Little York, Suite 240 9� Houston,TX 77040MA 2005 RE: Pearland Parkway Round-A-Bout ,,.�g �® Dear Mr. Olson: This letter sets forth the agreement of the City of Pearland (City) to maintain proposed improvements to the Pearland Parkway Round-A-Bout at its intersection with McHard Road and more accurately depicted on Exhibit "A" attached hereto. Beazer Homes Texas, L.P. (Beazer) agrees to construct improvements to the Pearland Parkway Round-A-Bout in a manner that is substantially similar to the improvements shown on Exhibits "A" and "B" attached hereto; said construction shall include • appropriate lighting and irrigation. Beazer agrees to submit construction plans to the City for review and approval prior to commencing construction. Beazer agrees to submit such plans within 90 days of the date of this agreement and to complete construction within 180 days after approval of the plans. It is agreed that all construction costs associated with the proposed improvements are the responsibility of Beazer, and that the City shall maintain the improvements upon completion and acceptance. In the performance of this agreement, the City and Beazer agree to mutually release the other party's agents, attorneys, representatives, employees and officials from any and all disputes that may arise from this agreement. If this letter accurately describes your understanding of the agreement between the City and Beazer regarding the construction of improvements to the Pearland Parkway Round-A-Bout, please execute this letter in the space provided below and return one executed original to my office.
