subject to the following rezoning efforts in the past: 1. The site was rezoned as part of the Stonebridge PD in 2004 with the adoption of Ordinance No. 509-704. 2. The PD was amended in 2012 to reflect a change to the Design Plan for 34.42 acres of land located on the east side of Pearland Parkway from Residential to GB uses to accommodate a mixed use medical and specialty care campus. 3. The PD was amended in 2016, which was part of a citywide effort to require CUP approval for certain land uses within the existing PDs. Page 2 of 48Page 29 of 75 Consent Agenda Item #B. City Council Regular Meeting - Jul 26 2021 Page 203 of 926 RESPONSIVE RESULTS-ORIENTED TRUST-BUILDERS ACCOUNTABLE 4. 3.17 acres of the subject site was rezoned in 2020 to accommodate a pet store and care facility located on the west portion of the subject property. STAFF RECOMMENDATION As stated previously, the subject has remained undeveloped for years despite several attempts for development. The site appears to have some challenges to being developed, including lack of visibility and accessibility, the location of major portions of the property within the floodway and 100-year floodplain. Residential uses appear to be compatible with the surrounding residential development and takes advantage of the natural properties of the site. Although the Future Land Use Plan designates the subject site for Low Density Residential designed to accommodate the R-E through R-1 zoning designations; however, considering the natural properties and challenges of the site, the proposed R-4 zoning designation seems to be conducive and complimentary to the overall theme of the PD on the west side of Pearland Parkway. The proposed amendment is generally consistent with the other criteria of approval, except the Future Land Use Plan designation. Staff recommends approval of the proposed PD amendment with the underlying zoning of R- 4, subject to the regulations and conditions contained within the attached PD Amendment No. 4 document. The proposed site plan does not include additional access points for secondary access for fire and emergency services. The adopted fire code requires additional safety measures when more than 30 homes are being constructed. There are currently two proposals being discussed with the applicant; amend the design plan to provide secondary access from a surrounding property or provide residential fire sprinkler systems in each of the homes. Should the applicant decide to provide an amendment to the design plan then staff recommends that the item be tabled or brought back to the P&Z so that the public can be notified and review the proposal. CONFORMANCE WITH THE COMPREHENSIVE PLAN The subject property is designated on the 2015 Future Land Use Plan as “Low Density Residential”, which is intended to accommodate the Single-family detached dwellings of Residential Estate (RE) and R-1 zoning districts. Although the proposed zoning classification of R-4 is inconsistent with Low Density Residential classification; however, challenges of the site including lack of access and visibility and location of large portions of the property within the floodway will balance the density of the R-4 with the rest of the site. The Comprehensive Plan has established the following general land use policies for consideration by City officials when making decisions regarding proposed development activity and changes in zoning classifications within the city: 1. Land uses should not detract from the enjoyment or value of neighboring properties. 2. Potential negative land use effects (noise, odor, dust, excessive light, traffic, etc.) should be considered in development review/ approval and mitigated. 3. Adequate transportation access and circulation should be provided for uses that generate large numbers of trips. Pedestrian and bicycle access should be addressed where appropriate. 4. CONFORMANCE WITH THE THOROUGHFARE PLAN The City’s Thoroughfare Plan designates Broadway Street as a Major thoroughfare with sufficient width, which currently has a minimum right-of-way of 120 feet. The internal circulation of the site consists of proposed 50-foot dedicated public residential streets. UTILITIES AND INFRASTRUCTURE City utilities, including water sanitary sewer will be extended by the developer to serve the future residential development. In addition, staff sent a notice of the public hearing with a vicinity map to the applicant, the owner of the property, and to property owners within 200 feet of the subject property under consideration for the zone change, and a zoning change sign was posted on the subject property by the applicant. Description of the Subject Property The portion of this Planned Development that is being amended consists of 32.667 acres (Property) at the eastern end of Stable Stone Lane. The Property is located behind the Centre at Pearland Parkway retail center and adjacent to a section of the Lakes at Highland Glen. The land is vacant, partially wooded, and contains an existing detention pond for the Stonebridge subdivision. A significant portion of the Property is encumbered by Clear Creek floodplain and floodway. Two fault zones traverse the Property which place an additional constraint on utilization. 2. Description of Proposed Development The proposed development consists of 57 single family residential lots consistent with the quality and character of the adjacent subdivision. Beazer Homes, the developer/builder of Highland, will develop and be the homebuilder for the Property. The amenity level and home quality for this Property will be commensurate with the high standards constructed in previous sections of Highland Glen. 3. Description of the Area The Property consists of 32.667 acres as shown in Exhibit A. 4. Purpose Statement This PD amendment will allow development of a quality single family residential community. Several non-residential uses for this portion of the PD have been attempted subsequent to the original approval in 2004 without success. The goal of the development is to create a single- family residential enclave that will harmoniously blend with adjacent development. 5. Comprehensive Plan The Future Land Use Plan depicts the Property as residential. The proposed use is consistent with the Comprehensive Plan and will provided much-needed single family residential housing in a desirable area. 6. Applicability The Property is already within the boundaries of a Planned Unit Development. B. Zoning and Land Use 1. Existing Zoning The Property is currently zoned PUD. 2. Density, Gross Residential: The number of dwelling units per gross acre used for residential use. All density calculations shall be made using gross acreage dedicated for residential use, exclusive of easement and thoroughfare rights-of-way, and inclusive of retention/detention areas, public or private streets that are platted or will be platted as part of the development of the property, open space, recreational areas, and parks provided within the development. Permitted, Conditional, and Accessory Uses Development within the Property will be regulated based on the R-4 zoning district standards, except as noted herein. C. Design Standards 1. Signage, Landscaping, Fencing Signage: Entry monumentation will be provided at the entrance to the Property on Stable Stone Lane. The style and scale will be consistent with the character image shown on Exhibit D. Monumentation will conform to UDC criteria. Landscaping: Street trees and landscaping will be provided in the areas shown on Exhibit D, however, exact locations and species are subject to final design. The minimum quantities for street trees, ornamental trees, shrubs, and grasses are shown in the landscape table on Exhibit D. Landscaping requirements for the single-family lots per the Unified Development Code are applicable to this development. A detailed tree mitigation plan will be prepared after a current tree survey is completed prior to application for a clearing permit. Satisfaction of tree mitigation requirements may be satisfied by tree planting in the detention pond area, other open spaces, or as otherwise allowed by the UDC. Fencing: Context-sensitive fencing is critical to the overall design plan for the community. A masonry wall will buffer the western edge of the Property from the existing retail center. A majority of the lots will back up to the amenitized detention ponds or open space – each of these lots will have open metal fencing along the rear property line to enhance the open space look and feel of the community. Fence locations are shown on Exhibit D. 2. Design Plan The proposed street plan, lot, and detention pond layout is shown on Exhibit C. The final configuration may shift slightly during platting, but the overall street pattern and layout are not expected to deviate substantially from this plan. The other items will be placed throughout the open spaces and neighborhood park. A 4’ sidewalk shall be required on both sides of the streets per the UDC. 3. The north line is constrained be an existing subdivision with no street stub outs provided. The east line is bounded by Clear Creek while the south line is encumbered with an existing drainage channel. The only access point is via the existing Stable Stone Lane on the west line of the Property. A second point of access for emergency use is provided via an access easement dedicated across the retail center in front of the property. This easement will be extended to provide paved access along the west side of the front detention pond with an additional emergency access connecting the internal streets as shown on Exhibit C. The final emergency access arrangement shall be approved by the Fire Marshall. 4. Unified Development Code Compliance The property will conform to the requirements of the Unified Development Code unless specifically called out in this PD. D. Required Dedications of Public Land or Public Improvements The detention pond will be deeded to Brazoria County MUD #28 with maintenance by a HOA to be created. The existing detention pond on the property will be cleaned up and graded. Required right-of-way for Clear Creek will be dedicated to Brazoria Drainage District #4. E.
