(PUD(S)) AT THE REQUEST OF JAMES P. DEY, APPLICANT FOR SBC,
OWNER, PROVIDING FOR AN AMENDMENT OF THE LAND USE DISTRICT
MAP; CONTAINING A SAVINGS CLAUSE, A SEVERABILITY CLAUSE, AN
EFFECTIVE DATE AND OTHER PROVISIONS RELATED TO THE SUBJECT.
WHEREAS, James P. Dey, applicant for SBC, owner, filed on October 24,
2005, an application for amendment pursuant to Section 28 of Ordinance No. 509, the
Land Use and Urban Development Ordinance of the City, for approval of a change in
the land use as provided for in said Section 28, said property being legally described
in the original applications for amendment attached hereto and made a part hereof for
all purposes as Exhibit "A"; and
WHEREAS, on the 21st day of November, 2005, a Joint Public Hearing was
held before the Planning and Zoning Commission and the City Council of the City of
Pearland, Texas, notice being given by publication in the official newspaper of the
City, the affidavit of publication being attached thereto and made a part hereof for all
purposes, as Exhibit "B", said call and notice being in strict conformity with provisions
of Section 28.3 and 28.4 of Ordinance No. 509; and

WHEREAS, on the 1st day of December, 2005, the Planning and Zoning
Commission of the City submitted its report and recommendation to the City Council
regarding the proposed amendment application by James P. Dey, applicant for SBC,
owner, whereby the Commission recommended approval of the change of
classification for the described property for a Specific Use Permit for Telephone
Exchange Switching Relay and Transmitting Equipment, in the Planned Unit
Development District — Shadow Creek Ranch Planned Unit Development (PUD(S));
and
WHEREAS, upon receipt of the report from the Planning and Zoning
Commission, the City Council considered this application and the recommendation of
the Planning and Zoning Commission at a regular meeting on December 12, 2005;
and
WHEREAS, the City Council having fully heard the testimony and argument of
all interested parties, and having been fully advised in the premises, finds that in the
case of the application of James P. Dey, applicant for SBC, owner, presented which,
in the judgment of the City Council, would justify the approval of said application; now,
therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
I.
The following described property located within the corporate City limits of the
City of Pearland, Texas, and presently classified as Planned Unit Development
District (PUD), is hereby granted a Specific Use Permit for Telephone Exchange
Switching Relay and Transmitting Equipment, in the Planned Unit Development
District — Shadow Creek Ranch Planned Unit Development (PUD(S)), such property

being more particularly described as:
0.062 acres of land located in the H.T. & B.R.R. Company Survey, Section 83,
Abstract 305, more particularly being a portion of that certain called 50.980
acre tract described as north one-half of Davis Tract in "Agreed Final
Judgement in Partition" of record under File No. 02-060920, Official Records of
Brazoria County, Texas and File No. 2002136052, Official Public Records of
Fort Bend County, Texas, City of Pearland, Brazoria County, Texas, and Fort
Bend County, Texas (Generally Located on the South Side of Spinnaker Bay
Drive, and East of Biscayne Springs Lane)
The Specific Use Permit is subject to the following condition:
1. All equipment for the telephone switching station be located within the
enclosed building.
II.
The City Council of the City of Pearland finds and determines that the recitations
in the preamble hereof are true and that all necessary prerequisites of law have been
accomplished and that no valid protest of the proposed change has been made. The
City Council further finds and determines that there has been compliance with the
mandates of law in the posting and presentation of this matter to the Planning and
Zoning Commission and to the City Council for consideration and decision.
III.
The City Council of the City of Pearland finds and determines that the
amendment adopted herein promotes the health, safety, and general welfare of the
public and is a proper valid exercise of the City's police powers.
IV.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance

is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such
holding shall not affect the validity of the remaining portions thereof.
V.
All rights and remedies, which have accrued in the favor of the City under this
Ordinance and its amendments thereto, shall be and are preserved for the benefit of
the City.
VI.
The City Secretary is hereby directed to cause to be prepared an amendment to
the official Land Use District Map of the City, pursuant to the provisions of Section 2 of
Ordinance No. 509 and consistent with the approval herein granted for the
reclassification of the herein above described property.
VII.
This Ordinance shall become effective after its passage and approval on second
and final reading.

Commission Member Iocco made a motion to recommend approval of the specific use
permit request, which was seconded by Commission Member Sherrouse. The motion
to approve passed 5 — 0. The specific use permit was recommended for approval by
the Planning and Zoning Commission. The Commissioners added the following
conditions to the approval of the specific use permit:
1. All equipment for the telephone switching station be located within the enclosed
building.
2. The applicant submit a landscape plan for the areas around the proposed
building (not the entire reserve), subject to review and approval by Staff, prior to

There was discussion on the landscaping. Mr. Dey stated he would

Vice -Chairperson Iocco amended his motion to approve with the
two staff comments listed in the staff report, and Commissioner
Sherrouse seconded.
The vote for approval of the amendment to the motion was 5-0.

Chairperson Ruby Sandars read the purpose into the record.
Senior Planner Grahmann gave the Staff Report.
Jim Dey, a representative of SBC, spoke on behalf of the applicant. He
stated that typically they don't landscape as everything is concrete, brick
building, roof, and wrought iron fence. The adjacent subdivision usually
does all the landscaping.
Michael Klaus of 5016 Groveton, Pearland, TX 77581 spoke, asking how
are other SBC locations maintaining infrastructures.
No one else spoke for or against this SUP.
Councilman Cole asked for clarification on the landscaping, asking if an
agreement was in place with Shadow Creek Ranch to do this. Brief
discussion ensued further on the landscaping issue between
Council/Commission/Staff.
The Public Hearing for Zone Change Application No. 1249 was adjourned

CONFORMANCE TO THE LAND USE AND URBAN DEVELOPMENT ORDINANCE: The
subject property is currently zoned PUD. The subject property is approximately 50 feet
wide and 40 feet deep, and is part of a larger property.
PLATTING STATUS: The subject property is part of a larger tract of land. The SBC site
is proposed to be located within a "Restricted Reserve A," which is restricted to
"landscape/open space." Based on the plat, the proposed building would not be permitted
within this restricted reserve. Therefore, the applicant or owner will be required to submit a
replat for the subject property in order to amend the restrictions, and the replat would have
to be approved and filed for record, prior to issuance of a building permit for the building.
CONFORMANCE TO THE THOROUGHFARE PLAN: The subject property has frontage
on Spinnaker Bay Drive, a collector street with a right-of-way of 80 feet that is to be
widened in the future as necessary.
No other roadways affect the subject property.
AVAILABILITY OF UTILITIES: City water and sewer service may not be necessary for the
building proposed for the subject property, but it will be available for the subject property
as utility lines are being constructed by the developer of the adjacent single family
residential subdivisions.

IMPACT ON EXISTING AND FUTURE DEVELOPMENT: If constructed according to the
guidelines suggested below, the building or switching cabinets on the subject property
should not have a negative impact on the adjacent neighborhoods.
SPECIFIC USE PERMIT CONSIDERATIONS: The following is a list of items that should
be considered as a part of the Specific Use Permit:
1. Building Facade. The applicant is proposing a small building that has a total height
of 13 feet. The building is proposed to have a brick exterior with hardi trim and a
pitched roof. Staff recommends that all equipment for the telephone switching
station be located within the enclosed building. Staff is of the opinion that the
proposed masonry exterior for the building should provide for an attractive
appearance that will blend in with the surrounding residential properties.
2. Fence. Staff is of the opinion that, if all equipment is located within the enclosed
building, a screening fence is not necessary.
3. Landscaping. The proposed building will be located within a reserve that is
restricted to landscaping and open space. It is Staffs understanding that the
reserve will be landscaped by Shadow Creek Ranch as the adjacent residential
subdivision is developed and Tots sold. However, Staff would like to review a
landscape plan for the area around the enclosed building in order to enhance the
view of the reserve and the building, to ensure that the building is in harmony with
the surrounding residential subdivisions. Staff recommends that the applicant
submit a landscape plan for the areas around the proposed building (not the entire
reserve).
PUBLIC COMMENTS: Public notice/comment forms were mailed to property owners
within 200 feet of the subject property under consideration. A legal notice of public hearing
was published in the local newspaper, and a Zoning Sign was placed on the subject
property.
STAFF RECOMMENDATION: Staff recommends approval of specific use permit, as
proposed by the applicant, for the following reasons:
1. The proposed specific use permit provides for a telephone switching station to
serve the nearby residential neighborhoods.
2. The proposed specific use permit does not conflict with the surrounding residential
neighborhoods.
3. If adequately buffered with landscaping, fencing, or masonry building facade, the

If the proposed specific use permit is approved, Staff recommends the following conditions
