2018-06-11 CITY COUNCIL REGULAR MEETINGMINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, HELD ON JUNE 11, 2018 AT 6:30 PM, IN THE COUNCIL CHAMBER, PEARLAND CITY HALL, 3519 LIBERTY DRIVE, PEARLAND, TEXAS. Mayor Reid called the meeting to order at 6:30 p.m. with the following present: Mayor Tom Reid Councilmember Tony Carbone Councilmember Gary Moore Councilmember J. David Little Councilmember Trent Perez Councilmember Woody Owens City Manager Clay Pearson City Attorney Darrin Coker City Secretary Young Lorfing Absent: Councilmember Derrick Reed and Keith Ordeneaux Others in attendance: Jon Branson Deputy City Manager, Matt Buchanan President of Economic Development, Trent Epperson Assistant City Manager, Johnny Spires Chief of Police, Robert Upton City Engineer, Skipper Jones Assistant Director of Capital Projects, John McCarter Budget Officer, Chris Orlea Director of Parks and Recreation, Kim Sinistore Executive Director CVB, Andrea Brinkley Assistant Director of Public Works and John Knight IT Manager The invocation was given by Councilmember Moore and the Pledge of Allegiance was led by Deputy City Manager Jon Branson. CITIZEN COMMENTS: Melissa Washington 2903 Amber Hill Trail spoke on behalf of the Chamber of Commerce thanking City Council for the continued support of business in Pearland and also the Councilmembers that participated in the "Conversation with a Councilmember" event. She also wanted to announce that Councilmembers Owens and Little will be joining the next session. She also thanked the voters and reminded of ongoing election. PUBLIC HEARING: NONE CONSENT AGENDA: A. Approval of Minutes: 1. Minutes of April 23, 2018, Regular Meeting held at 6:30 p.m. B. Council Action — Resolution No. R2018-102 - A Resolution of the City Council of the City of Pearland, Texas, amending an Advanced Funding Agreement with the Texas Department of Transportation ("TxDOT"), for the Hughes Ranch Road Improvement Project (Cullen Parkway to Smith Ranch Road). Pearland Regular Meeting Agenda June 11, 2018 C. Council Action — Resolution No. R2018-107 - A Resolution of the City Council of the City of Pearland, Texas, authorizing a unit supply contract for emergency repairs (Natatorium) with K.R. Allen, in an amount not to exceed $100,000.00, for the period ending September 30, 2018. Councilmember Carbone made the motion, seconded by Councilmember Moore to adopt Consent Agenda Items A through C. Voting "Aye" Councilmembers Carbone, Moore, Little, Perez and Owens Voting "No" None. Motion passed 5 to 0 MATTERS REMOVED FROM CONSENT AGENDA: None NEW BUSINESS: Council Action — First Reading of Ordinance No. 1494-2 - An Ordinance of the City Council of the City of Pearland, Texas, amending Ordinance No. 1494, establishing prima facie speed limits established for vehicles under the provisions of section 545.356, Texas Transportation Code, upon certain streets and highways, of parts thereof, within the corporate limits of the City of Pearland, as set out in this ordinance and providing a penalty. (Bailey from FM1128 to Veterans and Broadway from FM521 to SH288) Councilmember Moore made the motion, seconded by Councilmember Little to approve Ordinance No. 1494-2 City Manager Clay Pearson reported that this is a request for an Ordinance to set a speed limit in Bailey Road after the speed survey and an amendment to existing speed limit on Broadway from FM521 to SH288 Councilmember Perez states that when the speed study was done on Broadway and limits went from 40 mph to 45 mph the study done at 42 mph and asked if it is being lowered to accommodate the school zone. City Engineer Robert Upton states that speed study was done at 42.7 mph and based on the travel patterns staff is requesting the speed limit to round down to 40 mph. Councilmember Little asked if Magnolia was included in the last speed study and are there plans to increase that speed from 35 mph. City Engineer states that the speed limits vary but in that area there are curves and school zones and there is no plan to increase the speeds. Motion passed 5 to 0 Consideration and Possible Action — Resolution No. R2018-100 - A Resolution of the City Council of the City of Pearland, Texas, confirming the contract term for the City's Fire Department Dispatch Services Agreement with Cypress Creek EMS as a three (3) year term ending on December 15, 2019, and authorizing estimated expenditures of $474,000.00 for the remaining term. Councilmember Little made the motion, seconded by Councilmember Moore to approve Resolution No. R2018-100 City Manager Clay Pearson reported that this a contract just a clean-up for dispatch on Emergent Medical Services and renewal terms were unclear. This will renew for another 3 years with Cypress Creek. Voting "Aye" Councilmembers Carbone, Moore, Little, Perez and Owens Voting "No" None. Motion passed 5 to 0 Consideration and Possible Action — Resolution No. R2018-83 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to enter into an Interlocal Agreement with Brazoria County for paving services, for the period of October 1, 2017 through September 30, 2018. Councilmember Perez made the motion, seconded by Councilmember Moore to approve Resolution R2018-83 City Manager Clay Pearson reports City if Pearland pays taxes to Brazoria County and has been working closely to use those funds to refurbish city roads. This Resolution is to identify the roads the will be refurbished. Councilmember Perez asked for clarification on how these roads are chosen because there are dead end roads on the plan that do not require the repairs as much as others. Councilmember Perez does not want to change the roads, but would like to know how roads will be chosen in the future. City Engineer Robert Upton states that it is a combination of the Pavement Index rating and work with the county. Robert Upton also stated that the county chooses roads based on use. City Manager Clay Pearson states they are also picking roads that will not affect the drainage plan and some roads will exacerbate the drainage issue. Pearland Regular Meeting Agenda June 11, 2018 Councilmember Perez asked at what point we tie in our Capital Improvement Program into road selections so we do not fix roads that will be reconstructed. City Engineer Robert Upton states the McHard project is far off and we are honoring the order of roads discussion from years prior. Councilmember Perez asked if there was a timeframe that the McHard Road project will begin. City Engineer Robert Upton states that the plan is for late next year and it is in land acquisition at this point and once that happens we will start in 2019. City Manager Clay Pearson states the Thursday package has an end date in 2022 for the McHard project. Assistant City Manager Trent Epperson states that it is a two year construction plan and the roads need to be able to hold up to the construction traffic and construction phase. Trent Epperson states in past projects roads that were thought to be able to hold up through construction had to be overlaid during construction to hold up. Voting "Aye" Councilmembers Carbone, Moore, Little, Perez and Owens Voting "No" None. Motion passed 5 to 0 Council Action — Resolution No. R2018-106 - A Resolution of the City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative pricing arrangement with Brazoria County for the purchase of emulsified asphalt for the recycling and application of asphalt streets from P Squared (P2) Emulsion Plants, LLC, in an amount not to exceed $150,000.00, for the period of June 12, 2018 through June 11, 2019. Councilmember Owens made the motion, seconded by Councilmember Moore to approve Resolution R2018-106. City Manager Clay Pearson reported that this is the agreement with Brazoria county for the asphalt on the streets that will be repaired. Mayor Reed asked for the difference in emulsified asphalt and regular asphalt. City Engineer Robert Upton stated it is just the formal name of asphalt and it refers to the binders in the asphalt. Councilmember Owens asked if we reclaim any of the asphalt from the projects and reuse them. City Engineer Robert Upton states that currently the asphalt is milled and put back in onsite. Pearland Regular Meeting Agenda June 11, 2018 Voting "Aye" Councilmembers Carbone, Moore, Little, Perez and Owens Voting "No" None. Motion passed 5 to 0 Council Action — Resolution No. R2018-101 - A Resolution of The City Council of the City of Pearland, Texas, authorizing the City Manager or his designee to participate in an interlocal cooperative pricing arrangement with Brazoria County for the purchase of hot mix asphaltic concrete from Century Asphalt, in an amount not to exceed $1,000,000.00, for the period of June 12, 2018 through June 11, 2019. Councilmember Carbone made the motion, seconded by Councilmember Moore to approve Resolution R2018-101 City Manager Clay Pearson reported that this is for the concrete portion of the road work. Voting "Aye" Councilmembers Carbone, Moore, Little, Perez and Owens Voting "No" None.
