A Resolution of the City Council of the City of Pearland, Texas, selecting a
separate public hearing format, in lieu of a joint public hearing format, for
zoning and conditional use permit applications considered by the Planning
and Zoning Commission and the City Council.
WHEREAS, on April 26, 2021, Unified Development Code (UDC) Amendment T-34 was
adopted to allow the implementation of a separate public hearing format, in lieu of joint public
meetings, for zoning and conditional use permit applications; and
WHEREAS, UDC Chapter 2, Article 2, Division 1, Section 2.2.1.3. authorizes Public
Hearings for zoning requests to be conducted separately by the Planning and Zoning
Commission and the City Council; and
WHEREAS, UDC Chapter 2, Article 2, Division 2, Section 2.2.3.3. authorizes Conditional
Use Permits to be presented to the Planning and Zoning Commission and considered by the
City Council separately.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. That the City Council hereby selects a separate public hearing format, in lieu
of a joint public hearing format, for zoning and conditional use permit applications considered by
the Planning and Zoning Commission and the City Council.
Section 2. The City Council of the City of Pearland finds and determines that the
adoption of this Resolution promotes the health, safety, and general welfare of the public and is
a proper valid exercise of the City's police powers.
