2021-03-22 CITY COUNCIL REGULAR MEETING MINUTESMINUTES OF A CITY COUNCIL REGULAR MEETING OF THE CITY OF PEARLAND, TEXAS, HELD ON MARCH 22, 2021 AT 6:30 P.M., 1N -PERSON AND VIA TELEPHONE/VIDEOCONFERENCE IN THE PEARLAND CITY HALL COUNCIL CHAMBERS, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. CALL TO ORDER Mayor J. Kevin Cole called the meeting to order at 6:30 p.m. INVOCATION AND THE PLEDGE OF ALLEGIANCE TO THE UNITED STATES OF AMERICA FLAG AND TEXAS FLAG Councilmember Luke Orlando gave the Invocation and Councilmember Tony Carbone led the Pledge of Allegiance to the United States of America Flag and Texas Flag. CITIZEN COMMENTS Kelly Moody, 3708 Pine Bark Ct., Pearland, Texas, Present of the Forever Parks Foundation of Pearland, presented the 2020 annual report of the Forever Parks Foundation. She thanked Mayor and Council for their support. Jeffrey HunkeIe, 3912 Oakwood Drive North, Pearland, Texas thanked Mayor Pro -Tem Hernandez for his work with Keep Pearland Beautiful. He spoke on regarding his concerns with Consent Agenda Item J and New Business Agenda Items Number Five and Si (6). Carol Artz-Bucek, 6117 Broadway, Pearland, Texas, with Pearland Chamber of Commerce, spoke regarding the March Membership Luncheon Event. She spoke regarding attendance at the Texas State Capitol with Mayor Cole, sixteen (16) Pearland professionals and the Pearland Chamber of Commerce to visit 72 legislatures. She spoke regarding no signage along the beltway. Jai Daggett, 11601 Shadow Creek Pkwy, Pearland, Texas, spoke regarding the Winter Storm. He spoke regarding what the citizens should expect from the elected officials during an emergency. CONSENT AGENDA City Council Regular Meeting - Mar 22 2021 A. Consideration and Possible Action - Resolution No. R2021-48- Resolution of the City Council of the City of Pearland, Texas, authorizing a design contract with HR Green, associated with certain drainage improvements (Brookland Acres, Garden Road/O'Day Road, and Woody Road), in the estimated amount of $237,072.00. B. Consideration and Possible Action - Resolution No. 82021-3 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a contract with Charles D. Gooden Consulting Engineers for design services associated with the South Corrigan Transite Pipe Waterline Replacement Project, in the estimated amount of $174,521 .00. C. Consideration and Possible Action- R2021-45 - A Resolution of the City Council of the City of Pearland, Texas, updating and approving the City's guidelines and criteria for granting tax abatements within a reinvestment zone created in the City of Pearland, Brazoria County, Fort Bend County, and Harris County, Texas; providing a savings clause; providing a severability clause; and providing for an effective date. D. Consideration and Possible Action - Resolution No. R2021-51 - A Resolution of the City Council of the City of Pearland, Texas, awarding a Unit Supply bid for traffic signal heads and components to Consolidated Traffic Controls, Inc., in the estimated amount of $140,000.00, for the period of April 1, 2021 through March 30, 2022. E. Consideration and Possible Action - Resolution No. R2021-52 Resolution of the City Council of the City of Pearland, Texas, awarding a bid for the purchase of one (1) aerial bucket truck from Specialty Fleet Sales, through The Interlocal Purchasing System ("TIPS") Cooperative, in the amount of $166,271.00. F. Consideration and Possible Action - Resolution No. R2021-55 - A Resolution of the City Council of the City of Pearland, Texas, designating Authorized Officials and Designated Signatories for various purposed related to the City's Community Development Block Grant -Disaster Recovery (CDB DR) grant program, funded by the U.S. Department of Housing & Urban Development (HUD) through the Texas General Land Office. G. Consideration and Possible Action - Resolution No. R2021-54 - A Resolution of the City Council of the City of Pearland, Texas, amending a unit cost contract for property buy-out additional acquisition services, with Jeff Ward & Associates in the additional amount of $47,000.00 (total amount of $115,000.00), for the period of September 1, 2021 through September 30, 2022. H. Consideration and Possible Action - Resolution No. R2021-56 - 'A Resolution of the City Council of the City of Pearland, Texas, adopting Housing Guidelines in accordance' with therequirements set forth by the Texas General Land Office Community Development Block Grant — Disaster Recovery CDB -DR Program. I. Consideration and Possible Action - Resolution No. R2021-57 - A Resolution of the City Council of the City of Pearland, Texas, amending a unit supply contract for general plumbing services with I. R. Allen industrial Services, LLC, in the City Council Regular Meeting - Mar 22 2021 additional amount of $50,000.00 (total amount of $120,000.00), for the period of May 31, 2020 through May 30, 2021. J. Consideration and Possible Action - Resolution No. F221-8 - A Resolution of the City Council of the City of Pearland, Texas, amending a unit -price service contract for preventative maintenance and repairs on standby generators with LJ Power Generators, in the additional amount of $32,000.00 (total of $122,000.00), for the period of January 30, 2021 through January 29, 2022. K. Consideration and Possible Action - Resolution No. R2021-59 - A Resolution of the City Council of the City of Pearland, Texas, amending a unit price maintenance and repair bid for HVAC Systems & Ice Machines with TD Industries, in the additional amount of $65,000.00 (total of $267,000.00), for the period beginning July 'i; 2020 through June 30, 2021. L. Consideration and Possible Action - Resolution No. R2021-60 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a contract with E Contractors and ratifying emergency expenditures, in the amount of $151,968.00, for emergency repairs to City facilities during the February 2021 Texas Severe Winter Storm. Councilmember Orlando made the motion, seconded by Councilmember Little, to adopt Consent Agenda Items A through L, with the exception of Consent Agenda Items B, E, 1, J, and L. AYES: Orlando, Carbone, Kamkar, Hernandez, Little, Owens. NAYS: None. The motion carried. NEW BUSINESS 1. Consideration and Possible Action - Resolution No. R2021-39 - Resolution of the City Council of the City of Pearland, Texas, approving the Multi -Modal Master Plan as a planning tool to compliment the use of the City's Comprehensive Plan. Councilmember Kamkar made the motion, seconded by Mayor Pro -Tem Hernandez, to postpone New Business Item Number One (1) for 30 days. AYES: Kamkar, Owens. NAYS: Orlando, Carbone, Hernandez, Little. Consideration and Possible Action - Resolution No. R2021-61- '1- A Resolution of the City Council of the City of Pearland, Texas, accepting the City's comprehensive annual financial report for fiscal year 2020 and the accompanying independent audit as presented by the accounting firm of BKD, LLP. Councilmember Carbone made the motion, seconded by Councilmember Little, to adopt Resolution N. R2021-61. AYES: Orlando, Carbone, Kamkar, Hernandez, Little, Owens. NAYS: S: Non . The motion carried. Resolution No. R2021-61 is adopted. 3. Council Input and Discussion - FY 21 and FY 22 Allocations - U.S. Department of Housing & Urban Development Community Development Block Grant DDB and CDBG Coronavirus stimulus funds. No action taken. 4. Consideration and Possible Action- Second and Final Reading Ordinance N. 220- 12 - An Ordinance of the City Council of the City of Pearland, Texas, amending Chapter 30, Utilities, Article 1, IN GENERAL, and Article 1I, RATES AND CHARGES, of the code of ordinances; providing a penalty for violation; contain-ing a savings clause and a severability clause; providing for codification, publication, and an effective date. Councilmember Kamkar made the motion, seconded by Councilmember Little, to adopt Ordinance No. 220-12. AYES: Orlando, Carbone, Kamkar, ar, Hernandez, Little, Owens. NAYS: None. The motion carried. Consideration and Possible Action - Resolution No. R2021-62 2 - A Resolution of the City Council of the City of Pearland, Texas, authorizing 'a contract with Rogue Water for development and implementation of a water service communication plan, in the estimated amount of $52,800.00. Consideration and Possible Action - Resolution No. R2021-47 21-4 A Resolution of.the City Council of the City of Pearland, Texas, renewing a software maintenance contract with Tyler Technologies, Inc., for software maintenance services, in the amount of $141,186.15. Mayor Pro -Tem Hernandez made the motion, seconded by Councilmember Little, to adopt Resolution No. R2021-47. AYES: Orlando, Hernandez, Little, Owens. NAYS: Carbone, Kamkar. The motion carried. Consideration and Possible Action Resolution No. R2 21- 3 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the power of eminent domain to a fee title interest, a sanitary sewer easement, and a temporary construction easementon certain property for public infrastructure improvements (road and sewer); being tracts of land containing 0.3468 acre (15,106 square feet), a 0.2554 acre (11,125 square feet) and a temporary construction easement, located within the H.T.&B.R.R. .F . C . Survey, Abstract -549, Brazoria County, Texas and being a portion of Lot 5 I of the Allison Richey Gulf Coast Home Company Subdivision, Section 24 recorded in Volume 2, Page 89 of the Brazoria County Plat Records (B,C.P.R.). Said 0.3468 and 0.2554 acre tracts also being a portion of Lot 51 recorded in the name of Nguyet Thi Doan, Et AI in Brazoria County Clerk's File (B.C.C.F.) Number (No.) 95-038285, for the construction and maintenance of public improvements on certain real property described herein; authorizing the city attorney, or his designee, and: other city officials to take such actions as are necessary to acquire said property, located within the city, by donation, purchase, or by the exercise of the power of eminent domain.
