AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PEARLAND, TEXAS, AUTHORIZING THE CITY MANAGER OR HIS
DESIGNEE TO EXECUTE A RELEASE AND EXCHANGE OF
EASEMENTS TO ACCOMPLISH THE REALIGNMENT OF RIGHT-OF-
WAY AT THE INTERSECTION OF FM 518 AND SUNRISE MEADOW
DRIVE.
WHEREAS, the City of Pearland owns a 3,585 square foot easement which
includes property described by metes and bounds attached hereto as Exhibit "A" and
depicted in the map attached hereto as Exhibit "B", such exhibits being incorporated
herein for all purposes; and
WHEREAS, the City of Pearland owns a 4,767 square foot easement which
includes property described by metes and bounds attached hereto as Exhibit "C" and
depicted in the map attached hereto as Exhibit "B", such exhibits being incorporated
herein for all purposes; and
WHEREAS, the Charles W. Kennedy, Jr. Trustee, ("Kennedy") owns a 8,862
square foot tract which includes property described by metes and bounds attached
hereto as Exhibit "D" and depicted in the map attached hereto as Exhibit "B", such
exhibits being incorporated herein for all purposes; and
WHEREAS, the City of Pearland desires to exchange the easements described
in Exhibits "A" and "C" for the easement described in Exhibit "D" to realign the
right-of-way at the intersection of FM 518 and Sunrise Meadow Drive; and
WHEREAS, the City has concluded that the exchange of property is equitable to
both parties; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PEARLAND, TEXAS:
Section 1.That the City Council of the City of Pearland authorizes the
City Manager or his designee to execute a release and exchange of easements to
accomplish the realignment of right-of-way at the intersection of FM 518 and Sunrise
Meadow Drive.
ORDINANCE NO. 1073
Section 2.Savings. All rights and remedies which have accrued in favor of the
City under this Chapter and amendments thereto shall be and are preserved for the
benefit of the City.
Section 3.Severability. If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is for any reason held invalid, unconstitutional or otherwise
unenforceable by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct, and independent provision and such holding shall not affect the
validity of the remaining portions thereof.
Section 4.Repealer. All ordinances and parts of ordinances in conflict
herewith are hereby repealed but only to the extent of such conflict.

THAT CHARLES W. KENNEDY .JR.,TRUSTEE, (herein. called "Grantor"), and
CITY OF PEARLAND (herein called Grantee) for TEN and No/100 Dollars ($10.00)
paid by each to the other for other good and valuable consideration, the receipt and
adequacy of which are hereby acknowledged, do hereby make the following grant in
substitution and release of easement.
The GRANTOR herein has GRANTED. BARGAINED, SOLD, ASSIGNED,
TRANSFERED, CONVEYED, and DELIVERED and does by_these presents
GRANT, BARGAIN, SELL, ASSIGN, 'TRANSFER, CONVEY, and DEDICATE
unto the City of Pearland (herein called"Grantee"), an easement in substitution over,
across, and through the following described property situated in Brazoria County,
Texas, to -wit:
8862 square feet Tract of Land within Lot 7 of the Allison Richey Gulf Coast Survey
Abstract 309 Brazoria County Texas as shown in Exhibit "A " attached hereto and
made it part hereof for all purposes and being described by metes and bounds in
Exhibit B" attached hereto.
The easement, right-of-way, rights and privileges herein granted and dedicated to the
public shall be used only for the purpose of constructing, operating., repairing and
maintaining a public roadway and related appurtenances. through that certain tract of
land more particularly described on Exhibit A" attached hereto which is hereinafter
referred to as the "Easement Tract". The herein above granted tract shall replace the
herein released tracts and modify the existing 40' easement shown on recorded plat.
Subject to the foregoing and subsequent provisions hereof, Grantee its assigns,
agents, employees, workmen, and representatives shall, at all present, and future times,
have the right and privilege of ingress and egress, in, along, upon, and across said
property, for the purposes of locating constructing, maintaining, operating, inspecting
and , repairing said roadway.
It is expressly understood and agreed by and between the parties that this easement
and pudic dedication is for the extension of a roadway south of FM 5 I 8 along and
within the easement specified herein and the following provisions shall govern and
control such installation.
(1)
The easement, rights, and privileges herein granted shall be perpetual or for so
long as Grantee or its
assigns shall utilize the easement for the urposes intended. The easement,
nghTs and privileges granted hereunder shall terminate when, or at such time as
the purposes hereof cease to exist, are abandpned by Grantee,. or become
impossible of performance. The easement will also terminate if and when a
final plat is filed which includes a properly dedicated road right -or -way
covenng the easement granted herein.
(2) This conveyance is made and accepted subject to any and all matters of record
affecting the Easement Tract.
The Grantee herein shall be considered the general public and the use of the
easement shall be for public road purposes.. Nothing herein shall obligate any
public entity to accept or maintain any facilities constructed in said easement.
(4) Grantor does not, by the granting of this easement, assume or undertake any
responsibility for the construction or permanent maintenance of a public road
on the right-of-way dedicated herein and nothing contained herein shall alter,
amend, or modify any other agreements or obligations regarding road
constructions.

TO HAVE TO HOLD the above described easement for the said purposes, together
with all and singular, the rights privileges, and appurtenances as described above in
anywise belonging to the said Grantee, it's successors and assigns forever, subject to
the limitations set forth herein above.
The City of Pearland, (herein called Grantee) does hereby accept the above_ grant in
substitution, and does hereby Release, Quitclaim, and Convey to Charles W.
Kennedy, Jr., Trustee, (the .Grantor herein) any and all. of it's rights easement and/or
rights of way to the_following described real property in Brazona County Texas:
Release Tract I
3585 square feet of land within and on the east boundary of Lot 7 of the
Allison Richey Gulf Coast Home Company's Suburban Gardens Subdivision
of Section 21, H.T. and B. Railroad Company Survey, Abstract 309 as shown
in the subdivision plat recorded in Volume 2, page 23 of the plat records of
Brazoria County Texas being more particularly described by metes and bounds
in Exhibit "C" attached hereto and being shown in Exhibit `A".
AND
Release Tract 2
4767 square feet of land within and on the eastern border of Lot 4 of the
Allison Richey Gulf Coast Home Company's Suburban Gardens Subdivision
of Section 21, H.T. & B Railroad Company Survey, Abstract 309, Brazoria
County as recorded in Volume 2, page 23- of the plat records of Brazoria
County being adjacent and immediately west of Release Tract 1 described in
exhibit "C" and being shown in Exhibit "A" attached hereto.

corner of said 3.40 acre tract, same being in the centerline of a 40-foot wide platted road;

line;
