PEARLAND, TEXAS, TO BE HELD ON MONDAY, AUGUST 16, 2010, AT 6:30 P.M.
IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND,

Mayor Reid called the meeting to order at 8:40 p.m. with the following present:

PURPOSE OF HEARING — PROPOSED ANNEXATION OF APPROXIMATELY 307
ACRES — AREAS 3 & 4
307 ACRES OF LAND, MORE OR LESS, AREA GENERALLY LOCATED ALONG CR
48 (KINGSLEY DRIVE) SOUTH OF BROADWAY STREET, AND NEAR THE
INTERSECTION OF CR 59 AND CR 48.
STAFF REVIEW OF THE FEASIBILITY PLAN AND SERVICE PLAN:
Planner II Evan Duvall stated the total area for Area No. 3 and 4 is 307 acres with 105
acres of that being vacant. The uses are predominately residential with some
commercial and vacant land. The proposed zoning is RE Single Family Estate and the
appraised value is $11,456,520. The water and waste water for the area would be
provided by a water and waste water facility that is planned for the west side of the City.
CITIZEN COMMENTS:
Louis Hearn, Jr., 4142 CR 48, addressed Council and stated he has property located in
Area No. 3 and 4. He has his own water system that was very expensive for him to
have installed. It is his understanding that if a property comes within 300-feet of a major
trunk line then the owner can be forced to abandon his water system and he would like
to verify if that is true or not. He would also like to know if the Economic Development

Corporation is working on a plan to improve the industry in the area to counter the
foreclosure problem in the area. The City needs to thoroughly evaluate the annexation
plan before placing a burden on the residents in the area.
Gerard Hausen, 2807 Honeysickle, addressed Council and stated he is not positive that
he is included in the area being annexed, but would like to verify if he is. The residents
in his area have taken care of themselves and have done a good job of it. The people
are doing fine the way they are and he would like to know the City's plan. He
appreciates the City, however, he did not ask to be part of the Extraterritorial
Jurisdiction (ETJ) and would like to know if there is a way to get out of it.
COUNCIL/STAFF DISCUSSION:
City Attorney Darrin Coker stated the areas in question have been included in the City's
Extra Territorial Jurisdiction (ETJ) since 1963. The ETJ is land that is not within the City
limits; however, the City has the option to annex the land when they choose. Residents
do not have the option to be removed from the ETJ.
Councilmember Owens stated property that is outside of the City's ETJ would be
included in another city's ETJ and would eventually be annexed.
City Manager Bill Eisen stated the Pearland Economic Development Corporation has
and will continue to work to develop commercial expansion in the City. This will include
this area after it is annexed.
Councilmember Owens stated he is not aware of a law that requires residents to utilize
water services even if they are within 300-feet of the lines.
Assistant City Manager Mike Hodge stated the citizens would be required to pay the
impact fee to tie into the City's water and sewer services. They would also incur cost for
the actual connection to their property, the meter, and the meter box. The citizens are
not required to connect to the City's service. The City will also take over the
maintenance of the county roads, but there are no current plans to construct any new
public roads.
