MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF PEARLAND, TEXAS, HELD ON OCTOBER
7, 1985, AT 7:00 P. M. IN THE CITY HALL, 2335 N. TEXAS AVENUE, PEARLAND, TEXAS

RESOLUTION NO. R85-22, A RESOLUTION NOMINATING CANDIDATES FOR THE BOARD OF DIRECTORS
OF THE BRAZORIA COUNTY APPRAISAL DISTRICT
City Manager Ron Wicker and Tax Assessor/Collector Barbara Lenamon recommended that
Dr. Burch Loggins, Leland Kee, J. G. Dickson, Toby S. Lytle and Riley Godwin be
nominated for each of the five members of the Board of Directors of the Brazoria
County Appraisal District.
Resolution No. R85-22 read in full by Councilman Bost.
It was moved by Councilman Bost, seconded by Councilman Tetens, that Resolution No.
R85-22 be passed and approved on first and only reading. Said Resolution No. R85-22
reads in caption as follows:

PEARLAND, TEXAS, NOMINATING CANDIDATES FOR THE
BOARD OF DIRECTORS OF THE BRAZORIA COUNTY

Voting "Aye" - Councilman Gray, Councilman Frauenberger, Councilman Bost and
Councilman Tetens.
Voting "No" - None
Councilman Lentz abstained.
Motion passed 4 to 0.
APPROVAL OF INVOICE, ESTIMATE NO. 4, FINAL, BIG H CONSTRUCTION, INC., FOR WALNUT
STREET SEWER LIFT STATION REHABILITATION, IN THE AMOUNT OF $6,181.98
It was moved by Councilman Lentz, seconded by Councilman Tetens, that Estimate No. 4,
Final, Big H Construction, Inc., for the Walnut Street Sewer Lift Station Rehabiliat-
tion, Project No. 84-22, in the amount of $6,181.98 be approved and payment be made
from the appropriate fund.
Motion passed 5 to 0.
CITY ACCEPTANCE OF A RAILROAD CABOOSE
Mayor Reid explained there had been several efforts over the years to obtain a
caboose, or the like, for an addition to the Depot that is currently being used by
the Chamber of Commerce and located on City property off Liberty Drive. Mayor Reid

further explained that included in the Council's packets are a series of letters from
Capt. Jack Roberts who has obtained a caboose and made all the necessary arrangements
to place it on a site acceptable to the City, along with working out details for
cleaning and painting it.
City Manager Ron wicker stated he believed the caboose would be an addition plus for
the depot site and that it seems that Mr. Roberts has taken care of everything to
accomplish this effort. If Council agrees to accept the caboose, he would recommend
that the Park Board be involved in helping to decide where it should be placed.
Councilman Frauenberger, Council liaison to the Chamber, stated that the Chamber
Board will meet this Thursday and it will be recommended to them that the caboose
would be appropriate and would contribute to the historic significance of the depot.
It was moved by Councilman Frauenberger, seconded by Councilman Lentz, that the City
accept the railroad caboose and that the location for the caboose be coordinated with
the Park Board.
Motion passed 5 to 0.
DEPARTMENTAL REPORTS
Tax Assessor/Collector Barbara Lenamon announced that she received word from the
appraisal district that they have certified 96.4% of the Appraisal District roll for
Brazoria County. She will be getting our figures tomorrow which means she can calcu-
late and publish this week and an Ordinance will be ready for Council consideration
at the next regular meeting.

Re: Depot/Caboose
Dear Tom:
This letter will confirm Mrs. Roberts (Stella) and my conversation with
you pertaining to the Chamber of Commerce/Clean Pearland/City of Pearland
acquiring a caboose from the Southern Pacific Transportation Company.
Since talking to you we have been advised that the Chamber has met and
suggest that it be located near the Train Depot on Liberty Drive. We, as
originally thought, feel that this is the premier site for this addition to our
Civic Center area.
For your records we are enclosing copies of previous correspondence from
us to Southern Pacific and their reply. These are stapled together for your
and the Council's review.
Now for the plan of attack and " what's happened ".

A. SPTCO has donated the " caboose " as per letter and now have agreed
to load it out. We have inspected the unit and feel that it is more than adequate,
can be refurbished rather easily and will be a welcome addition to the Depot/
Civic Center. (Contacts: Mr. Hatfield, Jr. 223-6695, Mr. Charlie Day 223-6647
(Yard Office), or Mr. W. E. Bile at same number.
B. Wm. A. Smith Construction Co. (Mr. Jack Wilt 676-5500) has agreed
to lay foundation/ties and track.
C. T. E. Cory Transportation Co. (Mr. T. E. Cory 455-3035) will transport
from SPTCO off Clinton Drive to the site in Pearland.
D. BADO Equipment Co. (Mr. Jim Nichols 643-2658) has agreed to unload
unit upon arrival in Pearland.
E. Reliable Paint Co. (Mr. Lee Berryhill 458-3588) and the writer are
working out details for cleaning and painting and do not feel that this will present
any problem at all.
We feel that since this operation can be accomplished at little or no expense
to the City we should proceed to obtain this unit. We ask that you take it up at
the next City meeting and advise us soonest in order that we may proceed with,
what appears to be to all, a rewarding project.

Southern Pacific Transportation Company (SPTCo. ) takes
pleasure in donating to you Caboose 1681 to be used in connection
with your Clean Pearland organization. It will be necessary that
you arrange with SPTCo. ' s authorized representatives for the time
and manner in which same is to be picked up.
As a part condition of this donation, you agree not to
permit the said caboose to be used for any railroad related
purposes.
SPTCO. MAKES NO WARRANTY OR GUARANTY, EITHER EXPRESS
OR IMPLIED, AS TO THE FITNESS OF SAID CABOOSE FOR USE,
MERCHANTABILITY OR FOR ANY PARTICULAR PURPOSE WHATSOEVER.
Insofar as it lawfully may, Clean Pearland Organization
agrees to release, defend and indemnify SPTCo. from and against
all liability, cost and expense for injuries to or death of
persons and damage to or destruction of property, arising or
resulting in any manner whatsoever in connection with said
caboose, whether or not caused or contributed to by any negligent
act or omission, active, passive or otherwise, of SPTCo.
Mr. R. S . Hatfield, Jr. , Superintendent at 913 Franklin St. ,
Houston, TX 77002 , will be furnished a copy of this letter and
you should contact him to coordinate pick up of the caboose.

Dear Mrs. Roberts:
Thank you for the copy of your July 30th letter to Mr. Hoenig
of our San Francisco Office.
While we have not officially heard from Mr. Hoenig, we have
undertaken some action locally by submitting necessary paperwork and
attempting to locate a suitable caboose for donation to Clean
Pearland.
Again, please understand that we must wait for final approval
and authorization from Mr. Hoenig ' s office; however, we will do what
we can to assist you on a local basis until a final decision is
forthcoming from California.

Dear Sir:
Our " Clean Pearland " organization which is certified under The Keep
America Beautiful System is anxious to obtain a railroad caboose to be placed
in conjunction with our Chamber of Commerce building in the new City Complex.
As may be seen by photographs enclosed, the Chamber building is the original
Pearland Santa Fe depot built in late 1800's, which was moved in 1980 and
restored by local citizens. There is presently a Committee working to have the
building declared an Historical Landmark.
The depot is located on City of Pearland property and Clean Pearland with
all volunteer help and contributions is planning and planting a Sesquicentennial
garden which will be initially a combination flower/trees and vegetable garden,
but ultimately will serve as a " green space " for the new three story 35,000
square foot City Hall to be constructed in 1986. Adjacent to the City Hall
property is our newly built Community Center which presently houses our
Library, Parks Department and meeting rooms for community organizations.
Clean Pearland, a non-profit organization as defined under Section 501(c)(3)
of the Internal Revenue Code, has received enthusiastic support from a large
segment of our community and has received recognition at the local, county,
state and national level for achievement in improving quality of life in our
community. In the three years since inception " Clean Pearland " has won:

1. National award from Keep America Beautiful (KAB) for KAB week
activities.
2. Twice won Keep Brazoria County Beautiful Assocation award.
3. The Governor's Achievement Award and the Award of Excellence was
awarded Pearland by Beautify Texas Council (BTC).
The Chamber building will ultimately become a museum and we are anxious
to beautify the present depot with an authentic caboose. It is our understanding
that several of these units are available at the Inglewood Yard on Liberty Road
in Houston (coincidentally Liberty Dr. is name of Pearland Street on which
Chamber of Commerce is located - leads to Liberty Park (largest Pearland Park).
In connection with this project we have several questions, to wit:
Would it be possible to have one of these units donated to an organization such
as ours for the intended use ?
If donation is not possible what would be the sale price ?
For matter of record T. E. Cory Transportation Co. has offered to move a
unit to Pearland at no cost and Reliable Painting and Contracting has agreed to
sandblast and paint a unit. The caboose will be placed on bed of ties and will
rest on track. We would paint it with the Southern Pacific color code, with or
without name as your firm desires.
By copy of this letter we are advising everyone that we have talked to as
regards our request and " thank you " in advance for your prompt attention and
assistance in accomplishing this project. We hopefully await your response.
