R2002-0130 08-26-02 RESOLUTION NO. R2002-130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AWARDING A BID FOR THE REHABILITATION OF CLARIFIERS LOCATED AT THE LONGWOOD AND BARRY ROSE WASTE WATER TREATMENT FACILITIES. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1. That the City opened bids for rehabilitation of clarifiers located at the Longwood and Barry Rose Waste Water Treatment Facilities, and such bids have been reviewed and tabulated. Section 2. That the City Council hereby awards the bid to JTR, Constructors, Inc., in the amount of $362,452.00. Section 3. The City Manager or his designee is hereby authorized to execute a contract for rehabilitation of clarifiers located at the Longwood and Barry Rose Waste Water Treatment Facilities. These five bids were subsequently opened, read and recorded by City Purchasing Officer Gordon Island, in the presence of several bidders, yourself, and the undersigned. Copies of the bids and my tabulation are attached. JTR Constructors, Inc. (JTR), Houston, Texas, was the apparent low bidder, with a base bid of $362,452.00. JTR also submitted bids of $11,000.00 for Add Alternate 1 and $11,000.00 for Add Alternate 2. The total amount bid JTR with both alternates was $384,452.00. The base bid was for replacement of the galvanized steel weirs and troughs with new stainless steel equipment. The two alternates were for adding algae sweeps that would prevents algae from accumulating on the new equipment. Algae removal is currently done manually. Review of the five base bids showed what we consider to be a typical range and distribution of bid amounts. Review of the alternate bids revealed a significant difference between the total amount bid by JTR ($22,000.00) and the other four bidders. Totals for the two alternate bid items from the other four bidders ranged from $70,000.00 to $100,000.00. JTR has subsequently claimed an error was made in its bid for the alternate items, in a letter dated July 31, 2002 that was delivered to Klotz Associates several hours after the bid opening (copy enclosed). In substance, JTR stated that it erroneously assumed the price quoted by the algae sweep vendor was the total cost of the equipment for the entire project, not the cost for each of the four clarifiers. JTR has asked to withdraw both alternate bids. We have spoken with the algae sweep vendor and have been assured that all the bidders were quoted the same price. This price is comparable to cost information provided to us by this vendor during the design phase of the project. This information correlates to the significant difference between the amount bid by JTR and the four other bidders. In our opinion, there is no question that an error was made by JTR. KLOTZ ASSOCIATES, INC CONSULTING ENGINEERS Mr. Jerry Burns August 5, 2002 Page 2 The magnitude of this error is high relative to the total project cost. We believe it is unreasonable to expect JTR to perform the alternate bid items in this project for the bid amounts. The project bid documents (Section 01230, Sub -section 1.01 C) states that "...(B)ids will be evaluated without regard to Alternates. After determination of lowest bidder, consideration will be given to Alternates and Bid Price adjustments." This allows the City to accept the lowest base bid, and then either accept, reject or attempt to adjust the amount of the alternates. JTR has indicated the intended amount of its bids for the two alternate items should be four times the actual bid amount. Such an adjustment would increase each alternate to $44,000.00, and result in a total bid amount of $450,452.00. This amount is beyond the City's available funds for this project. The base amount bid by JTR is within the target budget. It should be noted that replacing the weirs and troughs at both WWTPs is the critical part of this project, and the algae sweeps were intended to be included if funds were available. Since this appears not to be the case after review of the bids, we recommend proceeding with the weir replacement and deferring the algae sweeps until next year. We reviewed qualifications and experience information provided by JTR with its bid. Based on that information, the firm and its principals appear to be qualified to undertake this project. We therefore recommend that the City of Pearland accept the base bid of JTR and enter into an agreement with that company to replace the weirs and troughs, in accordance with the project plans, specifications and related documents. Dear Mr. Neyens: The purpose of this letter is to notify you that JTR Constructors, Inc. submitted a Bid on the above reference project, but unfortunately, it has a mathematical error. The equipment supplier for the Algae Sweep Systems provided a quotation that was to be multiplied by four; which, we accidentally divided by four. Consequently, each alternate bid item must be multiplied by four. We apologize for this discrepancy and confusion; but during the bid process, the equipment supplier was out of reach to resolve and avoid this problem. We hope you concur with the above and accept our most sincerely apology for the inconvenience. Again, we apologize for this mathematical error and hope that we may withdraw our quotation on the Alternate Bid items. If you have any questions or require additional information, please advise.
