A Resolution of the City Council of the City of Pearland, Texas, authorizing
the power of eminent domain to a fee title interest, on certain property for
public infrastructure improvements (road); being a tract of land containing
0.2840 acre (12,372 square feet), located within the H.T.&B.R.R. Co. Survey,
Abstract-245, Brazoria County, Texas and being a portion of Lot 9 of the
Allison Richey Gulf Coast Home Company Subdivision, Section 25
recorded in Volume 2, Page 10 of the Brazoria County Plat Records
(B,C.P.R.). Said 0.2840 tract being a portion of called the south 1/2 of Lot 9
recorded in the name of Donald W. Simmons in Brazoria County Clerk's
File (B.C.C.F.) Number (No.) 2013005489, for the construction and
maintenance of public improvements on certain real property described
herein; authorizing the city attorney, or his designee, and other city
officials to take such actions as are necessary to acquire said property,
located within the city, by donation, purchase, or by the exercise of the
power of eminent domain.
WHEREAS, the City Council recognizes that a public convenience and necessity exists
for the location, construction, operation, and maintenance of public infrastructure improvements
(road) on certain real property described herein; and
WHEREAS, accordingly, the City Council hereby acknowledges that it is in the public's
best interest to acquire a fee title interest on certain property; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1. The City Council hereby finds and determines that a public convenience
and necessity exists for the construction of public infrastructure improvements (road) on certain
real property located in Brazoria County, Texas.
Section 2. The public convenience and necessity requires the acquisition of a fee
title interest, by donation, purchase, condemnation, or otherwise, of certain real property
located within the City and situated in Brazoria County, more particularly described in
Exhibit "A", attached hereto and incorporated herein for all purposes.
Section 3. The City Attorney, or his designee, and other City officials are hereby
authorized and directed, on behalf of the City to take such actions as are necessary to acquire
the property interest, described in Exhibit "A", either by donation, purchase or the exercise of
the power of eminent domain.

tract being a portion of called the south 1/2 of Lot 9, recorded in the naive of Donald W.
Simmons in Brazoria County Clerk's File (B.C.C.F.) Number (No.) 2013005489. Said
0.2840 acre tract being more particularly described by metes and bounds as follows (all.
bearings are referenced to the Texas Coordinate System of 1983 (NAD83), South Central
Zone):
COMMENCING at a 5/8-inch iron rod with cap stamped CL Davis found on the south
right of way line of Bailey Road (C.R.101) (width varies as per B.C.C.F. No.
2010045209) at the most northerly cut back corner of said Lot 1;
Thence, South 42 degrees 19 minutes 08 seconds West, a distance of 39.82 feet along
said cut back line to an angle point on the proposed east right of way line of, Harkey Road
(C.R.103) (width varies as per Volume 2, Page 10, B.C.P.R.);
Thence, along said proposed east right of way line, South 02 degrees 41 minutes 30
seconds East, a distance of 4450.44 feet to a 5/8-inch iron rod with cap stamped Miller
Survey Group (MSG) set for the POINT OF BEGINNING of the herein described tract,
on the south line of a portion of called north 1/2 of Lot 9 recorded in the name of Dora
Valdez in B.C.C.F. No. 2010048072;
Thence, continuing along said proposed east right of way line, South 02 degrees 41
minutes 30 seconds Bast, a distance of 247.32 feet to a 5/8-inch iron rod with cap
stamped Miller Survey Group (MSG) set for the southeast comer of the herein described
tract on the common south line of the south 3 /2 Lot 9 and the north line of called 1.01
acres recorded in the name of William Curtis Sams in B.C.C.F. No. 2017005123;
Thence, departing said proposed east right of way line, South 87 degrees 06 minutes 31
seconds West, at 15.55 feet passing a 1/2-inch iron rod found in the existing occupied
right of way line, for a total distance of 50.00 :feet to an angle point in Harkey Road;
Thence, North 02 degrees 41 minutes 30 seconds West, a distance of 247.50 feet to an
angle point in Harkey Road;
