IN THE COUNCIL CHAMBERS, CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Mayor Reid called the meeting to order at 6:30 p.m. with the following present: Mayor Tom Reid Mayor Pro-Tem Greg Hill Councilmember Tony Carbone Councilmember Scott Sherman Councilmember Keith Ordeneaux City Manager Bill Eisen City Attorney Darrin Coker City Secretary Young Lorfing Absent: Councilmember Susan Sherrouse. PURPOSE OF HEARING - PROPOSED ANNEXATION OF APPROXIMATELY 20- ACRES OF LAND, MORE OR LESS, GENERALLY LOCATED EAST OF CR107F, NORTH OF BAILEY RD., AND WEST OF MANVEL RD. City Planner Harold Ellis reported this is a request by Kevin Cole, applicant for Tin Dinh, Owner. Mr. Cole has petitioned the City of Pearland to annex an approximately twenty acre tract of land, located on the east side of County Road 107 F, north of Bailey Road, and west of Manvel Road. The property east of the tract subject to annexation includes approximately twenty acres, is under common ownership and was annexed into the City in 2001. This adjacent tract is zoned Single -Family Estate District. As indicated by the Service Plan, the City will be able to service the possible annexation area with existing resources. He further reported Staff recommends approval of the annexation of the subject twenty acre tract located on the side of County Road 107F, north of Bailey Road, and west of Manvel Road because the property is located within the City's Extra - Territorial Jurisdiction (ETJ) and will eventually become a part of the City of Pearland. By annexing the property prior to development, the City is able to prevent non- conforming issues that may potentially occur if the property develops while in the ETJ. The Annexation of the subject property into the City of Pearland will ensure that future growth is guided by the Future Land Use Plan of the Comprehensive Plan, Unified Development Code, and other City regulations. Additionally, the City will be in a better position to provide safeguards against unplanned and unregulated growth for current Page 1 of 3 — 12/9/2013 and future residents of Pearland. The proposed annexation is being initiated by the owner and will not affect nearby properties in a negative manner. It will give assurances to nearby property owners that development on the property will be subject to City of Pearland regulations. Kevin Cole stated he is looking at this property for a development opportunity. The property is split into two twenty acre tracts. The western tract is outside the City of Pearland and the eastern tract is inside the City of Pearland. He feels it would be in the best interest of the overall project to make a forty acre tract opportunity. Therefore requesting from the City and following the guidelines of the City to make it a cohesive development. CITIZEN COMMENTS: Terry Woods, 3525 Charles Avenue, addressed Council stating he owns property with a home next to the property in discussion. He stated he has had drainage issues ever since Berry Miller Jr. High was built. His concern is it will cut off all the natural drainage on his property from this development. COUNCIL/STAFF DISCUSSION Councilmember Carbone asked Staff to speak on the drainage issue. City Planner Harold Ellis stated drainage would be taken into account at the time of plating. Deputy Director/City Engineer Andrea Broughton stated the drainage plan for that site is required to be submitted, reviewed and approved prior to final plat approval. When reviewing the plans the City takes into consideration any drainage issues with neighboring or adjacent properties. Kevin Cole stated the development company has to be able to maintain what is pre - developed as well as post -developed and move the drainage through the property where it should naturally go. He further stated it is illegal to block a drainage flow and he has no problem working with Mr. Woods to correct the drainage issue. Deputy Director/City Engineer Andrea Broughton stated the Engineering Department will review the drainage plan and make sure the drainage is not blocked. She further stated she would reach out to Mr. Woods to get the drainage problem corrected.
