Ord. 1239 01-23-06 ORDINANCE NO. 1239 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, GRANTING A VARIANCE REQUEST FOR THE ISSUANCE OF A BUILDING PERMIT PRIOR TO THE COMPLETION OF THE PUBLIC INFRASTRUCTURE. WHEREAS, Memorial Hermann Hospital System ("MHHS") desires to construct a Memorial Hermann healthcare facility on a tract of land located at the intersection of FM 518 and SH 288 and more accurately depicted on Exhibit II A" attached hereto; and WHEREAS, the City Council of the City of Pearland understands the urgent need for healthcare facilities to serve the residents of the City and surrounding communities; and WHEREAS, in an effort to construct a healthcare facility in a prompt and efficient manner, MHHS has requested a variance to allow the issuance of a building permit prior to the completion of the public infrastructure associated with the project; and WHEREAS, the City Council of the City of Pearland, for the limited purpose of developing a healthcare facility in the City, desires to authorize the above referenced variance; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. The City Council of the City of Pearland hereby grants a variance to MHHS for the issuance of a building permit prior to the completion of the public infrastructure for the proposed healthcare facility. ORDINANCE NO. 1239 Section 2. The variance contemplated herein is contingent upon the City's receipt, from the contractor for which the building permit is issued, of a Payment and Performance Bond naming the City as a Dual Obligee under the bonds. Section 3. Savings. All rights and remedies which have accrued in favor of the City under this Ordinance shall be and are preserved for the benefit of the City. Section 4. Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise unenforceable by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 5. Repealer. All ordinances and parts of ordinances In conflict herewith are hereby repealed but only to the extent of such conflict. Memorial Hermann, Transwestern, DASCO Companies, LLC, and Dannenbaum Engineering Corporation together have reviewed the City's concerns and offer the following responses. We are requesting to be placed on the City Counsel meeting agenda for January 23, 2006. ./ Item (1) - Memorial Hermann Drive and TxDOT approval for access to Hwy 288: o The plat submission will not include a proposed connection to State Hwy 288. o Dannenbaum Engineering met with TxDOT relative to the proposed tie in of Memorial Hermann Drive to the future SH 288 feeder road. The proposed tie in meets TxDOT guidelines, however a written statement will not be provided until the design is finalized. ./ Item (2) - City of Pearland needs a sewer easement on the south side of Broadway. MUD 35 met on January 6th and took action on a resolution to seek condemnation if necessary to acquire the land. ./ Item (3) - Relocation of BDD4 drainage channel: o A Drainage Study for the property was approved by Brazoria County two years ago. Since that time, portions of the watershed have been re-routed, thus reducing the flow to this channel. o Detention basin construction plans were submitted on November 10th and the plat and paving, box culvert, storm sewer, water and sewer plans for Business Center Drive and Memorial Hermann Drive on November 14th. BDD4 approved the plans on January 11, 2006. o Neither the existing or proposed location of the channel interferes with the Memorial Hermann planned building location. ./ Item (4) - The Traffic Impact Analysis has been completed and all traffic patterns and road way alignments, widths, functions, etc. have been determined. Transwestern is working with the city to determine appropriate allocation of costs and responsibilities of improvements. This should be settled prior to plat approval. ~ ./ Item (5) - Previously, city staff had voiced concern over limited access to site would make it difficult for the city to make inspections: o Transwestern will be installing an all weather road capable of supporting heavy cranes, concrete trucks and other construction equipment during all weather conditions. o Road will be more than capable of providing access for all city vehicles. o Road will be constructed from the Shadow Creek extension of BCD or from Broadway. ./ Item (6) - Previously, city staff had voiced concern over no ambulance or fire truck access and no water for fire-fighting: o As stated in #5, an all weather access drive will be constructed and will provide access for emergency vehicles. o Water will be provided to the site from a permanent extension of the 12" water main along the Shadow Creek portion of BCD or from an installation of service from Broadway. o MHHS and DASCO agree and understand that no combustible construction can begin within the building structure until fire hydrant connection(s) are inspected and approved by the City o MHHS and DASCO understand that a building permit for the MHHS suite spaces will not be granted until the fire hydrant system is inspected and approved by the City. ./ Item (7) - Previously, city staff had voiced concern over tenants or developer asking for an occupancy permit prior to the completion and acceptance of the utilities and public improvements: o MHHS and DASCO agree that occupancy before the completion and acceptance of the utilities and public improvements will not be allowed and that both parties will not make a request for occupancy under these conditions. o City will allow for the construction of the shell building, related building site work and MHHS improvements (Ambulatory Surgery Center, Diagnostic Imaging & MHHS office spaces, if any) but will be subject to constraints as listed within the requirements of this document. o Tenant suites (physician and commercial suites, if any) will not be submitted for building permit until such time the City of Pearland has approved the utilities and public improvements. If submitted, permit request will be denied by the City. Additional Items: ./ Project Phasing: (see attached schedule) o Preliminary Plat submission (completed) o Variance approval o Building permit & construction for shell building and building site work o Construction of all-weather road and water service to property o Building permit for MHHS spaces subject to City inspection and approval of fire hydrant system o Submission & approval of Final Plat (including city staff review) o Construction of utilities and public improvement o Completion & acceptance of utilities and public improvements o Issuance of Occupancy Certificate for shell building and suites · Occupancy Certificates are subject to all normal conditions: .
