CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON MARCH 19, 1985, AT 7:00 P. M. IN
THE CITY HALL, 2335 NORTH TEXAS AVENUE, PEARLAND, TEXAS.

CONTINUANCE OF A PUBLIC HEARING ON STREET PAVING ASSESSMENTS ON LIBERTY DRIVE AND SOUTH
GALVESTON STREET FROM 11:26 P. M. on MONDAY, MARCH 18, 1985.
TESTIMONY ON BEHALF= OF THE 'CITY
William K. Thomasset, Director of Public Works, testified that he submitted to the City
Council, at a meeting held on October 22, 1984, the final payment estimate for the pav-
ing work done on Liberty Dr. and South Galveston St., and he informed Council that the
two streets had been opened for public use for more than 30 days, and that he recom
mended final payment and acceptance on both streets. Mr. Thomasset was cross-examined.

GEORGE REED - REALTOR:
Mr. Reed testified that he was a licensed real estate broker, appraiser and consultant -
S.R.A. Member of Society of Real Estate Appraisers; -Realtor., Member of the Houston Board
Texas Realtors Association, and National Association of Real Estate Boards; Member of
American Right of Way Association; and C.R.A. Member of American Assoc. of Review
Appraisers.
Mr -Reed also testified that he was familiar with land values in the City of Pearland,
Texas; and that all the properties, with the exception of the property owned by High-
land Lakes Mortgage Company, which front and abut the improvements on Liberty Dr., have
been enhanced in value at least in the amount of the proposed assessment reflected on
the Engineer's Rolls.
Mr. Reed further testified that all of the properties which front and abut the improve-
ments on South Galveston St., with the exception of Silver Maples Apartments, have been
enhanced -in value at leastin the amount of the proposed assessment.

TESTIMONY ON BEHALF OF PROPERTY OWNERS:
1. Edward A. Lewis, Liberty Dr. Property Owner, testified he did not agree with the City
that the value of his property on Liberty Dr.. was enhanced by the paving project. He
was cross-examined by City Attorney Luke Daniel;
2. Jim Paschal, Owner Paschal's Minimax, Liberty Dr., testified as to the adverse effect
on sales in his store during and after construction on'Liberty Dr. He -was cross-
examined by Luke Daniel, City Attorney;
3. Ms.Nancy Wilt, Fleming Food, testified as -to the adverse effect the construction
on Liberty Dr. had on the Minimax Store. She was cross-examined by Luke Daniel, City
Attorney.
4. Aaron Pasternak, Liberty Dr. Property Owner, testified as to his business dealings
in Pearland properties, his donation of land on Liberty Dr., and that he did not see any
special benefits to -his property from the paving improvements'. Tie was cross-examined
by Luke -Daniel, City Attorney.
5. Michael Valone, Real Estate Broker and Appraiser, testified in his opinion the value
of the Pasternak property on Liberty Dr. was not enhanced by the paving project. He
was cross-examined by City Attorney Luke Daniel.
6. Ms. Nan Tyson, Real Estate Appraiser from Alvin, Texas, testified she hadmade com-
parisons of the Morrison property on Galveston St. with comparable property in Alvin .
and in her opinion the value of'the Morrison's property had not been enhanced by the
concrete street. She was cross=examined by'Luke Daniel, City Attorney.
7. Tom Alexander, South Galveston St. Property Owner, made a statement regarding taxes
paid by property owners and spoke of assessments on other City properties, and that he
disagreed that his property had been enhanced by the paving project.
8. A. -G. Crouch, Attorney, representing Delta Savings property on the corner of So.
Galveston and F.M. 518, stated he disagreed with the City's contention, that the paving
project enhanced that property value by at least the amount of the assessment.
