CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:32 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Councilmember Woody Owens gave the Invocation and Boy Scout Troop 446 led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. CITIZEN COMMENTS Jimmy Davis, 5004 Colmesneil Dr., Pearland, Texas, stated his concerns regarding the utility billing ordinances and utility bill payment due dates. Zach Ward, 204 Colony Creek Dr., League City, Texas, Pearland Professional Firefighter Association, stated his concerns regarding the Evergreen Compensation Study. V PUBLIC HEARING Public Hearing — A request by the City of Pearland, applicant/owner, for approval of an amendment to the City of Pearland Thoroughfare Plan portion of the City's Comprehensive Plan. Councilmember Orlando read the purpose of the Public Hearing into the record. Director of Engineering & Public Works Robert Upton gave an overview of the request. Pearland City Council Minutes July 26, 2021 Mike Feeney, Kimley-Horn and Associates, Inc., gave an overview of the City of Pearland Thoroughfare Plan. Josie Ortiz, Kimley-Horn and Associates, Inc., gave an overview of the recommendations for the study areas. Mayor Cole called for citizen comments for or against the request. There were none. VI. NEW BUSINESS 1. Consideration and Possible Action — First Reading of Ordinance No. 1517- 4 - An Ordinance of the City Council of the City of Pearland, Texas, amending portions of the Thoroughfare Plan portion of the City's Comprehensive Plan; having a savings clause, a severability clause, and a repealer clause; providing for codification and an effective date. Mayor Pro-Tem Hernandez made the motion, seconded by Councilmember Owens, to approve the First Reading of Ordinance No. 1517-4. AYES: Orlando, Carbone, Kamkar, Hernandez, Little, Perez, Owens. NAYS: None. The motion carried. Paul Eskine, 2519 Park Avenue, Pearland, Texas, representing Houston Aircraft Instruments / PaSa Enterprises, LLD, gave an update on the Sullivan planned development townsite. He asked for Staff to make sure the required parking spaces are adequate. VII. CONSENT AGENDA A. Consideration and Possible Action - Second and Final Reading of Ordinance No. 2000M-212- An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification of certain property, Being 32.667 acres of land located in the Derril H.M. Hunter Survey, Abstract No. 76, Brazoria County, Texas, being a portion of certain called 39.50-acre tract conveyed to Musgrave-Grohman Ventures, Ltd., by instrument of record under Document No. 2004027202, Official Records of Brazoria County, Texas. (Eastern Side of Stable Stone Lane, Pearland, TX.). Consideration and Possible Action - Resolution No. R2021-132 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a contract for the refurbishment and remounting of a TL 160 ambulance box on a new chassis, from Mack Haik Dodge, in the amount of $174,425.00 through the Houston -Galveston Area Council ("HGAC") cooperative. E. Consideration and Possible Action - Resolution No. R2021-155 - A Resolution of The City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative pricing arrangement with the Texas Department of Information Resources (DIR), for the purchase of technology equipment (new public library; Shadow Creek Parkway) from Sequel Data Systems, in the estimated amount of $64,596.74 for fiscal year 2021. F. Consideration and Possible Action - Second and Final Reading of Ordinance No. 2000M-211 An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification of certain property, Tract A-1: Being a 1.722-acre tract, situated in the H.T. & B.R.R. Councilmember Kamkar made the motion, seconded by Mayor Pro-Tem Hernandez, to adopt Consent Agenda Items A through F, with the exception of Consent Agenda Items D and F. AYES: Orlando, Carbone, Kamkar, Hernandez, Little, Perez, Owens. NAYS: None. The motion carried. Mayor Cole moved Matters Removed from Consent Agenda Item F to before New Business Continued. VIII. Alan Muller, Growmax Development, spoke regarding the agreement to purchase signage and gave an overview of the proposed development. Councilmember Little made the motion, seconded by Mayor Pro-Tem Hernandez, to approve the Second and Final Reading of Ordinance No. 2000M- 211. AYES: Orlando, Carbone, Kamkar, Hernandez, Little, Perez, Owens. NAYS: None. The motion carried. Ordinance No. 2000M-211 is adopted. IX. NEW BUSINESS CONTINUED 2. Consideration and Possible Action — First and Only Reading of Ordinance No. 1603 - An Ordinance of the City Council of the City of Pearland, Texas, authorizing the issuance of City of Pearland, Texas Certificates of Obligation, Series 2021A; prescribing the terms thereof; providing for the payment thereof; awarding the sale thereof; making other provisions regarding such certificates and matters incident thereto; and declaring an emergency. Councilmember Owens made the motion, seconded by Councilmember Little, to approve the First and Only Reading of Ordinance No. 1603. John Robuck, BOK Financial Securities, Inc., presented the final pricing results for Certificates of Obligation, Series 2021A and Series 2021 B. AYES: Orlando, Carbone, Hernandez, Little, Perez, Owens. NAYS: None. ABSTAIN: Kamkar. The motion carried. Ordinance No. 1603 is adopted. 3. Consideration and Possible Action — First and Only Reading of Ordinance No. 1604 - An Ordinance of the City Council of the City of Pearland, Texas, authorizing the issuance of City of Pearland, Texas Certificates of Obligation, Series 2021 B; prescribing the terms thereof; providing for the payment thereof; awarding the sale thereof; making other provisions regarding such certificates and matters incident thereto; and declaring an emergency. Pearland City Council Minutes July 26, 2021 Councilmember Perez made the motion, seconded by Councilmember Little, to approve the First and Only Reading of Ordinance No. 1604. AYES: Orlando, Carbone, Hernandez, Little, Perez, Owens. NAYS: None. ABSTAIN: Kamkar. The motion carried. Ordinance No. 1604 is adopted. 4. Consideration and Possible Action - Resolution No. R2021-154 - A Resolution of the City Council of the City of Pearland, Texas, adopting a Five -Year Capital Improvement Program (2022-2026). Councilmember Orlando made the motion, seconded by Councilmember Carbone, to adopt Resolution No. R2021-154. Budget Officer Eric Roche and Director of Engineering & Public Works Robert Upton gave an overview of the Five -Year Capital Improvement Program. AYES: Orlando, Carbone, Kamkar, Hernandez, Little, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2021-154 is adopted. 5. Consideration and Possible Action — Second Reading of Ordinance No. 1595-2 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 1595-1, the 2020-2021 Annual Budget Ordinance, to facilitate the changes identified herein; providing a savings clause, a severa-bility clause, a repealer clause, and an effective date. Councilmember Carbone made the motion, seconded by Councilmember Little, to approve the Second Reading of Ordinance No. 1595-2. Mr. Roche gave an overview of the budget amendment. AYES: Orlando, Kamkar, Hernandez, Perez, Owens. NAYS: Carbone, Little. The motion carried. Ordinance No. 1595-2 is adopted. 6. Consideration and Possible Action — Second Reading of Ordinance No. 1602 - An Ordinance of the City Council of the City of Pearland, Texas, amending Chapter 20 of The Code Of Ordinances of The City of Pearland, Texas, by adding Article IX, Short-term Rentals, creating a requirement for a registration program for the operation of short-term rentals and the requirement to pay hotel occupancy fees to the City of Pearland when operating a short-term rental within the corporate limits of the City of Pearland; providing a savings clause; providing a penalty clause; a repealer clause and providing for publication. Mayor Pro-Tem Hernandez made the motion, seconded by Councilmember Little, to approve the Second Reading of Ordinance No. 1602. Pearland City Council Minutes July 26, 2021 AYES: Carbone, Little, Perez. NAYS: Orlando, Kamkar, Hernandez, Owens. The motion failed. 7. Consideration and Possible Action - Resolution No. R2021-152 - A Resolution of the City Council of the City of Pearland, Texas, recommending that the new library facility ("Library"), located at 11801 Shadow Creek Parkway, be named the West Pearland Library. Councilmember Kamkar made the motion, seconded by Councilmember Little, to adopt Resolution No. R2021-152. AYES: Orlando, Carbone, Kamkar, Hernandez, Little Perez, Owens. NAYS: None. The motion carried. Resolution No. R2021-152 is adopted. 8. Consideration and Possible Action - Resolution No. R2021-156 - A Resolution of The City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative pricing arrangement with The Interlocal Purchasing System (TIPS), for the purchase of audio-visual equipment (new public library; Shadow Creek Parkway) from Data Vox, Inc., in the estimated amount of $476,817.85 for fiscal year 2021. Councilmember Little made the motion, seconded by Councilmember Owens, to adopt Resolution No. R2021-156. AYES: Orlando, Carbone, Kamkar, Hernandez, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2021-156 is adopted. 9. Consideration and Possible Action - Resolution No. R2021-153- A Resolution of the City Council of the City of Pearland, Texas appointing a director to the Board of Directors of the Pearland Municipal Management District No. 2. Councilmember Perez made the motion, seconded by Councilmember Owens, to adopt Resolution No. R2021-153. Christie Jordan was appointed, by acclamation, to the Board of Directors of the Pearland Municipal Management District No. 2. AYES: Orlando, Kamkar, Hernandez, Little, Perez, Owens. NAYS: None. The motion carried. Resolution No. R2021-153 is adopted. 10. Council Input and Discussion- Comp & Class follow-up from the June 28, 2021 City Council meeting. Evergreen Solutions to provide additional information regarding Comp & Class findings to ensure comparable cities Pearland City Council Minutes July 26, 2021 were used in the study, outline new pay plans with inflation and determine costs. Director of Human Resources LaRae James gave an overview of the Evergreen Solutions Comp & Class Study. Evergreen Solutions representative Mark Holcombe presented a follow-up overview of the on the Evergreen Solutions Comp & Class Study. Pearland Police Officers Association representative Adam Carroll, 12511 Britt Rd., stated his concerns regarding the comp and class study. He thanked Ms. James and the Human Resources Department for coordinating the sick time buy back project and he thanked Council for continuing to review the Comp & Class Study. Councilmember Kamkar asked the City Secretary to include language in the minutes to state the Sick BuyBack Program will be added to the list of other compensation considered. No action taken. X. MATTERS REMOVED FROM CONSENT AGENDA D.
