1985-06-03 CITY COUNCIL PUBLIC HEARING MEETING MINUTESlot MINUTES OF A PUBLIC HEARING BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS HELD ON JUNE 3, 1985, AT 7:30 P. M. IN THE COMMUNITY BUILDING, 3523 LIBERTY DRIVE, PEARLAND, TEXAS The Hearing was called to order with the following present: Mayor Councilman/Mayor Pro Tem Councilman Councilman Councilman Councilman City Manager City Attorney Code Enforcement Official City Secretary PURPOSE OF THE HEARING: Tom Reid James Bost Al Lentz Richard Tetens Dennis Frauenberger Terry Gray Ronald J. Wicker Luke L. Daniel Ernesto Buenrostro Kay Krouse Public Hearing on the Proposed Revised Zoning Ordinance and Proposed Revised Zoning Map of the City of Pearland, Texas. NUMBER OF CITIZENS SIGNING ATTENDANCE REGISTER: 92 Mayor Reid opened the Hearing with some introductory remarks. Mayor Reid stated the Council was interested tonight in receiving new information and asked that any requests be submitted in written form with a site map attached. Leroy Savoie, Acting Chairman of the Planning & Zoning Commission, spoke on the history of zoning in Pearland from its inception in 1973 with the formation of the committee in 1982 to review and upgrade the ordinance on through the many workshops and public hearings held on the revisions to the ordinance and zoning map. City Manager Ron Wicker spoke about the growth rate in Pearland; last year it was 10%. The Land Use (Zoning) Ordinance is one of the best tools to work with to handle this growth, Mr. Wicker stated, and the Planning & Zoning Commission and the City Council, with its final say, have an important responsibility in accepting and approving the proposed revisions to this ordinance and zoning map. CITIZENS SIGNED TO SPEAK: 1. C. D. Anderson, 3215 Jacquelyn, Pearland - Mr. Anderson recommended the area. behind K -Mart Shopping Center, now zoned Multi -Family, be changed to Commercial or General Business. He stated he was opposed to any more apartments being built in Pearland. 2. Bill Ernst, 1313 Yorkshire - Mr. Ernst stated he was a local architect with a practice in Pearland and recommended some changes to the text of the Ordinance concerning 35' height restriction, townhome/condominium requirements, landscaping requirements, density requirements for apartments and parking requirements. 3. Mary Lou Henry, 5900 Memorial Dr., Houston, Texas - Mrs. Henry of Vernon Henry & Associates, Planners, represents the Gustafson Group and stated they were satis- fied with the proposed zoning of their property and feels it will allow reason- able use of the land. 4. David S. Miller, 2706 Shady Creek, Pearland - Mr. Miller recommended some changes in the language of the Ordinance concerning density requirements for apartments and townhomes, maintenance of landscaping, parking spaces for restaurants. He stated he would put these recommendations in writing for Council's consideration. 5. Larry Goodman, 2314 Heritage Landing, Pearland - Mr. Goodman requested that in their decision on the adoption of the Ordinance, the Council "think to the future". 6. Jeannine Ivy, 5201 Shank Road, Pearland - Mrs. Ivy asked if there were any changes to the Ordinance that would allow her to build a residence on a five acre tract she owns that is zoned M-1. City Manager Wicker responded that there was not. Mayor Reid asked Mrs. Ivy to put her request in writing for Council's consideration. 7. Bill Eignus, P. O. Box 12, Friendswood, Texas - Mr. Eignus spoke about the business he has operated since 1940 at the entrance of Longwood Park and requested Council consideration of zoning it General Business and requested they look at other areas like his to be zoned for small businesses. He will submit his request in writing. 8. Joe Rye, 6626 Scott Lane, Pearland - Mr. Rye stated he has requested in writing his desire to have his property changed from proposed residential to Commercial. 9. Anthony F. Vento - asked to be passed. 10. Frances Jamison, 2417 E. Broadway, Pearland - Mrs. Jamison requested that the 60 acres she owns on John Lizer Road be zoned Commercial and the property where her cannery is to be zoned Commercial instead of General Business. She will submit all her previous requests in writing for Council consideration. 11. Barbara Bonin - asked to be passed. 12. Lou Bernard - asked to be passed. 13. Mary Ann Lay, 3404 E. Walnut, Pearland - Mrs. Lay requested four lots she owns on Walnut be zoned Commercial. She has submitted this request in writing. 14. D. A. Miller - asked to be passed. 15. Bunny Williamson - asked to be passed. 16. Mary Starr - asked to be passed. 17. Robert W. Kennedy - asked to be passed. 18. Laura Howard, 4715 Scott, Pearland - Mrs. Howard testified that there was an error in the map. The residents on Scott Street had requested that the Planning & Zoning Commission change the zoning on either side of Scott Street all the way to Woody Road to Residential instead of a portion being Commercial and the Planning and Zoning had granted the request. 19. Richard Hoot, 4713 Scott, Pearland - Mr. Hoot echoed Mrs. Howard's testimony. Leroy Savoie, Acting Chairman of the Planning & Zoning Commission, verified that the map was in error and will be corrected before the City Council begins review- ing the map. 20. Billie Poynter, 4717 Scott, Pearland - Mrs. Poynter stated that along with the above, Mr. Kennedy's property is showing Commercial and she believes that is in error too. Leroy Savoie verified that it was in error. 21. Ed Lewis, P. 0. Box 728, Pearland - Mr. Lewis stated that the property on the southerly side of F. M. 518 at the intersection of Liberty Drive is listed on the map as General Business but the zoning had been changed to Commercial and he would like it to remain Commercial. 22. Tom Alexander, 3208 Nottingham, Pearland - Mr. Alexander stated he believed the new Ordinance will cause an economic setback in development in Pearland. He will re- submit his requests in writing for zoning of his property. 23. Boykin Bartlett, 4722 Devan, Houston, Texas - Mr. Bartlett spoke about the develop- ment of the Alexander property concerning over 200 acres and requested the Council take another look at P.U.D. and would like the opportunity to discuss the P.U.D. with Council. 24. John Alexander, Box 127, Pearland - Mr. Alexander said he believed in freedom of ownership of private property and would like to see landowners develop their land as they like. 25. Carol Carter, 3607 Orange, Pearland - Ms. Carter asked what her property is proposed to be zoned. City Manager Wicker responded that it was proposed Commercial. 26. Oma Hebble, 1897 Meadow Creek, Pearland - Ms. Hebble requested that portions of Dixie Farm Road be changed from residential to Commercial_ 27. Dan Jones - asked to be passed. 28. Albert Weber, 2610 Longwood Drive, Pearland - Mr. Weber stated he believed the pro- posed zoning of R-2 along the northern part of Dixie Farm Road was unfair. He said the residents of McGinnes and Longwood Subdivisions would not like to have small lots next to them.
