2021-06-28 CITY COUNCIL REGULAR MEETING MINUTES • MINUTES OF A CITY COUNCIL REGULAR MEETING OF THE CITY OF PEARLAND, TEXAS, HELD ON JUNE 28, 2021 VIA TELEPHONE/VIDEO-CONFERENCE AT 6:30 PM, IN PEARLAND CITY HALL COUNCIL CHAMBERS, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. I. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:30 p.m. II. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Mayor J. Kevin Cole gave the Invocation and Councilmember Tony Carbone led the Pledge of Allegiance to the United States of America Flag and the Texas Flag. III. ROLL CALL AND CERTIFICATION OF QUORUM Mayor J. CITIZEN COMMENTS Patton Ritter, 305 S. Walker St., Angleton, Texas 77575, addressed Council to state that he is a candidate for Brazoria County Court at Law Number Two. Gary Hosmer, 4026 Ravenwood Court, Pearland, Texas 77584, addressed the Council stating his concerns regarding alcohol in the City, free water, and tax districts. V. PUBLIC HEARING NO. 1 Public Hearing: A request by Robert Quintana, applicant, on behalf of Malisa Pearland, LP, owner, for approval of an amendment to the land use regulations of the Province Village Planned Development (PD) District, to permit Gym/Health Club use.by right within the General Business (GB) District of the PD, on approximately 1.707 acres of land; to wit: Legal Description: Being all of Lot"A", Block 1 of Province Village Replat No. 1, an addition in the City of Pearland, Brazoria County, Texas, as recoded in the plat recorded in the County Clerk's File No. 2014038140 in the Plat Records of Brazoria County, Texas. • • Pearland City Council Minutes June 28, 2021 General Location: 2701 Pearland Parkway, Pearland, TX. Michael Stelmach, 2002 Peonies Court, Pearland, Texas 77581, applicant, provided a summary of the Cycle Bar. Mayor Cole called for citizen comments for or against the request. There were none. VI. NEW BUSINESS 1. Consideration and Possible Action First Reading of Ordinance No. 2000M-210 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 2000M, the zoning map of the City of Pearland, Texas, for the purpose of changing the classification of certain property, being all of Lot "A", Block 1 of Province Village Replat No. 1, an addition in the City of Pearland, Brazoria County, Texas, as recoded in the plat recorded in the County Clerk's File No. 2014038140 in the Plat Records of Brazoria County, Texas (2701 Pearland Parkway, Pearland, TX). Zone Change Application No. ZONE 21-00005, a Robert Quintana, applicant, on behalf of Malisa Pearland, LP, owner, for approval of an amendment to the Province Village Planned Development(PD) District, to permit Gym/Health Club use by right within the General Business (GB) District of the PD, on approximately 1.707 acres of land; providing for an amendment of the zoning district map; containing a savings clause, a severability clause,and an effective date and other provisions related to the subject Councilmember Carbone made the motion, seconded by Councilmember Owens, to approve the First Reading of Ordinance No. 2000M-210. Raga Relangi, 3850 Tarragon Pen Drive, Richmond, Texas, engineer on the project, gave a presentation. Mayor Cole called for citizen comments for or against the request. Consideration and Possible Action - Resolution No. R2021-CUP21-00016 - A Resolution of the City Council of the City of Pearland, Texas, approving a Conditional Use Permit (CUP) for Auto Wash (Self-Service) and Auto Repair (Minor) within the Commercial District of the Shadow Creek Planned Development(PD), on approximately.1.386 acres of land; being all of all of Lot 2, Block 1 of the Minor Plat of Kingsley Corner at Shadow Creek, an addition in the City of Pearland, Brazoria County, according to the Plat recorded in County Clerk's File No. 2020004517 in the Plat Records of Brazoria County,.Texas (Located at 12700 Shadow Creek Parkway, Pearland, Texas). Councilmember Kamkar made the motion, seconded by Councilmember Little, to adopt Resolution No. R2021-CUP21-00016. Councilmember Little made the motion, seconded by Councilmember Orlando, to amend Resolution No. R2021-CUP21-00016 to include the items recommended by the Planning and Zoning Commission and read into the record. Consideration and Possible Action - Resolution No. R2021-137 - A Resolution of the City Council of the City of Pearland, Texas, awarding a contract for the purchase of Fire Department Uniforms from Galls, LLC, in Pearland City Council Minutes June 28, 2021 the estimated amount of $175,000.00 for the period of June 15, 2021 through June 14, 2022. H. Consideration and Possible Action - Resolution No. R2021-143 - A Resolution of The City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative pricing arrangement with the Texas Department of Information Resources (DIR) for the purchase of SmartNet Software Support and Subscription Services from Red River Technology, LLC, in the amount of$238,261.56. Consideration and Possible Action - Resolution No. R2021-139 - A Resolution of the City Council of the City. of Pearland, Texas, approving Special Event Permit No. EVNT21-00049 for iRun Production's Christmas in July 8K running event. J. Consideration and Possible Action - Resolution No. R2021-140 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager,or his designee to enter a contract for progressive construction photography services (Surface Water Plant Project), with Multivista Construction Documentation, in the amount of$29,312.26. K. Consideration and Possible Action - Resolution No. R2021-145 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a design contract with Cobb Fendley, associated with the East/West Barnett Lift Station Project, in the estimated amount of$159,966.00. L. Consideration and Possible Action - Second and Final Reading of Ordinance No. 187-4 - An Ordinance of the City Council of the City of Pearland,'Texas, amending Chapter 15,Article II, Library Board, of the City of Pearland Code of Ordinances, as it may have been, from time to time amended; and containing other matters relating to the subject; having a savings clause, a repealer clause, a severability clause; and providing for codification. Councilmember Orlando made the motion, seconded by Councilmember Carbone, to adopt Consent Agenda Items A through L, with the exception of Consent Agenda Item D. NEW BUSINESS CONTINUED 4: Consideration and Possible Action - Resolution No. R2021-135 - A Resolution of the City Council of the City of Pearland, Texas, appointing a member of the City Council to serve on the Steering Committee for the Pearland Transit Needs Assessment being prepared by the Houston Galveston Area Council ("HGAC"). • Pearland City Council Minutes June 28, 2021 • Councilmember Carbone made the motion, seconded by Councilmember Little, to adopt Resolution No. R2021-135. AYES: Orlando, Carbone, Kamkar, Hernandez, Little, Owens. NAYS: None. The motion carried. Resolution No. R2021-135 is adopted. 5. -Presentation and Discussion - Presentation of Compensation and Classification Study completed by Evergreen, LLC. Mayor Pro-Tern Hernandez presented New Business Item 5 for discussion.. Adam Carroll, 12511 Britt Rd, representative of the Pearland Police Officers Association, addressed the Council and stated his concerns with the Compensation and Classification Study. Mark Holcombe; 3037 Core Drive, Tallahassee, Florida, representative of Evergreen, LLC, provided a presentation of the Compensation and Classification Study. Council gave consensus for Evergreen, LLC to include three additional benchmark cities. No action taken. 6. Consideration and Possible Action - Resolution No. R2020-144 - A Resolution of the City Council of the City of Pearland,Texas, amending the City's Comprehensive Financial Management Policy Statement to enhance the City's long-term goal of maintaining fiscal health and stability. Mayor Pro-Tern Hernandez left the City Council meeting. Councilmember Kamkar made the motion, seconded by Councilmember Little to adopt Resolution No. R2021-144. Councilmember Kamkar made the motion, seconded by Councilmember Little, to amend Resolution No. R2021-144 to add language to Page 14, Item C, to achieve a goal of at least$3.00 to $1.0.0 ratio. Consideration and Possible Action - Resolution No. R2020-147- A , Resolution of the City Council of the City of Pearland, Texas, authorizing the City Engineer to accept the terms, conditions and award of funds from the Texas Water Development Board (TWDB)-Flood Mitigation Assistance (FMA) Program on behalf of the City, in the amount of $1,073,790.00, for the elevation of five (5) severe repetitive loss, flood prone properties • located within the City limits.' Councilmember Little made the motion, seconded by Councilmember Owens, to adopt Resolution No. R2021-147. AYES: Orlando, Carbone, Kamkar, Little, Owens. NAYS: None. The motion carried. Consideration and Possible Action- Resolution No. R2021-116 - A Resolution of The City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative pricing arrangement with the Choice Partners Cooperative for the purchase of library furnishings, in the amount of $1,107,352.18, from Library Interiors of Texas. Jeff Pulloff, representative with PGAL, addressed the Council regarding the line items for the library. • Michael Taylor, representative of Library Interiors of Texas answered questions of the Council. Councilmember Owens made the motion, seconded by Councilmember Little, to adopt Resolution No. R2021-116. AYES: Orlando, Kamkar, Owens. NAYS: Carbone, Little. The motion carried. Resolution No. R2021-116 is adopted. 9. Consideration and Possible Action- Resolution No. R2021-142 - A Resolution of the City Council of the City of Pearland, Texas, amending a Construction Manager at Risk contract with PLW Waterworks,, in the additional amount of $49,771,704.00 to include the total Guaranteed Maximum Price (GMP) of $70,595,915.00 (inclusive of pre-construction services and the Early Works Package No.1), for construction phase services associated with John Hargrove Water Reclamation Facility Expansion Project; and approving an appropriation of$4,948,236.00 from Fund 550 Fund Balance. Consideration and Possible Action - Resolution No. R2021-70 A Resolution of the City Council of the City of Pearland, Texas, authorizing a design contract with Traffic Engineers, Inc., associated with the Shadow Creek Ranch Intersection Improvement Project, in the estimated amount of$580,963.00. Councilmember Little made the motion, seconded by Councilmember Owens, to adopt Resolution No. R2021-70. AYES: Orlando, Carbone, Kamkar, Little, Owens. NAYS: None. The motion carried. MAYOR/COUNCIL ISSUES FOR CITY COUNCIL DISCUSSION • 1. Council Input and Discussion: Engineering Design Criteria Manual - Discussion on detention requirements for disturbed area and impervious cover. Mayor/Council Issues for City Council Item Number One was postponed to a future City Council Meeting in July. XVI. EXECUTIVE SESSION UNDER TEXAS GOVERNMENT CODE 1. Section 551.071- Consultation with City Attorney- Discussion with City Attorney to seek legal guidance regarding the public use of City facilities. 2. 551.087- Economic Development Negotiations- Deliberations Regarding Economic Development Negotiations.
