IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS Mayor Reid called the meeting to order at 8:04 p.m. with the following present: Mayor Tom Reid Mayor Pro-Tem Scott Sherman Councilmember Woody Owens Councilmember Steve Saboe Councilmember Felicia Kyle Councilmember Ed Thompson City Manager Bill Eisen City Attorney Darrin Coker City Secretary Young Lorfing Others in attendance: Jon Branson Assistant City Manager; Danny Cameron Public Works Director; J.C. PURPOSE OF HEARING — PROPOSED ANNEXATION OF APPROXIMATELY 189 ACRES — AREA 2 189 ACRES OF LAND, MORE OR LESS, AREA GENERALLY LOCATED SOUTH OF BAILEY ROAD FROM FM 1128/MANVEL TO VETERANS ROAD. STAFF REVIEW OF THE FEASIBILITY PLAN AND SERVICE PLAN: Planner II Evan Duvall stated the total acreage for Area No. 2 is 189 acres of which 51 acres are vacant. There are a multitude uses in the area including mostly residential, but also commercial and vacant property. The proposed zoning for the area is RE Single Family Estate and the appraised value is $9,353,520. The action plan for this area is similar to the previous areas discussed except that a future 18-inch and 24-inch water line is planned along Bailey Road. The project is currently defined as a long-term project and is not included in the 5-year Capital Improvement Projects Plan. There are planned road improvements including the widening of several streets in the area. The area is considered low -density residential, however, it does include several minor retail nodes that are planned for commercial uses. Page 1 of 3 — 8/16/2010 CITIZEN COMMENTS: Karen Murganthali, 6513 Grace Lane, addressed Council and stated she is concerned about the condition of Bailey Road and the traffic that is currently utilizing the road. When it rains there is nowhere to get off the road. The road is dangerous for the cars and school buses and nothing has been done to change the conditions. She is also concerned about flooding issues being caused in her area by construction plans. Mary Spencer, 16654 Berry Road, addressed Council and stated she would like to know what is the benefit of the City annexing this small area. The people living in her area are mostly older people that don't have anywhere to go if they decide to sell their homes. They have great service from the Sheriffs Office and the Fire Service currently serving the area. Ray Hill, 5806 Bailey Road, addressed Council and stated it has been brought up that the residents have had very little warning for the annexation. He is serviced by a private water company and has his own septic system that he is happy with and is environmentally friendly. His property taxes are going to go up approximately 30% to 40% and he is concerned about the cost. Frank Martinez, 4102 Veterans Drive, addressed Council and stated he owns property in Area No. 2 that he leases as a commercial use and he is concerned about how the proposed zoning is going to affect his property value. He also has an issue with the notification process and he feels badly about how many people do not know they are being annexed by the City. Lupe Cortez, 7520 Lester, addressed Council and stated he has property located in Area No. 2 that he would like to be zoned as commercial. Lynn Nixon, 16509 Herridge, addressed Council and stated she spoke during the Public Hearing for Area No. 1; however, she is located in Area No. 2. If the City annexes Area No. 2 it needs to look into a public transportation system and more sidewalks. She would also like to see the City develop a plan for the Bailey Road Project to prevent flooding in her area after the construction. COUNCIL/STAFF DISCUSSION: Assistant City Manager Mike Hodge stated Staff is still working out the details of the Bailey Road Project with Council. The current plan is for construction to begin late in 2010. Staff is planning miscellaneous repairs to the current roadway prior to the project. The roadway is designed to have underground storm sewer systems which will replace the ditch that is currently located on Bailey Road. There is also a major Drainage Project being planned which will put in a diversion channel that will prevent flooding in the area. The detention work will be completed in approximately six to eight months. The residents will have the option to keep their current water systems. Residents that choose to obtain water service from the City are not required to also use the sewer Page 2 of 3 — 8/16/2010 services except for under certain circumstance. Brazoria County is currently updating the floodplain maps. The City performed map revisions to the floodplain in the area and significantly decreased it. The planned projects for Area No. 2 will improve the floodplain area when completed. City Attorney Darrin Coker stated the notice of annexation is legally required to be sent to the landowner specified on the tax records for the property. He also clarified the qualifying date for anything to be covered under the grandfather clause is the day before the annexation. Councilmember Kyle stated the purpose of sending the notice to the property owner listed on the county tax records is to ensure the notice is sent to the owner of the property. There are instances where the resident on the property is not the actual property owner. Assistant City Manager Jon Branson stated, at this time, there is no mass transit plan in or around Brazoria County. Mayor Reid asked that the question, of when the Fire, EMS, and Police services would begin for the area being annexed, be answered. City Manager Bill Eisen stated the City currently provides the area with Fire, EMS, and Police services because it is located in the Extraterritorial Jurisdiction.
