Ord. 1073 08-26-02ORDINANCE NO. 1073 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE A RELEASE AND EXCHANGE OF EASEMENTS TO ACCOMPLISH THE REALIGNMENT OF RIGHT-OF- WAY AT THE INTERSECTION OF FM 518 AND SUNRISE MEADOW DRIVE. WHEREAS, the City of Pearland owns a 3,585 square foot easement which includes property described by metes and bounds attached hereto as Exhibit "A" and depicted in the map attached hereto as Exhibit "B", such exhibits being incorporated herein for all purposes; and WHEREAS, the City of Pearland owns a 4,767 square foot easement which includes property described by metes and bounds attached hereto as Exhibit "C" and depicted in the map attached hereto as Exhibit "B", such exhibits being incorporated herein for all purposes; and WHEREAS, the Charles W. Kennedy, Jr. Trustee, ("Kennedy") owns a 8,862 square foot tract which includes property described by metes and bounds attached hereto as Exhibit "D" and depicted in the map attached hereto as Exhibit "B", such exhibits being incorporated herein for all purposes; and WHEREAS, the City of Pearland desires to exchange the easements described in Exhibits "A" and "C" for the easement described in Exhibit "D" to realign the right-of-way at the intersection of FM 518 and Sunrise Meadow Drive; and WHEREAS, the City has concluded that the exchange of property is equitable to both parties; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS: Section 1.That the City Council of the City of Pearland authorizes the City Manager or his designee to execute a release and exchange of easements to accomplish the realignment of right-of-way at the intersection of FM 518 and Sunrise Meadow Drive. ORDINANCE NO. 1073 Section 2.Savings. All rights and remedies which have accrued in favor of the City under this Chapter and amendments thereto shall be and are preserved for the benefit of the City. Section 3.Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise unenforceable by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Section 4.Repealer. All ordinances and parts of ordinances in conflict herewith are hereby repealed but only to the extent of such conflict. (1) The easement, rights, and privileges herein granted shall be perpetual or for so long as Grantee or its assigns shall utilize the easement for the urposes intended. The easement, nghTs and privileges granted hereunder shall terminate when, or at such time as the purposes hereof cease to exist, are abandpned by Grantee,. or become impossible of performance. The easement will also terminate if and when a final plat is filed which includes a properly dedicated road right -or -way covenng the easement granted herein. (2) This conveyance is made and accepted subject to any and all matters of record affecting the Easement Tract. The Grantee herein shall be considered the general public and the use of the easement shall be for public road purposes.. Nothing herein shall obligate any public entity to accept or maintain any facilities constructed in said easement. (4) Grantor does not, by the granting of this easement, assume or undertake any responsibility for the construction or permanent maintenance of a public road on the right-of-way dedicated herein and nothing contained herein shall alter, amend, or modify any other agreements or obligations regarding road constructions. (3) TO HAVE TO HOLD the above described easement for the said purposes, together with all and singular, the rights privileges, and appurtenances as described above in anywise belonging to the said Grantee, it's successors and assigns forever, subject to the limitations set forth herein above.
